KOLKATA: The West Bengal National University of Juridical Sciences (NUJS), one of the country’s top law schools, has been rocked by a complaint of sexual harassment a week ahead of admission season.

A member of the vice-chancellor’s secretariat has brought charges of sexual harassment against a senior employee in the registrar’s department. The victim has alleged in written complaints to the VC and registrar that she has been receiving lewd e-mails and objectionable proposals from the accused. The harassment had allegedly been going on for over a year and the young woman had earlier verbally complained to the administration, but no action was taken. When she brought up the matter again with the registrar last week, he advised her to submit a written complaint.

Acting on the complaint, the university has set up a committee to investigate the case. The accused has been sent on leave. Two senior faculty members, a senior non-teaching staff and a teacher of Jadavpur University English department are members of the committee.

The accused, who has been with the NUJS for over a decade, called up TOI on Wednesday to say he had already resigned. “I have been framed. There is no truth in the accusation. There is a huge communication gap. In any case, I have resigned,” he said.

Registrar Surajit Mukhopadhyay, however, said he is yet to receive any such resignation.

“We have received a written complaint of sexual harassment and stalking from the victim and it has been forwarded to the committee for investigation. This is the first time that such a controversy has happened in the university and we have taken very serious note of the matter. If the accused is proved guilty, strictest action according to the law of the land will be taken,” Mukhopadhyay said.

Vice-chancellor Ishwar Bhatt assured that NUJS would do everything “to uphold the dignity” of the lady. “We are dealing with the complaint in the strictest terms. The accused is on leave andyes, he called me up to say he will resign,” he said.

Even as the NUJS campus was abuzz with the sexual harassment complaint, another controversy erupted when a final-year student was slapped in full view of others by a lady teacher. The student, who reached late for an exam, was stopped from entering the hall and asked by the teacher to first take permission from the VC. She argued that since she was just 15 minutes late she should be let in. This led to a heated exchange and the angry teacher slapped her.

Later, the VC intervened and the girl was taken to another room and given half an hour extra to write her test.

A committee set up to investigate the matter sent its report to the executive council which ruled that the faculty member be reprimanded for losing her temper. “We have tried to handle the incident in a very sensitive way, with full sympathies for the girl,” registrar Surajit Mukhopadhyay said.

 A 22-year-old woman accused five people, including two of her brothers-in-law, of raping her in south Delhi, police said on Wednesday.

In her complaint to police, the young woman alleged that she was gangraped by the five men late Tuesday night. The three others involved in the crime were friends of her brothers-in-laws, police said. The accused have all been arrested.

According to the woman, a resident of RK Puram, the men came to meet her husband for some personal work on Tuesday night. The woman said her husband was not at home at the time, but when she returned to her house, she found the men drinking alcohol there.

“She left to go elsewhere, but the men overpowered her and took her to an empty plot,” a police official said, quoting victim’s complaint.

“They snatched her bag and took turns to rape her. The woman somehow fled and sought help from a passerby who made a call to the police control room,” the official said.

“She was rushed to AIIMS Trauma Centre for medical examination. Her medical examination confirmed gangrape,” the officer said, quoting the woman’s complaint. On the basis of her statement, the police officer said, a case of gangrape was registered.

The accused were arrested after late-night raids, and presented before a magistrate who sent the five to judicial custody for 14 days, the officer said.

 13-year-old girl was allegedly gangraped by eight men, four of whom were known to her, police said on Saturday. The incident comes even as the capital is witnessing outrage over the horrific rape of a five-year-old girl.

Three of the eight men have been arrested.

The victim and her 12-year-old brother were abducted by two men known to her on March 15 from outside her house at Farsh Bazar area in east Delhi and taken to Loni in the city outskirts, where she was gangraped by the eight, a police officer said.

 Four of the eight accused were known to the girl, the officer added.

Police arrested three accused – Deepak, 21, Ranjeet (20) and Sohan Lal (24) – Saturday, following medical examination of the victim April 15.

The victim is undergoing treatment at the Hedgewar Hospital in east Delhi.

According to a police officer, the father approached police after she went missing, but did not file a rape complaint after she returned home.

A search is on to nab the other accused, the officer added.

Meanwhile, the girl’s family alleged that police had refused to lodge their complaint.

On March 24, the girl returned home and the family approached the police, the mother said.

Failing to get any response from police, the family approached the local court April 9 which then ordered police to lodge a rape case.

The five-year-old girl was brutally raped for two days and kept without food and water in a room in which the accused, her neighbour, lived. She was rescued Wednesday when her family heard her screams. The accused has been arrested from Bihar.

Delhi has seen 393 rapes in the first three months of the year.

 

Taiwan compensates trio after 11 years on death row


Taiwan will pay a total of Tw$15 million compensation to three men who spent more than 11 years on death row before their acquittal in one of the island’s most controversial murder trials, a court said Wednesday.

TAIPEI: Taiwan will pay a total of Tw$15 million compensation to three men who spent more than 11 years on death row before their acquittal in one of the island’s most controversial murder trials, a court said Wednesday.

Su Chien-ho, Liu Bin-lang and Chuang Lin-hsun will each receive about Tw$5 million for wrongful imprisonment, the High Court said.

The trio, who said they were tortured into making confessions, were first sentenced to death 21 years ago for the murder of a couple in Taipei.

Their legal plight began after a soldier who confessed in 1991 to killing the couple claimed that they were his accomplices. The soldier was executed the following year after a trial by a military tribunal.

They had since faced a series of trials and retrials that saw their death sentences being lifted and then reimposed until the High Court made a final ruling in their favour last year.

Taiwan’s human rights groups have seized on the case to call on the government to abolish capital punishment.

Like many Asian countries, Taiwan maintains the death penalty, reserving it for serious crimes including aggravated murder, kidnapping and robbery.

Last year, Taiwan executed six death row inmates, the largest number to be put to death in one day in recent years.

A young Nepalese woman was allegedly drugged, gang-raped by three young men in a car and then dumped in a jungle in South Delhi on Wednesday. The victim has been admitted to Safdarjung Hospital and is stated to be out of danger.

The 20-year-old woman was found in a semi-conscious state near Nanakpura Gurdwara in Moti Bagh around 7-30 a.m. on Thursday by a passerby. She had scribbled some words on the ground, including her name, indicating that she was raped and that she was a Nepalese living at Kotla (Mubarakpur) in South Delhi.

The passerby called up the Police Control Room at 7-40 a.m. The victim was then taken to Safdarjung Hospital in a police vehicle. “Her medical examination revealed no external or internal injuries,” said a police officer.

The woman is not yet fit for recording her statement, but she has been able to disclose her identity to the police. She got married a couple of months ago to a Nepalese living in Kotla Mubarakpur but had herself been living in a house at Defence Colony where she works as a domestic help. Her husband works at a restaurant in Greater Kailash.

The woman told the police that on Wednesday night she had gone to Chirag Dilli to meet her brother.

“She is unable to recall her brother’s name. She says that she went to his residence around 11 p.m. and found it locked from outside,” said the officer. The woman then went to a nearby bus queue shelter where she was waiting for a public transport vehicle when a car stopped close to her.

The car driver offered her a lift and oblivious of what lay ahead, she got into the vehicle.

On the way, two more young men, got into the vehicle.

“The woman told us that they first went to Vasant Kunj and then drove to neighbouring Gurgaon. She alleges that while travelling, the three youth offered her two glasses of cold drinks. Soon after she consumed the cold drinks, she fell unconscious and does not remember what happened thereafter,” said the officer.

The victim told the police that when she regained consciousness, she found herself lying in a jungle. She somehow walked some distance where an auto-rickshaw driver spotted her and finding her in that condition offered help. The driver then dropped the woman near Nanakpura Gurdwara.

“She has so far not accused anyone of having raped her. She does not remember the make of the vehicle in which she had taken lift and cannot also give the description of the persons involved. At this stage, she cannot recall whether she was raped or not. Therefore, on the basis of the PCR call we have registered a case of gang-rape and intoxication at the South Campus police station and are trying to reconstruct the sequence of events leading up to the incident. We have also contacted the victim’s husband,” the officer added.

NEW DELHI: In the first incident, a 15-year-old girl studying in a government school was allegedly abducted from east Delhi by three property dealers in an SUV, taken to a flat at Sarojini Nagar and raped for over three hours. The brutalized girl was then dumped near the Sarojini Nagar market around 1pm, after being warned that her family will be murdered if she approached the police.While the main accused – Pradeep, 28, a father of two – has been arrested, the two others, Rahul, 23, and Amit, 24, are absconding. A case of gang rape and kidnapping has been registered at the New Ashok Nagar police station. Police said the victim, a resident of Dallupara in the New Ashok Nagar, was on her way to school on Wednesday morning around 7am when three men in a black Scorpio stopped her. Since the victim knew Pradeep, she stopped to speak to him. “The accused reportedly took the girl to a flat in Sarojini Nagar, where they raped her one by one,” said a senior district police officer. The victim reached home in an auto and reported the matter to her parents.The second crime was also reported from east Delhi. A 5-year-old boy, enrolled in a private school in Govindpura near Jagatpuri, has alleged that his teacher had sodomized him inside the school. Police said the lower KG student returned home compaining of pain on Tuesday. “The parents reached the school on Wednesday where the boy identified the aggressor as a teacher named Pramod, 32,” police officer said. The accused has been arrested.

Two teenagers, including a Class 10 student, were apprehended for allegedly molesting a 27-year-old woman tutor in a moving bus in northwest Delhi’s Rohini on Monday evening. The cops nabbed the duo who, they said, were over 18 years old. While one of the two studies in Class 10, the other works as a labourer.

 

Bombay HC- Reimburse unaided schools for expense on SC/ST students #goodnews

Bombay High Court (HC) directed the state government Wednesday to reimburse unaided schools for expenses incurred on education of SC/ST students as per RTE Act.

The money — Rs 10, 463 per student per year till standard 7 or the actual amount spent, whichever less — is to be reimbursed irrespective of incomes of parents or guardians of the students from academic year 2010- 2011.

For higher secondary school students, the reimbursment is according to recommendations made by a state-appointed committee in 2010.

For schools in Mumbai, it is Rs 350; for those under other municipal corporations, it is Rs 250 and for the rest of the state, Rs 200.

Schools are also to be reimbursed for OBC, VJNT and SBC students the annual income of whose parents is less than Rs 1 lakh.

HC clarified while RTE Act could not be invoked against the wishes of minority unaided schools, institutions admitting students from disadvantaged sections could claim reimbursement.

A division bench of justices Mohit Shah and N M Jamdar said provisions of RTE Act should be read in the light of articles 21A (right to education) and 46 (promotion of educational and economic interests of weaker sections) of the Constitution.

HC noted though RTE Act applied to elementary education, the state had been giving the benefit of reimbursement to classes 9 and 10 as well.

MUMBAI: A eunuch was picked up by his neighbour and three others who bundled him into a vehicle, took turns to allegedly sodomise him for over three hours, singed him with cigarettes and then doused him in kerosene before throwing him out of the car early on Thursday.

The main accused, Mubarrak, has been arrested and the police suspect that a property dispute could be the motive.

Around 11.30pm on Wednesday, the 20-year-old victim and his two roommates-also eunuchs-left their Ghatkopar chawl and went to Naaz Hotel in Kurla (W) to pick up food. As they were returning, they were accosted by the accused and his three aides who were in a Maruti van. “I asked my roommates to go home. As I got into the car, the four threatened to kill our leaders. Then they took turns to have unnatural sex with me. They also burnt me all over my body with cigarettes. Before throwing me out of the van, they poured kerosene on me,” the victim said in the complaint.

After being thrown out on LBS Marg in Ghatkopar around 2.30am on Thursday, the victim took an auto to Rajawadi Hospital. The Vinoba Bhave Nagar police have detained a Ghatkopar resident for picking a 20-year-old eunuch from Kurla (West) at midnight on Wednesday and then he and his three friends gang-raped him for three hours and burnt him with cigarette all over the body. After committing the offence the accused poured highly inflammable chemical on the victim and throw him out of the moving Maruti Van on LBS Marg in Ghatkopar (West) at 2.30am on Thursday.

Hospital officials called the Park Site police who recorded his statements. The case has been transferred to the VB Nagar police who arrested Mubarrak.

The police suspect that property dispute was behind the offence. The victim stays on the ground floor of a chawl at Amrut Nagar in Ghatkopar (W), while Mubarrak stays on the mezzanine floor. “The victim and Mubarrak had fights over rooms and had also filed a case. We have registered a case of unnatural offences and are awaiting the medical report,” DCP Dhananjay Kulkarni told TOI. The accused have also been booked under sections 34 (common intention), 324 (causing hurt using dangerous weapon or means) and 506 (II) (criminal intimidation) of the IPC.

On Wednesday night, the victim and his two roommates (all eunuchs) had gone to Naaz Hotel in Kurla (west) and was returning back home at 11.30am with food parcel when she was stopped by Mubarrak and his three friends whom the victim claimed were in a Maruti van. “I asked my two roommates to go to home after Mubarrak asked me to sit in the van. For three hours they threatened of killing our leader and repeatedly had unnatural sex with me. They also used cigarette to burn all over my body. Before throwing me out of the moving van they poured kerosene on me,” the victim mentioned in the complaint.

MUMBAI: A 23-year-old woman was raped by four men through Wednesday night in the presence of her male friend at his home in Vile Parle (E). Her torture continued for more than five hours till her friend managed to hoodwink the accused and call up an acquaintance who led the police to the spot and got the four arrested.The accused, Rajesh Varma (21), Ramchandra Humbe (30), Krishna Kevat (31) and Mahesh Kewat (20), were produced in the Andheri magistrate court on Thursday. The court reprimanded the police for handling the case casually as they had not mentioned any strong point in the remand application. The officers had reportedly asked for the four’s custody stating that during the recording of witnesses’ statement, they wanted the accused in their custody to prevent them from threatening the witnesses. The court said such a request should have been made while opposing their bail application and not while demanding their remand. The magistrate subsequently remanded the four to police custody till March 20.Around 1.30am on Wednesday, a tourist taxi driver brought over his female friend to his chawl room at Sahar in Andheri (E); his wife and child were away to their village and he was alone at home. As the two walked towards the driver’s room, the four accused, notorious in the area for creating trouble, followed them, said the police.

The four, carrying alcohol bottles, barged into the room and accosted the man; brandishing a knife, they threatened him into silence, said the police. Even as three of the men pinned the driver down, one allegedly raped the woman.

After the first accused committed the crime, the four sat down and had a drink following which the remaining three took turns to allegedly rape the woman. The assault on the woman continued till morning when around 7am, the driver made an excuse of visiting the bathroom. From there, he called up his acquaintance. The friend approached the Vile Parle police who sent a team with him to the chawl. The four, who were still in the chawl room, were arrested and booked for gang rape, wrongful confinement and robbery.

The accused have confessed to have followed the victim and the driver to his room in the chawl.

KOLKATA: A 25-year-old woman with physical disabilities was allegedly raped by her neighbour in an abandoned house at Bhatikhna in the Behala police area on Monday.

The victim, however, told her mother about the assault nearly 48 hours later following which a police complaint was lodged on Wednesday.

The accused has gone into hiding.

On Monday evening, the victim was walking alone on the road when her 50-year-old neighbour, Bikash Ghosh, a house painter, lured her with food to an abandoned building near Bhatikhana.

Ghosh then allegedly raped the victim and left her there in a semi-conscious state.

Soon, three youths passing by the area heard the woman’s cry and took her to her house. The trio requested the woman’s sister-in-law not to allow her to go out of the house alone.

Later, the victim told her mother that three youths had brought her home and did not divulge any further details. Since she was traumatized, her family members did not disturb her, said a police officer.

It was only on Tuesday night that the woman mustered courage and told her mother that she had been raped by Ghosh.

The victim’s father lodged a complaint at Behala police station on Wednesday.

Police said that clothes the woman was wearing at the time of the assault had been taken for forensic tests. She will also undergo a medical examination.

However the delay of nearly two days will hamper the prospect of the investigation, an officer said. The medical tests should have been conducted within 24 hours of the assault. But the complaint came late, he added.

The woman, nearly 48 hours after the incident, confessed the incident to her mother. On Wednesday, a formal complaint was lodged by the father of the victim. The accused is however absconding.

On Monday, evening the accused Bikash Ghosh, 50, a paint-labourer found the victim alone on the road. He allured her with food to an abandoned house near Bhatikhana. There he raped her and left her abandoned in the house in a semi-conscious state. Three youths passing by the area rescued the woman after hearing the groaning sound of the woman.

Three youths then took her to her home at Tarpan Ghat Road and requested her sister-in-law not to allow the victim to go out of the house alone. They did not say anything else to victim’s sister-in-law. Later she told victim’s mother about three youths who had brought her home. But the victim was too traumatised to say anything. Her family members did not disturb her, said a police officer.

On Tuesday night, after settling down with her trauma, the victim confessed how she was raped by the accused. She broke down in tears. On Wednesday morning, they lodged complaint with Behala police station. Police said that the her clothes at the time of the incident were confiscated for forensic tests. She would also be undergoing medical examination.

However the delay, an investigating officer said, would hamper the prospect of the investigation. The medical tests should have been conducted with 24 hours of the incident. But the complaint came late.
