Man gets 10-year RI for locking wife's private parts
Chouhan’s cruelty had come to light after his wife tried to commit suicide by consuming poison.
INDORE: The district court on Friday sentenced a 45-year-old man to 10 years of rigorous imprisonment for putting a ‘chastity lock’ on his wife’s private parts.

Special additional sessions judge A K Singh found Sohan Lal Chouhan guilty under sections 326 (causing grievous hurt) and 498 A (subjecting married woman to cruelty) of the IPC. The court also imposed a fine of Rs 1,000 on him.

Public prosecutor Jyoti Tomar said Chouhan was arrested in July 2012. Out of the 14 witnesses presented before the court, three — including the couple’s son and daughter — had turned hostile. “However, the son admitted Chouhan hadn’t allowed him to meet his mother in the last four years,” Tomar said. “Besides, the statements of the doctor who had removed the ‘lock’, the policeman who had recovered the key from Chouhan and an independent witness helped in nailing Chouhan.”

Chouhan’s cruelty had come to light after his wife tried to commit suicide by consuming poison. While trying to insert a tube to extract the poison, hospital doctors were stunned to see the ‘locked’ genitals. She then revealed her husband had performed a crude surgery on her to ‘lock’ her private parts four years ago. In a statement, she said he suspected her of having an extramarital relationship.

The woman was married to Chouhan when she was 16 years old. She had consumed pesticide after Chouhan tried to rape their elder daughter.

LUDHIANA: Getting an Aadhar card made has become a problem for many residents in the city as most of them are not even aware of the centres where these Aadhar cards are being made. Absence of requisite staff and the enrolment kits used for making the cards is a major problem plaguing the project.”I have been hearing so much about the Aadhar card and how it is going to be a must in the coming times. However, the biggest problem for me is that I do not know where I should go to get this card made. It’s not only me facing this predicament as many of my friends too are encountering the same problem,” said TP Singh from GurdevNagar.
Advocate Yogesh Dewan, a resident of Model Town, also complained that he has not been able to get his card made as he does not know where it is made. “If at all the government is serious about making these cards, the work should be done in a proper manner. Area-wise centres should be opened at fixed places so that people know where to get the cards made without any hassle.”
When approached on the issue, District Food and Civil Supplies officer Lavkesh Sharma said, “Though we have many problems, work on the cards is being carried out. Wherever there are problems, we will definitely solve them.”

Bulandshahr (UP), Apr 8 (PTI): The callous response of police came to fore when a 10-year-old girl, who was allegedly raped, was put behind bars by women cops after she approached them to file a complaint along with her mother.

Two women constables have been suspended while two sub-inspectors including the station-in-charge have been sent to police lines following the incident, SSP Gulab Singh said.

The victim spent several hours behind the bars after her mother brought her to a women’s police station to lodge a complaint against a local goon for allegedly raping her. She was rescued only after locals protested over the matter.

According to Singh, the minor from Meerpur village here was found lying unconscious in a field by her parents last night where she had been dumped after being allegedly raped.

An FIR was lodged with the police by victims’ parents but shockingly the staff of the women’s police station detained the victim in lock-up. The girl’s medical examination will be conducted to confirm rape and investigations are on, Singh said. The local goon accused of raping the minor is absconding, he added.

Bhopal/New Delhi: In a fresh twist to the murder of RTI activist Shehla Masood, Bhopal Bharatiya Janata Party (BJP) legislator Dhruv Narayan Singh is all set to be the prime prosecution witness in the case. Singh was the prime suspect in the killing of Masood in Bhopal in August 2011.
Singh was recently quizzed by CBI after which the decision to make him the prosecution witness was taken, said reports. Bhopal-based interior designer Zahida Pervez and her friend Shaba Farooqi were also interrogated by CBI that revealed the BJP MLA had nothing to do with Masood’s killing.
It is to be noted that the BJP legislator was allegedly close to Shehla Masood and interior designer Zahida Pervez, who masterminded her murder.
Reportedly CBI sources said that the BJP MLA was reluctant to become a witness in the case. However, he agreed to their request later.
The flashback
Masood, an environmentalist and RTI activist was shot dead by three hired assassins outside her Bhopal residence in August 2011, allegedly at the behest of Zahida Parvez.
She was constantly living in threat, as revealed by her in an interview before her death.

New Delhi, India – The death of the prime suspect in the Delhi-gang rape case in his jail cell has turned the spotlight on a disturbingly high number of deaths in Indian prisons.

Officials at the high-security Tihar Jail say Ram Singh, 33, committed suicide early on Monday while four other inmates in his cell slept. Singh allegedly used a blanket hanging from a metal rod on the ceiling 2.5 metres high to hang himself, officials say.

Singh was one of six people on trial for the shocking gang-rape on a moving bus of a 23-year-old female student last December in New Delhi. The woman later succumbed to her injuries after she was thrown from the vehicle after her two-hour ordeal.

The case stunned the nation, drawing mass protests against violence against women and calls for new laws to curb such abuses.

“It is an appalling lapse on the part of the prison authorities that a prisoner on the watch list, with other inmates in his cell, hung himself to death and the guards too did not notice anything.

After reports of Singh’s death flooded out, questions were soon raised about how the bus driver could have committed suicide in a room full of inmates in a maximum security facility with a guard on duty.

Union Home Minister Sushilkumar Shinde admitted a “major lapse in security” over the incident, adding an inquiry would be established to investigate.

Defence lawyer VK Anand alleged Singh was killed. “I suspect foul play in my client’s death, and I do not think he could commit suicide. There were no such circumstances that could force him to commit suicide.”

Singh’s parents also said their son would not have taken his life and demanded a judicial probe. His mother, Kalyani Devi, said her son was repentant and ready to face justice.

“He confessed about his mistake, then why would he commit suicide? He was prepared for any punishment the government would have given him,” said Devi.

Though a subsequent autopsy points to Ram Singh’s death by hanging, speculation about the exact causes behind his death has not subsided.

“It is an appalling lapse on the part of the prison authorities that a prisoner on the watch list, with other inmates in his cell, hung himself to death and the guards, too, did not notice anything,” Suhas Chakma, director of the Asian Centre for Human Rights, told Al Jazeera.

Four custodial deaths a day

Singh’s death has highlighted the large number of inmates who die in India’s justice system.

Statistics from the National Human Rights Commission (NHRC) show from 2001 to 2010, 14,231 died in police and prison custody in India – about four deaths per day.

According to the latest data from the National Crime Records Bureau, 1,332 prisoners died in India’s jails in 2011 – 93.4 percent of which were “natural deaths”. Sixty-eight inmates committed suicide and eight were killed by other prisoners. “Deaths due to firing”, “Assault by outside elements”, and “others” accounted for the 12 other “unnatural deaths”.

But the Asian Centre for Human Rights said in a 2011 report that “a large majority” of custodial deaths “are a direct consequence of torture in custody”.

The actual number of prison deaths is likely far underreported, the group said.

“These deaths reflect only a fraction of the problem with torture and custodial deaths in India, as not all the cases of deaths in police and prison custody are reported to the NHRC,” the group said in report titled “Torture in India 2011”.

A Ministry of Home Affairs official declined to comment on this story.

Akhilesh Kumar, National Crime Records Bureau chief statistical officer, said, “Our main duty is to compile the numbers and we have no comment over causes … and what they reflect.”

Praful Bidwai, a New Delhi-based human right activist, told Al Jazeera that the impunity of police and prison officials when it comes to violence against inmates must be challenged.

“Custodial maltreatment, torture or killing cannot be curbed unless the deeply criminalised police and law enforcement authorities are made accountable,” Bidwai said.

Policing law enforcers

Tihar Jail where Singh died is the largest prison in South Asia – and severely overpopulated. Tihar houses some 12,000 inmates, overshooting its capacity by about 6,000 prisoners. In 2012 Tihar recorded 18 inmate deaths, two of those said to be suicides.

Another problem with India’s justice system is the astonishing lack of urgency when it comes to due process. Once ensnared in India’s court system, the wait for justice can be an arduous one.

A backload of more than 20 million cases is now before the country’s courts. Bail is often refused for serious offences, and there are no mechanisms to compensate the wrongly accused who spent years jail awaiting trial.

Worse still, everyone agrees that conditions inside the jails border on the horrific. Ram Singh’s father, for one, has alleged that his son was sodomised by other inmates. Others, including a Delhi professor who spent months in Tihar as a suspect for alleged links to a deadly attack on the Indian parliament in 2001, have narrated their nightmarish experiences.

Since acquitted, Iftikhar Geelani still carries the scars of his hellish incarceration, during which he says he was routinely abused and forced to wear an excreta-splattered shirt with which he was ordered to mop a filty toilet.

Meenakshi Ganguly, South Asia director for New York-based Human Rights Watch, told Al Jazeera local human rights workers have repeatedly expressed concern about torture and custodial killings. She said most incidents occur in police custody, rather than in prison facilities.

“In jails, we have heard more about ill treatment by fellow inmates or guards, particularly against terror or rape suspects,” Ganguly said.

Tackling the criminality of police and prison authorities is one way to curb custodial torture and death in India’s justice system, activists say.

Bidwai said other than meting out stiff punishment for law enforcement officers who abuse prisoners, other methods need to be employed such as sensitivity training towards inmates.

“Custodial maltreatment, torture or killing cannot be curbed unless the deeply criminalised police and law enforcement authorities are made accountable.

Having neutral observers during interrogations, and disallowing confessions to the police as evidence would also weed out “rogue elements among police and prison authorities”, said Bidwai.

“Such steps will send the right message down the line,” he added.

However, with much of the public unsympathetic to the plight of those jailed, it will be hard to convince politicians to enact the necessary legislative changes, Chakma of the Asian Centre for Human Rights said.

“The lack of political will to stamp out custodial torture runs across all political parties,” said Chakma.

Ram Singh, main accused in the horrific gang-rape case of 23-year-old physiotherapy student on December 16, 2012 which caused massive nationwide outrage, allegedly committed suicide in a high-security cell in Tihar Jail early on Monday morning, raising questions over monitoring of undertrials.

Significantly 33-year-old Ram Singh, who had a slight deformity in his right hand after an accident, hanged himself from the grill of his cell in jail No.3 using his clothes, jail officials said.

“Singh was not alone in the cell when he committed suicide. Other inmates were present and a guard was also posted. But nobody came to know about it. Around 5am, he was found hanging,” a senior jail official said.

Prone to violent behaviour and mood swings, he had suicidal tendencies and was under “suicide watch,” he said.

Singh, who was to be produced before court for its daily hearing, was rushed to the jail hospital where he was declared brought dead. His body was taken to Deen Dayal Upadhyay Hospital for post mortem.

The news of his death immediately triggered demands from his lawyers and family for a CBI probe. They alleged that he was murdered inside the jail and refused to believe that he could have committed suicide.

“There were no circumstances which could have led to Ram Singh committing suicide. There was no mental stress. He was very happy,” his lawyer VK Anand said. Lawyers for the defendants had previously accused police of beating confessions out of the men.

JALANDHAR: Even as a medical board set up to probe the alleged gang rape of a minor dalit girl is yet to finalize its report, police on Sunday added stringent sections of the Protection of Children from Sexual Offences Act, 2012, pertaining to ‘aggravated penetrative sexual assault‘, to the FIR.

Sections 5 and 6 of this Act have been invoked even as police officials till Saturday had been looking into “some grey areas” in the statement of the victim’s father. The Act also provides speedy trial by a special designated court.

Meanwhile, three accused arrested in the case after they surrendered before the police on Saturday were remanded in police custody till February 13 by a Nakodar court on Sunday. The three are distantly related to the girl and had pleaded innocence. However, the victim’s family has been holding on to the allegations it levelled on January 6, the day when the girl was first rushed to Lohian Hospital and then to Jalandhar Civil Hospital with life-threatening septicemia.

It was only after being shifted to the hospital that the family had alleged that the girl was raped on the night of January 28 in Mandhala Chhanna village. The girl was finally operated upon in Amritsar where her badly infected and ruptured uterus was removed by doctors to save her life and her intestine was repaired.

The victim’s family also alleged that on Saturday some “anganwari worker” visited their home and rebuked the girl’s mother, who fainted after that. She was rushed to the Civil Hospital in Lohian with the help of police personnel posted in the village on Saturda

Identities like Social Security Number (SSN), or National Insurance Number (NI) in the west, or Aadhaar now in India, promise to validate not just identity. Through identity as the master-key (index field in database technology), the respective security agencies can relate identity to past, present and future personal data. For example, PDS querying theAadhaar database for identifying a citizen then digs into its own database to validate, if the said recipient had availed the benefit before.

It is important to know that all such validation means and requires more data capture of all kinds for all seemingly legitimate purposes, so that such validations can be done against it. But each custodian of data—from front-end shopkeepers to ministries and more—also starts keeping copies of such data for validation, commercial use, corruption, stalking or just like that for the future. More data and more copies of data mean a death knell for privacy. Why create such targets of interest for vicious minds. Can the creator of such a Frankenstein monster absolve itself of such consequences merely because it was not the original intent but the creator failed to see the possibilities?

Both USA and UK had a huge hue and cry over possible ramifications of such invasion of privacy despite relatively mature, trusted, independent agencies, unlike India. Australia attempted national ID cards way back in 1985 but withdrew them in 1987 after severe opposition from all quarters.

dead, buried and crushed…What we are destroying today is the last elements of the national identity register, which was always the most objectionable part of the scheme.”

On a similar note, there is a public outcry in the USA, in the aftermath of the Petraeus scandal. NSA whistleblower William Binney in a TV interview, said on the surveillance by US government, “They are building social networks on who is communicating with whom… social network of every US citizen is being compiled… .they are taking from one company alone 300 million records a day (for storage)…over time accumulated to close to 20 trillion every year… the original program that we put together to handle this was to be able to identify terrorists.”  He also said that the original plan was to encrypt all mails and decrypt only those that met certain criteria of security risk. Every single tweet from twitter is archived in the US Library of Congress. Big data and the world’s best processors and servers run algorithms to not just identify terrorists but for all political purposes. It is at best a poorly kept secret.
There are eerie similarities between the ways the US government agencies track personal information, how it came into being quickly after 9/11 fears, how it was intended and where it is now at. The immense power the state gets through controlling such information is enough temptation for any ruler. We have seen through mass exposes on corruption in recent times that there is enough power-sharing between powerful elite of politicians. This includes the opposition, big businesses, bureaucrats and policing agencies. They buy out any resistance from any quarter.
The US attempt to have stronger identification systems (“Real ID” linking many IDs from driving license to SSN and more, in the aftermath of 9/11) was defeated as 25 of 50 statesopposed it. Some of the irrefutable objections were:

  • • “It went against Jeffersonian principles of individual liberty, free markets and limited government”.
  • • “There is no practical way to make national identity document fraud-proof”.  “Costs of identification—in dollars, lost privacy and lost liberty, are greater than security provided”

Electronic Healthcare Records (EHR) in the US too aimed to create unified personal database of health history. Despite obvious efficiencies, it is not finding favour with the masses.  The people do not trust corporate entities (who lobby with the government) withpersonal health histories.
Many argue that even without UID, it was not difficult for the state to ferret details of any individual. The whole point now is the ease, speed and volume of such actions. And the ease, speed and volume are not altered by increments but by order of magnitude. Getting the political dirty tricks department to scour files of activists opposed to government is so common today. Ramdev, Kejriwal, Anna, VK Singh, Vinod Rai, have all had possibly true, half-true and even false witch-hunts launched based on information dug up on them selectively and viciously. How can one trust such state with omnipotent powers of handling all personal data?

A lot has been said in the media criticizing the Aadhaar on multiple lines. I desist from repeating issues of risks with process, technology, costs, promised chimera of zero corruption in PDS and more (a complete and logical argument can be made on what to expect on the PDS front—and believe it or not, it makes no dent into corruption levels in PDS. Only form changes). It is not just the one-time costs either. It is a maintenance monster on the budget.
But I restrict and further extend arguments on privacy issues that are the most serious of the risks.

Aadhaar and its aftermath

 

Apart from the state using information selectively against political opponents whether to buy votes in parliament, silence political opponents or power-mongering over citizens, corporates and global MNCs also have sufficient interest in prizing information of citizens.
An insurance service provider would be keen to get all personal information and then base its decision on them. This can be done with, or without, revealing the source of such information. Illegal or unethical, motives for such actions would be created by Aadhaar. Motives established, such acts are only a matter of time.
Similarly, any marketer would love to obtain such information to do targeted marketing. Companies want it and when demand exists, through bribery or legal means, such information would be public. Attending one such govt-industry event where entrepreneurs showcased their proposed business models riding on UID data, was, to say the least, scary in terms of threats to personal data privacy. Even today, most civil/ criminal cases in courts are fought on evidence of illegally obtained telephone bills, call records and bank/credit card details. Tomorrow there will be more and easier availability of proofs and a larger grey market trading in private information would emerge.

The corporate sector has vested interests, short-sighted though, in supporting UID for the moolah it generates through the projects. That some of these companies/ partners working on projects have CIA directors on board and gather crucial biometric data is already voiced as a risk in itself.
It is also argued with good reason that by having such a lucrative database, we are creating incentives for wrong interests—from hackers to enemy nations. Probability is low or high is a premature question and not of primary concern. But given the risks, it is enough to worry about.
The way ahead is to raise public awareness and stall this costly and dangerous experiment by over-riding the vested interests of a few. Step by step, adding data agency by agency, and integrating link by link we are headed towards an Orwellian state that wishes to control all aspects of our lives. The benefits of not having such controls over our lives far exceed the restriction on our freedom. The world has studied, debated and moved on from the idea of unified personal ID. Indians should not allow ourselves to be the guinea pigs of the world.

New Delhi, (PTI): Rapper Honey Singh, who was forced to cancel his scheduled New Year’s Eve show following protests in the backdrop of gangrape incident, on Tuesday sought to wash his hands off the controversy triggered by offensive lyrics in some of his songs.

Singh, 28, who has sung for several Bollywood movies, said he had not authored the lyrics that are being attributed to him.

The lyrics have been termed offensive towards women by activists, who have started an online campaign against Singh.

An FIR has also been lodged against the rapper in Lucknow.

When contacted Singh’s manager Anup Kumar claimed that the Gurgaon show was cancelled not because of the protests but in solidarity with the Delhi gangrape victim.

“We did not cancel the show because of this petition and FIR. We cancelled it in the wake of Delhi gangrape issue.

This is not the first concert we are cancelling in Delhi after that horrific incident. We had also cancelled our much publicised December 25 event,” Kumar told PTI.

Bristol Hotel, however, disputed Singh’s version, saying it was the management and not Singh, who decided to cancel the performance.

The FIR against Singh was lodged by Gomti Nagar police on the complaint of IPS officer Amitabh Thakur, police sources said in Lucknow. The FIR was registered under sections 292, 293 and 294 of the IPC that are related to obscenity offences.

‘To Clarify Some Rumors…’

I’ve been listening to rumors about Zeest’s origin for quite some time now. Some people have also associated songs by other bands with us. Instead of being eliminated, they are increasing day by day. There have been some reasons behind it. Some of the mistakes are from our side. We have not been able to communicate with our fans properly due to the lack of proper media attention. While people did the rest in pumping the rumors; I was really disappointed to learn that normally people don’t care to do a little bit research on what they listen. Only believing the words of mouth and spreading the news to everyone.

I would like to clarify some of the rumors roaming around the public:

  • Zeest doesn’t belong to IIT India. Zeest is a KarachiPakistanBased Band and it has nothing to do with IIT thing.
  • Songs like GMD, XL ki Kudiyan or Balatkari don’t belong to us. Kindly give credit to the actual artists.
  • Zeest don’t do only swear/slang words songs. You can’t judge any artist from only one song. The purpose of our song BC Sutta is not swearing at all. So far we have release only one song i.e. BC Sutta. Please don’t predict what the rest of our music will be like.
  • Zeest never released any official videos regarding their songs, interviews, or any public appearances. Whatever you guys find on youtube.com is totally fans related material.
