The four accused, Gnanprakasham, Simon, Meesekar Madaiah and Bilavendran, were sentenced to death by the Supreme Court in January 2004 in connection with the killing of 21 policemen in a landmine blast at Palar in Karnataka near the inter-state border in 1993. They were sentenced to undergo life imprisonment by the Mysore court. But the government moved the Supreme Court, which awarded them the death sentence. Their mercy pleas have been pending since 2004.

A division bench of Justice YK Sabharwal and Justice BN Agrawal had converted the life imprisonment of convicts to death sentence and dismissed the convicts’ appeals against the order of conviction passed by a Special TADA court in Karnataka.

What occurred in December last year was not the first gangrape in India, or the last. But what was it about that ghastly night that brought thousands of people across class, caste and gender out to the streets, demanding justice? The answer came in the reports of how the young woman fought her captors. Her fight to survive, and her defiance in the face of unimaginable brutality, made us realise that she would not be forgotten — because we would tell her story. We would celebrate her courage, her will to survive, her fearlessness and her defiance. We would remind ourselves that she was more than a gangrape victim. That she was a fighter. That women are more than bodies that can be violated.

So, we decided to write a song not to mourn her death, but to celebrate her spirit. And thus the song, “Maa nee Meri” was created by Swaang (available at http://goo.gl/ADFsa). The song was created as a protest song, as a song of defiance, addressed to the mother, not just as a mother, but as a woman, a daughter, a wife, a sister and a victim. The idea was to begin by problematising the culture of silent suffering and sacrifice that is valorised, romanticised and idealised in India as a strength inherent to women. We also questioned a culture of parenting that teaches fear, submissiveness, obedience and precaution as virtues, thereby silently transferring the onus of a crime onto the victim. This girl would not remain silent, she would speak out, fight, drown, but not swim obediently with the tide of patriarchal norms (“Maa nee meri mitti moorat, main nee goonga patthar banana”).

The song looked beyond the perpetrators and rapists as those obviously responsible for such crimes. It laid responsibility on the larger public, on citizens, families, lawmakers, law keepers, keepers of faith and morality. It indicted all of us, “un chhey mein shaamil tum bhi thhey, yeh kaam toh hai hamdardon ka (You were amongst those six, this is the doing of well wishers)”, for being callous, complacent and comfortable in the security of our drawing rooms, for thinking “better safe than sorry”, for not fighting. We also tried to reflect a historical imagination about violence against women in our country and thus made references to 1984, 1992 and 2002; an acknowledgement that at each historical moment of public turmoil and conflict, women were victimised.

Finally, we conclude the song with the reminder that rape is not death. That even the idea of rape being the effective end of the life of the victim is deeply problematic. This understanding of rape reduces the entire existence and individuality of women to “jism ke dhaai inchon mein (two-and-a-half inches of the body)”, and is precisely the logic that perpetrators function on when they choose to rape women to “teach them a lesson” or “show them their place”. This notion is the cornerstone of any patriarchal understanding of women and is so widespread in our society that it is reflected in popular culture again and again, the most recently controversial of which has been Punjabi singer Honey Singh’s grossly offensive music, such as the song “C***t”.

Ours is a world where art is in thrall to the logic of markets. Any sensational, shock-value laden “product” that trades in existing stereotypes will be successful. This is a perverse culture that renders the role of the artist in a society obsolete by turning the artist into a vendor. Art must never be empty, instant entertainment. Because art, by looking beyond the obvious, can channel collective angst into a more constructive expression that can create a positive change.This is why the artist has a responsibility to oppose regressive works parading as popular culture. And thus, in the context of a land where violence against women is endemic, art that celebrates sexism and misogyny and glorifies masculinity in its most brutal form is regressive and ought to be questioned.

For every “C***t”, we must create songs that celebrate and remember that “she” fought. That she was one and they were six but afraid she was not (“Vekh maayi nee main lad ke aayi, kalli o chhey par na darr ke aayi”). We must continue to fight, to challenge, to protest. Because only then will we be able to move from a perverse misogynist culture to one that empowers, both in art and in life.

SANGRUR: Scarring the sacred relationship between a teacher and a student, a government school teacher has been booked for raping a dalit minor girl.

A teacher of mathematics of village Namol, Gurjant Singh has been booked for raping a class VIII student. The agitated villagers have demanded stern action against the teacher, who is presently absconding. The education department has placed the teacher Gurjant Singh under suspension and a charge sheet is being prepared against him.
As the incident came to light on Wednesday, the angry villagers protested at the school and headed towards Sangrur civil hospital to get the girl medically examined. Subsequently a medical board of three doctors conducted the medical examination on Wednesday afternoon.

“The teacher on the pretext of teaching had called the minor girl at his place on December 31 when the school was closed during winter vacations. Alone at his place at that time, the teacher had raped the girl and threatened of her dire consequences if she told anyone about it”, told villager Sarabjit Singh. He said the incident came to light when the teacher a couple of days ago again molested the girl in the school and some other students saw the teacher indulging in indecent behavior.

Police on the complaint of the father, a brick kiln labourer has registered a case of rape against the teacher .

District education officer(Secondary), Nirmal Singh Sohi said “as per the directions of director general school education, teacher Gurjant Singh has been suspended and a charge sheet is being prepared against him”.

Sangrur SSP Harcharan Singh Bhullar said that the police has registered a case against Gurjant Singh and efforts are being made to arrest him.

The Reality at Jaitapur Nuclear Power Plant , Mr. Hollande #mustshare

French President Francois Hollande is making his first visit out of Europe since he was elected. And he has chosen India as a preferred destination for his visit starting tomorrow – 14th February.

On his radar is to sell Areva’s failed EPR (European Pressurized Reactor) nuclear reactors to India. Even as his own country has neither been able to implement the EPR reactors in France or Finland and nor has the US regulator certified it, the Indian government is eager to set up these reactors in a huge area in coastal Maharashtra – at Jaitapur – a highly bio-diverse region that needs preservation.

The carrot which the French president is dangling is the supply of fighter jets to India on “favorable” terms. The Indian government for want of more and more weapons (and probably with an eye on making some money out of the deal?) is turning a blind eye to the enormous damage this project will cause. Anuj Wankhede and Cressida Morley write about the Jaitapur protestors, who despite all efforts of the French and Indian governments, remain determined that this project will never see the light of day.

The beauty of the Ratnagiri coastline and surrounding area has to be seen to be believed. Any government official from DAE to NPCIL would be crazy to think of destroying or even putting at risk this kind of natural biodiversity. It is already established that Maharashtra state itself does not require any more electricity than is already being produced and the Chief Minister himself is on record as saying that the state will be free of any load shedding by the year end.

So for whom is the Jaitapur Nuclear Power Plant (JNPP) being built?

Certainly not for the local people, the fishers, farmers and ordinary people whose livelihoods will be destroyed and their lives threatened. The government tells us that nuclear power is needed for ‘development,’ but the people who will be directly affected by JNPP have a very different ideas of what development is and whom it should benefit.

The fishing village of Sakhri-nate, is just a few kilometers by road from the proposed JNPP site – only 3 kilometers as the crow flies. You can see the site clearly just across the sea.

OLYMPUS DIGITAL CAMERASlogans such as ‘No nuclear’ and ‘Areva go back’ are painted on walls all around the village and the people against JNPP vehemently say they are prepared to give their lives rather than allow the plant to come up. Recent newspaper reports have shown just how desperate NPCIL is to do a deal with the fishers by raising the compensation for land acquisition to Rs. 22.5 lakh per hectare from Rs.1.5 to 4 lakh announced previously.

But the fishers are adamant…it doesn’t matter how much they are paid when their livelihoods, their community, in fact their very lives are on the line.

Most of those opposed to the plant in Sakhri-nate are fishers but there are people of different professions as well, showing that it is not just a direct concern for livelihood but a much wider fear that JNPP will in fact destroy their lives and community. The activists have detailed knowledge of how the JNPP will affect their lives. For fishers, this knowledge may not be scientific in the academic sense of the word, but every day they observe the sea intimately as their lives literally depend on it. The knowledge that they have gained through long experience cannot be easily dismissed.

The fishing community is concerned that the effluent water used for cooling the nuclear plant – which will be pumped back into the sea at a temperature – at least 5-7 degrees Celsius higher than the natural temperature – will have a disastrous effect on the fish population and their breeding. The Government is trying to assure the fishers that a rise in seawater temperature would not affect the fish, except possibly to make them bigger! Obviously, the fishers are not buying this at all. They claim that the fish that presently inhabit their fishing ground will not be able to live in such a changed environment. Even if these fish are able to swim away to other areas of the sea, shellfish, for example cannot escape so easily and will surely perish. Perhaps, different species of fish will come to the area due to the raised temperatures but this also represents an unknown for the fishers. In any case, they refuse to believe that the environment will simply remain the same with such enormous quantities of heated water being pumped into the sea. As one fisher put it, even a refrigerator emits heat which can affect the surrounding air temperature and living things, so how can the government claim that an entire nuclear power plant will have no impact on the environment?

Others have expressed fears of terrorism and natural disasters.

The cliffs surrounding Sakhri-nate, directly opposite the proposed site for JNPP, are spectacular to say the least. The solid rocks here weather the eternal beating of the sea waves. Yet, this rock was split wide apart by lightening and electrical storms that are common in the area. It’s easy to imagine similar lightening bolts falling just a few kilometers away, and the damage they would do to a nuclear reactor. It would be a disaster of unimaginable proportions indeed.

P1190019Especially after Fukushima, the fear of accidents is very real and no amount of government assurances has convinced the activists that JNPP will be totally safe. The level of distrust towards the government is very high and palpable. Activists claim that the government contradicts its own reports and does not disclose ‘inconvenient’ information besides they feel the government is least concerned about the locals.

Rather than the government, Sakhri-nate fishers would rather believe their fellow fishers from another part of the state – Tarapur. They have travelled to nearby Tarapur which as the site for the first nuclear reactor to be built in India and they have seen what the nuclear power plants have done to the fishing catch. The fishing community at Tarapur is practically out of business due to the low catch and the enforced security ring around the plant which forces them to take long detours into the sea and which entails huge costs on diesel – not to mention the time spent.

At Tarapur, the locals were told 40 years ago that the Tarapur NPP was a matter of national pride. The local community and fishermen in that area gladly agreed to its construction, fully believing government assurances that the fish and environment would not be affected and that they would be adequately compensated. They have since been thoroughly betrayed and have warned their fellow fishers near Jaitapur to fight against JNPP – lest the same fate befalls them. The information received by the Sakhri-nate fishers from the Tarapur fishers is based on their bitter experiences and a shared understanding of the sea and the environment, both of which are integral parts of their lives and livelihoods. Who would you rather believe—the actual experience of your peers or the theoretical science of distrusted governments?

Ideas on development: worlds apart

The rift between the local community, dead-set against the NPP and the government, equally determined to build it, is not just about differing information and mistrust. There is a more fundamental difference in worldview between these two parties. While the government’s idea of ‘development’ focuses on achieving ambitious electricity generation, attracting foreign capital and making more and more ‘goods’ for an ever-expanding market, the fishers of Sakhri-nate have different ideas.

no nuclearAs one local explained “We are already developed. We don’t need anything more; we have full employment in the village. Even disabled or illiterate people have jobs, mending fishing nets etc. We have enough electricity; all we ask is that the government allows us to pursue our livelihoods. We have enough money to live well now, as fishing is a lucrative industry, but if we loose our livelihood, we will have nothing.”

Others said that if development was needed at all in their village, it should be in the form of increased educational facilities – including vocational schools – so that their children would get better employment opportunities – if they choose to. There are also calls for growth which minimizes environmental destruction and which compliments local industries such as food processing factories for the fish and mangoes, also produced in large quantities in the Jaitapur area. The already present ice factories, which provide ice to pack the fish so they can be sent to different parts of the country, are another obvious example of this type of development.

It would seem that the government has underestimated the level and type of knowledge and information that the local community has or even tried to understand their concerns – leave alone address them. This is not to mention the high income and living standards enjoyed by the fishermen who do not want this so called lop sided “development” at such high risks.

But most of all, the official model of development is being called into question: Why should large-scale industrial projects be encouraged, in this case a foreign-funded project that carries a risk of unimaginable destruction, and why should local communities be required to sacrifice their lives and livelihoods for lighting up city malls while the locals who are being affected by the project will still have only erratic power supply – just as is the case at Tarapur?

#India-NHRC questions sterlising women unhygenically #vaw #womenrights #reproductive rights


Kolkata, Feb 11 : Days after over 100 women were sterilised in a single day at a health camp under unhygienic conditions, the NHRC Monday issued a notice to the West Bengal government.

On the basis of a media report and a complaint, the National Human Rights Commission (NHRC) issued notice to the principal secretary, health, West Bengal, and to the district magistrate of Malda, returnable in six weeks.

The complainant said that over 100 women were sterilised by two doctors in a day without ensuring basic healthcare facilities.

“The sterilisation operations were performed at a camp at Manikchak village health centre, Malda district. After the surgeries, women were left in the open outside the health centre for recuperation. Some of them were sent to their homes in rickshaws without keeping them under observation for a mandatory period post surgery,” the NHRC said in a statement.

The complainant has demanded a high-level inquiry, action against the erring doctors and monetary relief to the victims.

Due to lack of space in the health centre, some women were dumped unconscious in a field after the mass sterilisation.

The state government has ordered a probe into the incident.

Communists fight every battle with all their might.
I know – metastatic cancer is a deadly disease
So I am fighting it with all my willpower.
I want to live my life to the fullest and I do believe
That my will to live will defeat even death
And even if it does not happen
I will prove in any case that
True revolutionaries neither give up in the face of hard times
Nor surrender before death like a coward.I believe in my determination and combativeness
And I know that I have to win this battle and
Return to the front, to hold which till my last breath
Is a commitment made to my soul.
So, there is every possibility that this last wish of mine,
This ideological testament of mine
Might become meaningless tomorrow,
But even after fighting valiantly till the last breath,
Like a true communist,
If I have to fall,
I want to leave this letter of my last wish
For my comrades and friends.

I know I have to defeat cancer.
I have the love and pain of my comrades with me.
I have to get back to rejoin the ongoing war against capital

And back away from the storms.
Like a normal communist
I too have had natural human weaknesses,
And even some class weaknesses inherited from my background.
I do not claim that I was never touched by pessimism,
Or I never had any grievance with my comrades,
But I can assure that I have always got satisfaction and happiness
In my efforts to become a better communist,
I love my comrades more than anything in the world
And trust them wholeheartedly
And I still love life with all my heart
And I want to live as much as I can.

That’s why, I believe that victory will be mine
The cancer is bound to be decimated against my communist resolve
In this fight against death.
But I am ready like a true communist
To face every adversity
And that’s why I am writing down my heartiest wish
That if I lose out in the battle of life
My body must be wrapped in our cherished red flag
And then it must be donated to a government hospital or medical institute
For the purpose of scientific research or to donate organs to poor and needy patients.
I will legally assign the responsibility for this to two of my comrades.
If this is not possible for any reason
My body should be taken to an electric crematorium
On the shoulders of my comrades
And my last rites must be performed without any religious rituals
With raised fists and the International being played.
It must also be ensured
That none of the degenerate renegades must be allowed to join
They must not be allowed to come near my body.
I know, those who say even today
That I have been “brainwashed” (which is the biggest abuse for me),
Will not refrain from using my death for their dirty politics,
Thus, it is necessary
That I write down my wish in clear terms.

Comrades! I do not await death
But to get back to my work.
Cancer can be defeated by
Positive attitude and firm resolve
And all possible treatments are going on.
But still if I am unable to return to my front,
There is nothing to worry,

We have to save the children! Save the dreams!!

PRESS RELEASE- Four anti nuke activists booked under Goondas Act, exonerated by Madras HC


Four persons belonging to Idinthakarai and Koodankulam villages, who had been booked under Goondas Act since September 2012, have been exonerated by the Madras High Court (Madurai bench). In all, six men ranging in age from 23 to 68, were charged under Goodas as part of the State Government’s harassment campaign against the People’s Movement Against Nuclear Energy. All six have served between three and five months in jail on trumped up charges.

 

The Madras High Court’s decision to lift charges under Goondas Act further proves the long-standing allegation that the Tamil Nadu Government has abused the Indian Penal Code to stifle democratic dissent and crush the movement against the nuclear power plant.

 

In all, the Koodankulam Police Station has filed at least 325 cases against more than 200,000 people, including cases involving sedition and waging war against the state against nearly 10,000 people. Since most of the cases are against unnamed persons, it has been convenient for the Police to arrest randomly and then link the arrested persons to any one of the 325 cases.

Yesterday, the Madras High Court’s Madurai bench exonerated the following persons based on an appeal filed against the confirmations of Goondas Act by the NSA and Goondas Board.

The rules governing the draconian Goondas Act require that named persons should be produced before the Goondas Board and the Board’s report confirming or rejecting the invocation be submitted to the Government within 7 weeks (50 days) of invocation of the Act. However, it is now more than 7 weeks since the appearance of the named persons before the Board. The Board is yet to submit a report on four out of six persons.

Of the six, four people were represented by Adv. Lajapatarai and his team in Madurai on behalf of the PMANE. Two others arranged their own counsels.

Showcause notice to Vedanta unit for violating EPA #goodenws

The Jharsuguda district administration has issued show cause notice to the alumina smelting and power generation unit of Vedanta Aluminium Ltd (VAL) for construction work in the area violating the provisions mentioned in Environment Protection Act, 1986.

“The construction work done by VAL at its smelter unit and power plant has invited provisions mentioned in section 15 (contravention of the act) and 16 (offenses by the company) of the environment protection act. They have been asked to reply within two weeks,” says Rabindra K Mishra, additional district magistrate of Jharsuguda district.

As per the order, the CEO of VAL Jharsuguda unit has to present before the district administration on February 28 for preliminary hearing at the collectorate. The Union Ministry of Environment and Forest (MoEF) had earlier communicated to the state government about violation of the act by VAL.

Vedanta said it has not received any notices and will reply only after getting the physical copy of it.
