PRESS NOTE
National Commission for Protection of Child Rights (NCPCR) has summoned concerned
officers of Government of Jharkhand to appear before it on 21st May, 2013 for non compliance
with some recommendations of the Commission pertaining to child rights violations in the State.
Ms Mridula Sinha, Principal Secretary, Department of Social Welfare & Women & Child
Development, Government of Jharkhand has been summoned for non-compliance with some of
the recommendations made by the Commission on 8.10.2012 for State level actions, such as, to
tackle the situation of malnutrition, functioning of ICDS Centres, non-availability of pediatric
medicines at AWCs, Observation Homes/Special Homes and issues related to child trafficking.
Shri K. Vidyasagar, Principal Secretary, Department of Health & Medical Education, has
also been summoned for hearing on the same date in the matter of an illegal sterilization surgery
of a 16 year old boy in Kanke Public Health Centre in Ranchi District.
Dr. M. Tamil Vanan, Senior Superintendent of Police (SSP),Khunti has also been
summoned on the same date in the matter of killing of a 17 year old boy by CRPF and Police
jawans under Karra Police Station in Khunti District

A murder suspect was given injections of acid and kerosene during police questioning in Uttar Pradesh, following which he fell sick and died in a hospital. Three errant policemen were suspended, an official said on Saturday.

Accused Balbir was brought to Avagarh police station in Etah district on Thursday and allegedly made to sit on a hot plate and given injections of acid and kerosene.

He died of infection and lacerations at a hospital in Lucknow on Friday evening, police said.

Family members of Balbir alleged that police tortured him to force him to confess to the crime.

Deputy Inspector General of Police, Aligarh, Prakash D. said that Etah‘s Senior Superintendent of Police Ajay Mohan Sharma suspended sub-inspector Shailendra Singh and two others.

A case has been registered against the errant policemen and a magisterial probe ordered into the incident, a police official said.

Savage, inhuman torture & molestation by Jalangi police

Respected Sir,

 

I want to draw your kind attention regarding the matter of custodial torture committed upon Mr. Ariful Islam Sarkar by the police personnel of Jalangi Police Station. Our fact finding report provides the detail of the whole incident.

 

On the date of the incident the involved police personnel trespasses the victim’s house and brutally assaulted the victim in front of his wife Ms. Rina Bibi. They molested the victim’s wife by pulling her clothing.  After that the perpetrator police personnel forcibly took the victim to Jalangi Police Station and the victim was brutally assaulted by them inside the said police station during his custody. He was even waked at midnight, stripped naked and bashed. The victim received injuries over his body during the assault. After that the victim was medically treated at Sadhikandiyar Primary Health Centre and Murshidabad Medical College and Hospital; Baharampur. In both the places he informed the details of physical torture by the perpetrator police personnel to the attending doctors. Later, he was sent to prison and on 01.04.2013, the victim got bail. On 08.04.2014, the victim lodged a written complaint before the District Magistrate and Superintendent of Police, Murshidabad informing the incident of physical torture committed upon him by the involved police personnel of the Jalangi police station. But till date no actions has been taken by the higher authorities of the police.

Hence we seek your urgent intervention and demand for: –

 

·       The whole incident must be investigated Your own independent agency.

·       The involved police personnel of Jalangi Police Station must be booked under the specific law and prosecuted for their alleged criminal acts and acts committed in violation of law.

·       The victim and his family must be provided adequate compensation and protection so that they do not come under any further threat or inducement.

Name of the victim: – Mr. Ariful Islam Sarkar, son of- Late Abul Kasim Sarkar, aged about- 50 years, by faith- Muslim (backward community), residing at Village- Nabingram -Sagarpara, Police Station- Jalangi, District- Murshidabad, West Bengal, India.

 

Name of the perpetrators: – Mr. Mainuddin Khan (Assistant Sub-Inspector of Jalangi Police Station) and 4 other involved police constables of Jalangi Police Station.

 

Date and time of incident: – On 29.03.2013 at about 2 pm.

 

Place of occurrence: – Victim’s house at above mentioned address and inside Jalangi police station.

 

Case Details: –

 

It is revealed during fact finding that the victim is an agricultural labour. His financial condition was impecunious and he is living under financial duress.  He was not been enlisted under Below Poverty Line (B.P.L) category. In the year 1995, the victim got married with Ms. Selina Parvin, daughter of Mr. Ajimuddin Mondal. Fact finding reveals that she was from financially well off family as her father was a government employee. As a result, after their marriage, she developed marital discontent. In the year 2006, she left the victim’s house. The victim tried to convince his wife and father in law for her return but failed. Ms. Selina Parvin filed a divorce petition for the dissolution of her marriage with the victim. In the year of 2006, the victim got remarried with Ms. Ruma Bibi after getting divorce from his earlier marriage. This infuriated Ms. Selina Parvin and she started to conspire against the victim.

On 26.05.2010, she filed a petition under section 125 of Criminal Procedure Code before the Judicial Magistrate, 1st Court, Berhampore against the victim vide Execution Case No.-233/2010 and the court (JM 1st Court, Baharampur) ordered the victim to pay sum of Rs. 1800/- as maintenance per month to Ms. Selina Parvin. But the victim failed to pay few instalments of monthly maintenance due to his financial distress and as a result the court issued arrest warrant against the victim on the basis of non-payment of maintenance.

On 29.03.2013 at about 2 pm, Mr. Mainuddin Khan an Assistant Sub Inspector of Jalangi police station accompanied with four other police constables of Jalangi police station came to the house of the victim by an ash coloured Bolero make four wheelers. They trespassed into the victim’s house and at that time police force was not accompanied by any lady police. They foul mouthed with the members of the family and verbally abused the victim and his wife with filthiest language having sexual connotation. The police personnel brutally assaulted the victim in front of his wife with their wooden sticks and forcibly shoved the victim to the courtyard of his house, then Ms. Rina Bibi was molested by the said police personnel while she was asking for release of his husband from their clutches. During the melee the police personnel pulled her wearing, unclothed her and intentionally touched her private parts. In the mean time the perpetrator police personnel repeatedly had beaten the victim while they dragged the victim to their parked car. The victim was taken to the Jalangi police station and was put into the lock-up. The said ASI, Mr. Mainuddin Khan got the victim out from the police lock-up at midnight and again bashed him up. He was kept naked at the lock up for whole of night. While the victim asked for drinking water, the police personnel present at the time with the said ASI tried to force the victim to drink his own urine instead of giving him a glass of water

On 30.03.2013 at about 9 am, the victim was taken to Sadhikhandiyar Primary Health Centre for medical treatment. The victim informed the attending doctor; Dr. Nurujamman about the horrific physical torture meted upon him by the mentioned police personnel at the Jaangi police station. On 8.4.2013, he was again treated at Murshidabad Medical College and Hospital at Beharampur, after released from judicial custody on 1.4.2013 after granted bail from the court.

On 07.04.2013, our fact finding team wanted to talk with Mr. Mainuddin Khan; the involved ASI through telephone (03481-23553) regarding the incident of physical torture upon the victim by him. But the said police personal refused to discuss the issue and abruptly disconnected the telephone line. Our fact finding team again called to the said police station over telephone and wanted to know the details of the incident regarding the matter of custodial torture upon the victim by the police personnel attached with the police station. But the then Duty-Officer disagreed to discuss the happenings and he also disconnected the line in a haste.

On 08.04.2013, the victim lodged a written complaint before the District Magistrate and Superintendent of Police; Murshidabad, informing the whole incident of custodial torture committed upon him by the police personnel of the Jalangi police station. But till date no appropriate actions have been taken by the higher authorities of the district or police administrations.

I want to draw your kind attention regarding the matter of sexual abuse committed upon the minor victim boys by the perpetrator BSF personal. The incident took place within the jurisdiction of Swarupnagar Police Station, District-North 24 Parganas, West Bengal.

On the date of incident the perpetrator BSF personal took sexual pleasure by forcing the minor victim boys to act at his whims. Our attached fact finding report gives details of the incident. The incident continued for an hour. The heinous incident sexual torture and abuse committed upon the victim boys was primarily complained to the BSF Official but the family of the victim boys did not get any relief. One written complaint was lodged before the Superintendent of Police, North 24 Parganas informing the whole incident of sexual offence committed upon the minor victim boys by the perpetrator BSF personal. But till date no action has been taken by the said authority.

Hence we seek your urgent intervention regarding the following matters: –

·       The whole matter must be investigated by Commission’s own investigating wing.

·       The perpetrator BSF personal must be booked under the law and should be prosecuted under Section 377 of Indian Penal Code and the criminal law and the Juvenile Justice (Care and Protection of Children) Act, 2000 considering the complaint lodged before the Superintendent of Police, North 24 Parganas.

·       The victims and their families should be provided with adequate compensation as well as protection so that they do not come under threat or inducement.

Name of the perpetrator: – Mr. Ramkumar being BSF jawan at Gunrajpur BSF BOP under Police Station- Swarupnagar, District- North 24 Parganas

Date and time of the incident: – On 17.03.2013 at about 1 pm

Place of occurrence: – Inside Gunrajpur BSF Border Out-Post (BOP).

Case details: –

It is revealed during fact finding that on 17.03.2013 at about 1 pm Mr. Ramkumar being the BSF jawan of Gunrajpur BOP, BSF called the victims inside the Gunrajpur Border Out-Post while they were playing with each other on the street adjoining to the said out-post.  After that the perpetrator BSF personal put off his wearing pant while they came inside the said out-post. The perpetrator BSF personal forced the victims to hold his genital and asked them to rub it by hands. The perpetrator BSF jawan started to enjoy sexual pleasure by abusing the victim boys. The victim Master Sagar Sarkar could be able to escape the place with fear. But other two minor victims could not be able to escape from that place. The perpetrator BSF personal forcibly penetrated his genital into the mouths of those minor victims and brutally seduced them for an hour. After that the perpetrator BSF personal illegally detained those minor victims after completely seducing them. The minor victims were seriously felt sick due to such inhuman sexual abuse the perpetrator BSF personal of that said BSF out-post. After that Master Hridoy Das and Sanjib Das returned to their homes and informed the whole incident to their family members. Ms. Laxmi Das, the mother of Master Hridoy Das went to that said BSF out-post to inform the whole incident to other BSF jawans of that said BSF camp taking with Mr. Sahidul Gaji, the member of local Gunrajpur Gram Panchayat. Mr. Sahidul Gaji talked with others jawans of that said BSF camp and told Ms. Laxmi Das to solve that matter in exchange of money. But she did not agree to do that. After that one BSF jawan called the Commanding Officer of the said out-post and informed him the whole incident. The Commanding Officer came to the camp and the whole matter was video recorded by them. After that he took her signature in a blank paper and told her that the total cost of medical treatment of those minor victims would be paid by them and also convinced her by saying that the perpetrator BSF personal would be punished regarding the matter of physical molestation upon the minor victims. After that the Commanding Officer threatened her saying that they would suffer if they dared to disclose the incident to anyone and also told the member of the Gram Panchayet not to disclose the matter to anyone.

On 02.04.2013, Ms. Laxmi Das lodged a written complaint on behalf of the victims before the Superintendent of Police, North 24 Pgs informing the whole incident of sexual abuse committed upon the minor victim boys by the perpetrator BSF personal. But till date no action has been taken by the said authority.

#India Police insensitivity- Gangraped migrant women approach Delhi Police for justice

The Haryana Police’s sensitivity towards crimes against women has once again come under scanner, after two migrant Dalit women, who were allegedly gang-raped and paraded naked by their employer at a brick kiln in Dhanana village of Bhiwani district, had to approach the Delhi Police through an NGO headed by Swami Agnivesh for getting justice.

The victims, a 33-year-old woman and her 22-year-old sister-in-law, who were being kept as bonded labourers in the brick kiln, had approached the Bhiwani police last Saturday with a request for their release as bonded labourers, but the police allegedly turned a deaf ear to their complaint.

A policeman allegedly told the women that they deserved this treatment and “something bigger could happen to them by the evening.”

On the same night, they were allegedly gang-raped by the brick kiln owner and two others.

The women, who belong to Budelkhand, alleged in their complaint to the Delhi Police that they were gang-raped by three men, including the brick kiln owner for two days.

“My employer used to beat me with sticks and torture me regularly when I used to ask for wages. He and two of his brothers even forced me to parade naked. They fractured my fingers and bruised my body. And this has been happening for the past six months,” one of the victims alleged.

Bandhua Mukti Morcha, an NGO to help bonded labour and headed by Swami Agnivesh, helped the women approach the Delhi Police and narrated their tale of woes.

The Delhi Police registered an FIR under Section 376-D of the IPC on the complaint of the women and informed the Bhiwani police last night.

Bhiwani Superintendent of Police (SP) Simardeep Singh said the victims were being brought to Bhiwani for recording their statements.

He said the police would incorporate relevant sections of the IPC in the FIR after recording the statements of the victims.

Simardeep Singh said the police would verify the allegations against the local police and would take action if anyone was found guilty.

Senior UP policeman arrested for allegedly trying to marry minor girl

Chandauli (Uttar Pradesh): A senior police official was today arrested for allegedly trying to marry a minor girl in Balua area of Chandauli in Uttar Pradesh, police said.

Pradyumn Kumar Yadav (45), posted as DSP in Raipur (Chhattisgarh), was arrested during his bid to tie the knot with a 13-year-old girl at a temple in Uttarigaon village in the district, Superintendent of Police Sharad Sachan said.

The arrest was made after villagers informed the police about the act of Mr Yadav.

The victim was physically assaulted, verbally abused by the perpetrator BSF personnel without any reason and cash of Rs. 2230/- and one mobile set was arbitrarily seized from his possession by the perpetrator BSF personnel on the date of the incident. Our attached fact finding report gives the details of the incident. The victim lodged a written complaint to the Superintendent of Police, Murshidabad informing the whole incident of physical torture and false implication committed upon him by the perpetrator BSF personnel. But no actions have been taken against the perpetrator BSF personnel by the higher authority. The victim is now living under fear after getting warnings and threats from police and BSF personnel to withdraw his complaint against the BSF personnel lodged before the Superintendent of Police, Murshidabad.

Hence we seek your urgent intervention regarding the following matters: –

·       The whole incident must be investigated by the Commission’s own investigation wing.

·       The perpetrator BSF personnel must be booked under the law immediately and prosecuted under the criminal law in open court of law.

·       The role of the police of Raninagar Police Station must be investigated regarding failure to act lawfully in the matter of the victim.

·       The victim must be relieved from the false charges and should be provided adequate compensation.

·       The family of the victim and the victim must be given adequate protection so that they do not come under threat or inducement.

·       BSF personnel obstructing villagers to cultivate their land be stopped without delay.

Name of the perpetrators: –

1.  Company-In-Charge of Kaharpara BSF BN. No-130 2. One officer Intelligence Branch of BSF and 3. to 8. Other six involved BSF jawans of Kaharpara BSF BN. No-130 under Raninagar Police Station; 9. Mr. Sumit Talukdar, the Officer-In-Charge of Raninagar Police Station

Date and time of the incident: – On 13.02.2013 at 1pm

Place of the occurrence: – In I.B.B Road at Kaharpara under Raninagar Police Station.

 

Case details: –

It is revealed during fact finding that the victim is living with his wife Ms. Habiba Sultana, aged about 30 years and with his two sons namely Mr. Sakhil Habib, aged about 14 years and Mr. Nur Alam, aged about 9 years. Cultivation and selling fodder are the ways to survive their livelihood. He is involved in various social works. He is also a victim of political rivalry.  The father of the victim was reportedly murdered as a result of political rivalry before few years back.

On the date of incident at 10 am, the victim went to his cultivation field which was situated in Radhakrishna Mouja Dag No- 1345-1349-1275 to observe the crops. At about 1pm, he was illegally restrained by six BSF jawans of Kaharpara BSF BN. No-130 while he was returning from the field. They asked the victim to show his voter identity card. After that they without sounding any reason started to brutally assault the victim by fists and blows. The perpetrator BSF personnel repeatedly slapped him on his ears and chest and forcibly snatched cash of Rs.2230/- from his possession and one mobile set from him. After that the perpetrator BSF personnel put him into life threat and tried to accuse him as a smuggler. The perpetrator BSF personnel also threatened him that he would be falsely implicated in a case if he refused to say that he has an involvement in smuggling. The victim was also verbally abused by the perpetrator BSF personnel and he was brutally assaulted again. Thereafter the victim was taken by the perpetrator BSF personnel to Raninagar Police Station by car. He was falsely implicated in a criminal case on the basis of a written complaint of the perpetrator BSF personnel which was treated as First Information Report (F.I.R) vide Raninagar Police Station Case No- 134/13 dated 13.02.2013 under sections 188 of Indian Penal Code and 12 of P. P. Act. In the said criminal case there was another co-accused namely Mr. Mahiriddin Seikh who was reportedly arrested by the BSF personnel on 12.03.2013.

On 14.02.2013, the victim was produced at Additional Chief Judicial Magistrate Court, Lalbagh. He was released on bail. The Company-In-Charge and the officer of Intelligence Department (I.B.) of Kaharpara BSF BN. No-130 threatened the victim to implicate him false charges again and even to kill him if he dared to inform the incident of physical assault to anyone. On 15.2.2013 the victim got medical treatment from one local Doctor namely Mr. Nishir Kumar Sarkar who recorded the injuries sustained by the victim. The said doctor referred the victim to hospital for further treatment. Later he was medically treated in Berhampore General Hospital.

On 20.02.2013, the victim lodged a written complaint before the Superintendent of Police, Murshidabad through courier informing the whole incident of physical torture committed upon him by the perpetrator BSF personnel.  But till date no action was taken on the basis of his complaint.

On 26.03.2013, the victim talked with our fact finding team and he informed that the Investigating Officer (I.O) of Raninagar Police Station of the above mentioned criminal case warned him that he would face grave problems for sending complaint letter to the Superintendent of Police, Murshidabad informing the whole incident of physical torture committed upon him by the perpetrator BSF personnel and also said that if he is implicated in a false case again then there would be none to survive him from that situation. The Investigating Officer of that said police station told the victim that if he did not withdraw the complaint which he lodged before the Superintendent of Police, Murshidabad, he would pay the grave consequences for that. The victim’s life now came under threat. At present the victim is living under fear after getting warning from the Investigating Officer (I.O) of Raninagar Police Station and BSF personnel. The victim till date did not get back his mobile set and cash of Rs. 2230/- which were arbitrarily seized from him by the perpetrator BSF personnel without issuing any seizure list.

#India – Panchayat cuts off girl’s hair in public for allegedly eloping #Vaw #WTFnews


The police has registered a report against 16 people for being part of a tribal panchayat which punished a girl recently, for allegedly eloping, by cutting off her hair in public.

The tribal panchayat at Chikhlar village situated about five kilometres away from Betul district headquarters also punished the girl’s uncle for allegedly eloping with her, by making him run around with a garland of shoes and a grinding stone tied to his chest.

Though the girl aged about 18 pleaded that her uncle had kidnapped her from the village market, the tribal panchayat allegedly did not listen to her pleas and insulted her.

The villagers vociferously have protested against the police action yesterday before the Superintendent of Police (SP) office here, demanding that the report be withdrawn.

They also justified the action of their panchayat as it was their “tradition”.

Terming the panchayat’s decision as illegal, the police said that a case has been registered and a further probe is on.

So far, 13 persons have been arrested and released by the police on a personal bond and a search is on to trace the remaining three culprits.

The police had intervened following a tip-off by an anganwadi worker and the girl’s family members spoke out against the panchayat diktat.

Her uncle who has been accused of eloping with her three months ago, was married, with two children.

He returned to the village on March 19 after which the local tribal panchayat met on March 20 to issue the diktat, police sources said.

The four accused persons attempt to murder 17-year-old girl

A 17-year-old Dalit girl survived a murderous attack after sexual assault, allegedly by four persons, who posed as plainclothes policemen at Singarakonda under Addanki police station limits in Prakasam district in the wee hours of Thursday.

Two of the accused were nabbed. Based on the information given by them, their associates were held later in the day, Superintendent of Police K. Raghuram Reddy said. The four followed the girl and her male relative after noticing that they were moving away from the crowd of devotees towards a hillock. Posing as plainclothesmen, they persistently questioned the two, including about their caste, and intimidated them. They then took the girl to a secluded place near a Gurukula Patasala and committed the offence, Dr. Reddy said.

They tried to strangle her, but fled after some devotees raised an alarm and alerted two police constables, he said.

Based on the complaint lodged by the girl and her relative, the four accused were booked for gang—rape under Section 376 of the IPC and under relevant sections of the SC/ST (Prevention) of Atrocities Act.

Two days after the semi-nude protest by anti-Posco agitators, Odisha police has registered a case against three women and president of Posco Pratirodh Sangram Samiti (PPSS) Abhaya Sahu on charge of obscenity in public.

“The case has been registered at Abhaychandpur police station under section 294 (a) and other sections of the IPC,” Jagatsinghpur Superintendent of Police Satyabrata Bhoi said on Saturday, adding that appropriate action will be initiated against the women and Sahu.

Meanwhile, the women belonging to both pro and anti project groups, held separate meetings to chalk out their respective strategies.

PPSS’s women’s wing — “Durga Bahini”, at a meeting this morning resolved to take extreme steps to ensure withdrawal of Posco project.

“Now we can go to any extent to ensure stopping of the project on our fertile land,” said Durga Bahini chief Manorama Khatua, who was among the three women against whom the case had been registered. She said the women would henceforth guard the entry gate to Dhinkia area with their male counterparts to ensure no more demolition of betel vines.

The pro-project group of women at a separate meeting condemned the semi-nude protest by members of the Durga Bahini. They demanded immediate arrest of PPSS leader Abhaya Sahu accusing him of instigating innocent women to strip in public.

The meeting chaired by Anju Dalei said the women of the entire district hung their heads in shame for the semi-nude protest by a group of women belonging to Durga Bahini.

Meanwhile, there was calm in the area as the administration had stopped land acquisition activities for two days.

Though police was deployed at a distance from the proposed plant site area, the agitators feared that the personnel might target Dhinkia village, the epi-centre of anti-Posco agitation.

Jagatsinghpur District Collector who had been directly monitoring land acquisition activities, claimed the state government had been taking possession of land with mutual understanding of the dispossessed. He blamed vested interests for misleading the innocent farmers.

“Appropriate action will be taken against the mischief mongers under the law,” he said.
