 and respond to the Jal and Jammen Satyagraha

The farmers, labourers, potters and fish workers in the Sardar Sarovar affected areas, many of whom are also affected by the canals of the Indira Sagar and Omkareshwar Projects and those affected by the Jobat Dam warn the Government of Madhya Pradesh against its totally insensitive attitude and illegal moves, destroying the lands and livelihoods of thousands of oustees affected by the Indira Sagar and Omkareshwar Projects. We stand by the nature based communities, the women and men who on the 14th day of the Jal Satyagraha, are facing the waters, protesting against the Government’s plan to make their villages a watery grave and evict them by the watery force. About 2,500 land holder families in Omkareshwar and thousands of families in Indira Sagar are pushed, not merely into ‘submergence’, but ‘destruction’ zone, that too without prior and legal rehabilitation.

 

It is absolute injustice meted out to the adivasi and non-adivasi farmers and the Madhya Pradesh Government has violated all norms, both its own Rehabilitation Policy and Judgements of the Supreme Court. In total contempt of the communities living in the Narmada valley since generations, the Chief Minister, Shivraj Singh Chauhan and his cabinet is refusing to acknowledge not just the gross illegalities but also the truth and non-violence expressed through the Jal Satyagraha of the oustees and the activists of Narmada Bachao Andolan, Chittaroopa Palit and Alok Agarwal.

 

They refuse to take note of the scenario wherein not one but all dams in the Narmada valley are pushed ahead illegally, with scant respect for environment, law and justice. The two Ministers, as envoys of the CM, who visited the site of the Satyagaraha yesterday, failed to put forth any concrete proposal before the Satyagrahis and the oustees. The Centre too, through the Narmada Control Authority and the Ministry of Water Resources and Ministry of Environment have not promptly intervened in this critical situation, appearing to be beyond control when not one but at least waters from 8 dams are released and the downstream areas are flooded, destroying hundreds of acres of standing land and houses.

 

In Sardar Sarovar, the oustees of ISP and OSP have flooded more than 300 houses, along with a few shops in Nisarpur and hundreds of acres of standing crop in dozens of farms, across villages. The SSP is however, stopped and no permission is granted for any further raise in height, since 40,000 families are still residing in the submergence zone and huge scandal of Corruption in the Rehabilitation is unearthed and is under scrutiny by Justice Jha Commission.

 

However, while in SSP, for the last 27 years of struggle including Jal Satyagraha to Jal Samadhi, agitations have led to the land-based rehabilitation of 11,000 families in Maharashtra and Gujarat, but not one is rehabilitated in Madhya Pradesh. The situation is same in all the large dams in the Madhya Prdaesh part of the Narmada valley – Bargi, Maheshwar, Omkareshwar, Indira Sagar, Maan, Jobat, Veda, Goi etc. This is self-evident of the state government’s disrespect for the adivasis and farmers. Madhya Pradesh is locating and allocating land for investors across the globe but denies the same to the project – affected and only forces them to accept rocky, uncultivable or decades-old encroached land from its ‘Waste Land Bank’.The same insensitivity is reflected in its silence in dealing concretely with the 10 month long Jobat Zameen Haq Satyagraha by the SSP oustees, mostly the hilly adivasis, displaced since 1994. The oustees who are on the verge of reaping the second crop on the government seed farm land they have ‘occupied’ since 10 months is another slap in the face of the State!

 

It is this callous attitude that is being challenged, staking lives and livelihoods in Omkareshwar and Indira Sagar dam affected areas today and the same must be responded to immediately. We appeal to all the agencies, including the NHRC, the Commission for Scheduled Tribes to intervene, at least now, after 15 days of the Satyagraha. The High Court and the Supreme Court can also take suo moto notice of the crisis and intervene to protect the rights and lives, with due respect to those sacrificing their land and village communities from the oldest of the civilizations, i.e. Narmada in ‘public interest’. If not, an intensified struggle all over will challenge the power holders on the entire issue of the Narmada valley.

In support of Aseem Trivedi, now being tried in India for sedition for drawing cartoons

I had never heard of Aseem Trivedi before, but I am shocked to read today that he has beenarrested and will be tried for SEDITION! – for what? For cartoons that depict his anger at the massive corruption by the Indian government. [Also see this news of his arrest.]

Apparently, in India, it is criminal to depict the state for what it is: a monster that is sucking up the blood of the people of India.

I myself had depicted this in 1975:

In my view (depicted in this picture) Indira Gandhi had disemboweled the poor even as she pretended to care for them. I was 15 years old when I made this. Seditionist? No. I had a strong sense of integrity even then, and strongly cared for India. To care for your nation is NOT sedition.

Apparently Trivedi has shown disrespect to national symbols. But what about those who LOOT the country? Are they showing respect merely because they are escorted by Z level security?

What is more important: symbols or reality?

In my view the government of India is showing the GREATEST disrespect to national symbols. Trivedi has got it right. The socialists have racked India and made tens of private mansions for each of themselves in the name of the poor. They have destroyed truth. They have destroyed liberty.

Trivedi’s website has already been shut down by the Indian government. Unfortunately, for the Indian government (and governments worldwide) the Pandora’s box of liberty – the internet – has been opened and no one can shut it down. Liberty will triumph.

In support of Aseem Trivedi, I’m re-publishing all his cartoons that I can find on the internet. If I’ve missed any please send them over.

I hope people like Shailesh will try to understand this – that democracy is NOT God. It is NOT a sufficient condition for the defence of liberty. It is a step towards that journey but that journey requires strong leaders to join politics and cut the ever-extending reach of the government. Only vigorous defence of liberty can save India’s democracy from degenerating into tyranny. Not PR. Let’s get the priorities right. We need leaders RIGHT NOW, to defeat the current government (and opposition!), and establish a new order based on liberty. Instead of idle debates, it is time for action.

Kanpur based cartoonist Aseem Trivedi, arrested for allegedly posting seditious content on his website, was today remanded to police custody till September 16 by a local court.

Trivedi, who was arrested on Saturday on the basis of a complaint filed in December, was produced before a court in Bandra which remanded him to police custody till September 16.

Police had sought his custody to question him on the contents on his website and other charges. The court had issued a non-bailable warrant against him last month.

A member of Republican Party of India, Amit Katarnayea, had filed a complaint against Trivedi that the latter had put up banners mocking the Indian constitution during the Anna Hazare rally held last year at the Bandra Kurla Complex. It was also alleged that he had put the obscene content on his website.

Outside the court, a defiant Trivedi said, “If telling the truth makes me traitor then I am one. Even Mahatma Gandi was called traitor and if I am booked under sedition for doing service to the nation then I will continue to do so.”

While police officers said that he had shown disrespect to the National flag and he was arrested under 124A of the Indian Penal Code for sedition besides various sections of the Information Technology Act.

Trivedi was due to fly to Syria on Wednesday to receive a cartooning award.

“If anyone is talking against corruption, proclaiming it as anti-national and slamming charges of sedition, one needs to understand that this is against the government and not against the country,” said Mayank Gandhi, a member of IAC.

He said further said that Trivedi was not a member of the IAC “but is fighting corruption and we are here to give him moral support”.

The police insist that the arrest is a procedural formality, saying they have acted on a complaint. The First Information Report states that the accused had put ‘ugly and obscene content’ on his website.

“He has shown disrespect to the National flag and therefore he has been arrested under section 124 A,” said Chandrakant Bhosale, Senior Inspector, Mumbai Police.
The arrest comes at a time when Mr Trivedi was scheduled to visit Syria to collect the 2012 Courage in Editorial cartooning award. He was scheduled to fly on September 12.

“If telling the truth makes one a traitor, then I am happy. Likewise even Gandhi, Bhagat Singh are traitors. If while doing service to the nation I am booked under sedition, I will continue to do so and get arrested,” Mr Trivedi said today.

AK Khan, a friend of Mr Trivedi, alleged that the cartoonist is being repeatedly manhandled since his arrest. India Against Corruption or IAC, which has been attacking the government over a series of alleged scams, has lent support to Mr Trivedi, saying the arrest is politically-motivated.

“If anyone is talking against corruption, proclaiming it as anti-national and slamming charges of sedition, one needs to understand that this (drawing cartoons) is against the government and not against the country,” said Mayank Gandhi, a member of IAC.

“He is not a member of IAC but is fighting against corruption and we are here to lend him moral support,” Mr Gandhi added.

“Whoever raises their voice against corruption is termed as a seditionist, anti-nationalist and a Naxalite,” said Preeti Menon, member IAC.

We strongly protest against the letter sent by the Maharashtra government to the Centre to amend the PCPNDT Act, 1994 so that sex selection can be treated as murder, punishable under section 302 of the IPC.First of all abortion should not be referred to as foeticide, which had anti-abortion implications. Women had the right to decide when and whether or not they should bear and give birth to children. Making sex-selective abortions (wrongly referred to as “female foeticide”) a murder charge, would only increase illegal abortions and also make access to safe abortion difficult.

All these years, women’s groups were fighting against sex selection not abortion. Now after Census 2011 and a huge dip in child sex ratio, the government has gone on the other extreme by trying to equate abortion with homicide.Womens movement has always demanded the continuous and strict monitoring of sonography centers, hospitals and nursing homes and strict action against all unlicensed centers. Instead of concentrating on this issue and doctors who misuse medical technology, the discussion in the letter focuses on abortions.

According to the PCPNDT Act, sex selection (the correct legal term) itself is a crime and the doctors involved should be punished as per the provisions under the act. The pregnant woman on whom sex selection is performed or undertaken is not an offender according to the act. This should be upheld in Maharashtra.

Safe and legal abortion is a woman’s right and abortion is legal in India. Medical Termination of Pregnancy (MTP Act) spells out the conditions under which it can be carried out. Sex-selective abortion, however, amounts to discrimination against a particular sex, in most cases, female sex. Sex-selection in favour of the male child is a symptom of devaluation of female lives. It is important to remember that those who want to use abortion for elimination of the female foetus have to first determine the sex of the child. Rightly, it is this process of pre-natal selection which is a crime, and it is being regulated and monitored through the Preconception and Pre Natal Diagnostic Techniques (Prohibition of Sex selection) (PCPNDT) Act.

Unless we are able to deal with all those social and economic factors that are going into the culture of son-preference and daughter-aversion, the child sex ratio will go on plummeting. But the solution is not to curb the legal right to abortion. Rather the PCPNDT Act should be enforced, and clinics that offer prenatal sex testing should be weeded out.

We condemn the demand to make abortion a crime and urged the government to stop using anti-abortion stand for curbing the plummeting child sex ratio. Checking pre-natal sex selection required the proper implementation of the PCPNDT Act and monitoring of sex-selective procedures by the government. It could not be achieved by introducing such draconian measures that curb women’s right to safe and legal abortion.

We demand that the law deals strictly with those who perform the crime of sex selection. The political protection to erring doctors is a serious problem in Maharashtra and the state government should take steps to put an end to political interference in implementation of PCPNDT Act, rather than focusing on abortion.

We do not endorse the view that abortion is homicide ,even as we fully agree that sex selective abortion is a crime that must be punished as per the PCPNDT Act. We demand the Centre to rejects Maharashtra Goverment’s recommendation to treat sex selection as homicide under Sec 302-IPC

Political cartoonist arrested on sedition charges gets a week in police custody

A holiday court in MumbaiImages ] on Sunday remanded anti-corruption cartoonist and free speech campaigner Aseem Trivedi to policy custody till September 16 for allegedly making cartoons that insult India‘s [ Images ] flag, Parliament and the national emblem. The order was given by the Bandra holiday court in Mumbai on Sunday morning. Trivedi was arrested when he surrendered on Saturday night at the Bandra Kurla Complexpolice station in Mumbai. He faces charges of sedition (under IPC section 124A), violation of section 66A of the Information Technology (Amendment) Act, 2008, and the Prevention of Insults of National Honour Act, 1971.A team of Mumbai Police had earlier reached Trivedi’s home in Kanpur with a non-bailable warrant but returned to Mumbai as Trivedi is now based in Delhi [ Images ]. Trivedi himself contacted the BKC police station which asked him to reach Mumbai.

Several FIRs and court cases have been filed against Trivedi in Maharashtra [ Images ] for cartoons that he had displayed at the Jan Lokpal agitation in Mumbai in December 2011. The cartoons were also available on his website, www.cartoonsagainstcorruption, whose registration was suspended by web company Big Rock after a notice from Mumbai police, in December 2011.

Speaking on the phone from Mumbai just before his arrest on Saturday night, Trivedi explained that the cartoons intended to display the insult to the nation that is being done by politicians, and do not seek to insult national symbols in any way.

The controversial cartoons are still available at www.cartoonsagainstcorruption.blogspot.com. One cartoon titled, ‘Gang rape of Mother India’ shows a ‘Mother India’ dressed in a tri-colour sari, with politicians and bureaucrats about to assault her, with a gleeful beast standing by described as ‘Corruption’. One cartoon shows India’s national emblem, the Ashoka Lions, with foxes rather than lions. In the inscription on the emblem, the words ‘Satyamev Jayate‘ are replaced with ‘Brashtamev Jayate’ (meaning corruption alone triumphs) and a danger sign.

A cartoon calling for the “right to recall” elected representatives in mid-term shows Parliament as a sewage collection centre into which flows waste from several toilets — or, polling booths. Another cartoon simply shows Parliament as a ‘national toilet’. Another cartoon shows 26/11 gunman Ajmal Kasab [ Images ] as a dog peeing on the Constitution of India. Some cartoons target Congress leader Digvijaya Singh for his statements against the Jan Lokpal movement.

Trivedi has for the moment refused to hire a lawyer and does not intend to apply for bail. “I want to first see how a British-era law like sedition is going to be applied against a cartoonist in free India,” he said.

One of the main complainants, Amit Katarnawre, 27, said on the phone from Mumbai that he had filed an FIR at the BKC police station in Mumbai and had just last week met senior police officials to press charges against Trivedi.

Katarnawre said he was offended by the cartoons as they, in his view, intentionally desecrated India’s national symbols. He was particularly disturbed by the cartoon that shows Kasab as a dog peeing on the Constitution. “As a Buddhist my religious sentiments were hurt by the cartoon that uses the Ashokan lion pillar, as Emperor Ashoka was a Buddhist,” he added.

Katarnawre is an employee of Central Railway and a Dalit. He says he is not a member of any political party but is ideologically an Ambedkarite who could not stand the Constitution being desecrated. He said Trivedi should be interrogated to ascertain the role of all members of Team Anna in the display of the cartoons at the MMRDA grounds.

Apart from sedition, Katarnawre has also charged Trivedi with Section 66A of the Information Technology (Amendment) Act, 2008, which punishes persons for “sending messages” online that are “grossly offensive” or have a “menacing character”.

A third law used against Trivedi is the Prevention of Insults to National Honour Act,1971, which provides for punishment up to three years in jail and a fine for insulting or defacing the Indian flag and the Indian Constitution. It adds, however, ‘Comments expressing disapprobation or criticism of the Constitution or of the Indian National Flag or of any measures of the government with a view to obtain an amendment of the Constitution of India or an alteration of the Indian National Flag by lawful means do not constitute an offence under this section.’

Trivedi, 25, says he is within his rights as an artist to use national symbols to show how they are being insulted by politicians. He was a freelance cartoonist working with local dailies in Kanpur before he got involved with the Anna Hazare movement.

After his website was shut down in December 2011, Trivedi became associated with the Anna Hazare-led India Against Corruption movement and also started an independent initiative to campaign against internet censorship. Called ‘Save Your Voice’, he travelled across India to raise awareness against the IT Rules 2011.

Trivedi also sat on a seven-day hunger strike in Delhi’s Jantar Mantar to protest the IT Rules in May this year, and displayed anti-corruption cartoons at the Anna Hazare protest in Jantar Mantar in August 2012.

The Virginia, US-based Cartoonists Rights Network International have named him the 2012 recipient of their ‘Courage in Editorial Cartooning Award’. He is sharing the award with Syrian cartoonist Ali Ferzat who was abducted and badly beaten by the Syrian regime in August last year. However, Trivedi will not be able to travel to receive the award as the United States has denied him a visa, although he is scheduled to travel to Vienna [ Images ] toparticipate in an art event later this month.

Mumbai: Cartoonist Aseem Trivedi sent to police custody till September 16 #FOE #Sedition


 

Mumbai: Yet another cartoonist has become the victim of the ongoing policing by political parties. Cartoonist Aseem Trivedi was on Sunday arrested for allegedly posting “ugly and obscene” content on his web portal.

Trivedi was arrested in Mumbai and produced in a Bandra court later in the day following which he was sent to police custody till September 16.

He was charged with sedition under Section 124 A of the Indian Penal Code. It is a non-bailable offence.

He was also charged under the IT Act and the 1971 National Emblem Act.

The cartoons by Trivedi reportedly depicted Parliament as a commode and showed the national emblem with wolves instead of lions.

The police claimed that Trivedi had earlier exhibited similar cartoons at a rally organised by India Against Corruption (IAC) at the MMRDA grounds in Mumbai in December 2011.

The police have asked the National Broadcasters Association to restrict the broadcast of the cartoon

Nity just spoke to a protester who’s at the siege site (east end wall of the nuke plant) on Idinthakarai seashore. There are atleast 8000 people at the siege site now facing severe weather. Drinking water is not available at the site but arrangements are being made to arrange for the same.

The protesters seek the support of all groups and organisations to organise solidarity events and meetings all over India.

Thousand people from Periya thaalai village who were on their way to Idinthakarai were stopped by the police. The people are now on their way to attend a hunger protest held in Pani maya madha church in Tuticorin. Fishermen from Tuticorin are already on a hunger protest at the church. The police is not allowing protestors to head towards Idinthakarai to participate in the protest.

Protesters plan to lay siege to #Kudankulam Nuclear project site today

An uneasy calm prevails in Kudankulam and Idinthakarai in the wake of the protesters’ threat to march towards the Kudankulam Nuclear Power Project site on Sunday for laying siege to it, and the deployment of around 4,000 police personnel to face any eventuality.

 

The anti-Kudankulam Nuclear Power Project agitation, which started a year ago at Idinthakarai, has almost reached the climax with the protesters making a last-ditch effort to prevent enriched uranium fuel being loaded on to the first reactor.

If the fuel loading passes off uneventfully, then the year-long agitation will become meaningless, feel the protesters, who also believe that their desperate move will exert pressure on the Union Government to put off plans for commissioning the KKNPP.

The agitation, hitherto confined to coastal hamlets, may overflow on the roads leading to the KKNPP as part of the protest, which may trigger a possible conflict with the police.

CLARION CALL

Announcements were made by priests in a few churches in the coastal villages of the district on Saturday morning appealing to the devotees to join the ‘satyagraha’ on Sunday.

Anticipating a huge mobilisation by protesters from various coastal villages from Tirunelveli and Tuticorin districts, around 4,000 police personnel have been deployed on the roads near Kudankulam and Idinthakarai. Sandbags have been piled up by the police on the roadside.

WARNING RIBBONS

Warning ribbons have been tied around the ground-level wells – both used and unused – around Vairaavikinaru to caution passersby. “The protesters may run for cover in case of a possible police action tomorrow. To prevent them from falling into the wells, we’ve tied the warning ribbons,” said a police officer. Perfect functioning of all streetlights in this region has been ensured by the local panchayats following a direction from the Assistant Director (Panchayat).

During vehicle checks by officials attached to the Regional Transport Offices at Tenkasi, Tirunelveli and the Motor Vehicle Inspectors of Valliyoor, 20 vehicles, including jeeps, autorickshaws and an earthmover, which did not have valid documents, were seized. The impounded vehicles have been taken to the Radhapuram police station.
