It’s tough to deny facts brought to light by modern technology. The Dhule police were felled by mobile phone cameras showing them destroying unattended stalls belonging to Muslims during the riot that broke out in January. There really was no choice but to take action against them. Now, mobile call records show that the phones of three Muslims accused of having planted bombs in suburban trains on July 11, 2006, were far away from the sites of the bombings.

That wouldn’t mean much if the agency investigating the case hadn’t done its best to prevent this coming out. The conduct of the ATS has been strange indeed. First, it kept on citing the need to go through these call records to get police custody of the accused. But its charge sheet made no mention of the records. Yet, when the accused wanted to have a look at them, the ATS refused, citing a variety of reasons. It was only when the high court dug its heels in on the issue that the prosecution threw in the towel, saying the accused could get the records from the mobile companies, since it had deleted the copies in its possession. No wonder cops hate judges and lawyers!

The mobile companies were also reluctant, first saying it would take months, then asking for Rs34 lakh as costs. Again it was left to the court to put its foot down.

The records corroborate what the three alleged bombers have been saying about where they were when the bombs were placed on the trains. They also seriously dent the credibility of the investigation — for the fourth time since the blasts.

Soon after the blasts, the ATS had gone on an arresting spree, describing every arrest as a “major breakthrough’’, and the man arrested as the “mastermind’’. But within three months, it applied for discharge of three such “masterminds’’, saying they had nothing to do with the blasts.

From Day One, the ATS had blamed Pakistan. But when it came to confronting Pakistan with the evidence, it played coy.

The real shocker came in the charge sheet — not a word about pressure cookers, after describing to a salivating media how the bombs had been assembled in pressure cookers, their make, from where they had been bought…

But even this wasn’t as shocking as the sudden emergence of an alternate narrative two years after the blasts. At a specially convened press conference, the then crime branch chief Rakesh Maria announced that the culprits were another set of boys belonging to the Indian Mujahideen; its co-founder Sadiq Shaikh, had himself confessed to this. The bombs weren’t assembled in a hut in Govandi as the ATS alleged, but in a Sewri flat.

But the ATS, then headed by KP Raghuvanshi, stuck to its story, and three months after his “confession’’, Sadiq Shaikh was discharged from this case at the behest of the ATS itself. Earlier this month, he told the court that the crime branch had tortured him to “confess’’ to the train blasts.

Allegations of torture have dogged this case right from the start, and no less than the PMO had to intervene. Family members of those arrested as well as those wanted, filed affidavits describing their alleged torture at the hands of the ATS, and were taken to meet the PM by Samajwadi Party chief Abu Asim Azmi.

209 innocents died in the serial train blasts. What must their families be thinking every time the investigating agency comes out looking foolish in these last seven years?

KKM couple court arrest outside Maharashtra legislature

Mumbai, April 2 (IANS) An artiste-activist couple from a Pune-based theatre group, accused of having Maoist links, court arrested outside the high-security precincts of Maharashtra legislature here Tuesday.

The duo, Sachin Mali and Sheetal Sathe of the Kabir Kala Manch, have been charged under the Unlawful Activities Prevention Act (UAPA) for having Maoist links.

“We wish to come clean of all allegations slapped against us mentioning us as providing aid to and assisting the Naxal (Maoist) movement. We wish to co-operate with the agencies and wish to have our names cleared,” Mali said as he was being escorted away by police under tight security.

The couple, which had gone underground and remained wanted for several years, have contended that their surrender is like a “revolution” and that they expected restraint from torture or being implicated in false cases by the authorities.

However, it was not clear why they chose to surrender in a public place in south Mumbai which is under a high security cover in view of the ongoing legislature session.

After their surrender, the Mumbai police placed them under formal arrest and handed them over to the Anti-Terrorist Squad for interrogation and further investigation.

“A formal arrest has been registered with the Marine Drive Police Station and later they were handed over to the ATS for further investigation. The case is now being probed by the ATS, as it has the primary charge of investigating Maoist activities in the state,” Deputy Commissioner of Police Ravindra Shishwe told media persons after the developments.

Asked for his reaction, Home Minister R.R. Patil said his department was investigating the matter and he would not be able to comment on it till detailed information is received.

Saeedun-Nissa (42), wife of Mohammed Ali, one of the accused of 2006 Mumbai train blasts, has sought medical compensation as well as action against Anti-Terrorist Squad (ATS) officials for allegedly subjecting her to mental torture and harassment.

In a letter addressed to the Mumbai Police Commissioner with copies to the Bombay High Court Chief Justice, Saeedun-Nissa has charged that ATS officials barged in her house at any given hour, abused her and sometimes even physically assaulted her children.

Talking to Deccan Herald, Jamiatul Ulema, (Maharashtra Legal Cell) secretary Gulzar Azmi said that Saeedun-Nissa submitted her complaint to MCOCA Court (Maharashtra Control of Organised Crime Act) Judge Y D Shinde as well as the High Court Chief Justice and National Commisson for Women and Human Rights Commission,
“We will wait for a month and if no action is taken with regard to her deteriorating health and piling medical bills…then we will move the high court. Saeedun-Nissa has become a high-blood pressure patient because of the continual harassment meted to her by ATS officials and she has named them in her complaint,” Azmi said.

In her letter, Saeedun-Nissa living in Shivaji Nagar slums in Govandi, a north-eastern suburb of Mumbai, recounting the horrors to which she is subjected to she stated, “ My husband a bead-seller was named as an accused only because he had dared to complaint against a video parlour screening pornographic film in neighbourhood.

Police officials know this fact that it is a frame-up but despite this these officials barge into our house and start questioning me whenever a terror attack takes place in any part of the country.  “They are never accompanied by women constables and several times they have slapped my 12-year-old son Sohail in front of my eyes.

The physical assaults and humiliations by these officers have made a diabetic and a high-blood pressure patient.” she alleges. Naming the ATS officials, the victim apart from seeking medical compensation from police has also sought posting of women constables in front of her hut so that her family  gets some respite from ATS officials.

 

#Immediate Release- Indefinite fast in support of demands of farmers-labourer


Lucknow, December 26 : The indefinite fast and demonstration in support of demands of farmers-labourers organized by Socialist Party jointly with National Alliance of People’s Movements (NAPM), Lok Rajniti Manch, Hind Mazdoor Sabha, Rihai Manch, Special Teachers and Guardians Association, entered its fourth day today. Two social activists are on an indefinite fast: Dr Sandeep Pandey, Magsaysay Awardee and Vice President of Socialist Party; and Anil Mishra, social activist.

The gap between the rich and the poor has widened even more, with salary scales of service sector increasing manifold and rising prices over the past years. We believe in the standard recommended by Dr Ram Manohar Lohia that the gap between the income of the rich and the poor should not be more than ten times. Also in a democracy everyone should be getting the same income. We demand that Wage Board should amend the minimum wage of labourers of unorganized sector to Rs 440 so that these labourers don’t receive wage less than the minimum income given by the government. As we know trade union is demanding a minimum income of Rs 11,000 per month for contract workers.

Even the election manifesto of Samajwadi Party had a promise that Farmers’ Commission will be formed to decide the minimum support price for farmers that should be no less than 1.5 times their investment. But the biggest question related to minimum support price is that how will it be implemented? Who will put a clamp on middlemen? The government should demonstrate political will and ban middlemen in matters related to farmers and extortion from the poor people. Be informed that illegal extortion done by three different segments from poor traditional artisans who take part in ‘Kartik Poornima Mela’ in Daliganj was brought to an end last week.

Yesterday former MP Iliyas Azmi said while addressing the indefinite fast and demonstration that Tariq Kazmi and Khalid Muzahid were arrested from Jaunpur and Azamgarh; and Anti-Terrorist Squad (ATS) is lying by falsely stating that they were arrested from Barabanki. We demand that RD Nimesh Inquiry Report should be made public so that there can be clarity on this matter.

Representatives of Special Teachers and Guardians Association are participating every day in this indefinite fast and demonstration. Their President and social activist, Munnalal Shukla, ended his three days fast yesterday as his health was deteriorating.

This indefinite fast will continue till the time government doesn’t respond regarding the demands raised by this movement. Although we have informed Rajendra Chaudhari, Spokesperson of Samajwadi Party, about our demands and this indefinite fast and demonstration, so far there is no proposition from the government to hold a dialogue.

DEMANDS

1. Unorganized sector should get minimum wage of Rs 11,000 per month or Rs 440 per day. Minimum wages should be linked to Consumer Price Index.

2. It is a matter of grave concern that during the last wheat purchase very few farmers could get the minimum support price of Rs 1285 per Quintal because of dominance of middlemen. The same situation is now occurring in the paddy purchase. We demand a CBI probe in this Wheat-Paddy purchase scam.

3. Under the Right of Children to Free and Compulsory Education (RTE) Act, 2009, the clause of 25% reservation for underprivileged children in all schools should be strictly implemented without delay.

4. Illegal extortion and bribes taken for appointments should be stopped.

5. Anti-farmer Maitreya Project in Kushinagar should be cancelled.

6. Innocent Muslim youth who are jailed in the name of terrorism should be released. We demand to make RD Nimesh Investigation Report’ public.

7. Special teachers should be appointed for differently-abled children (handicapped children).

8. Doctors including Dental Surgeons should be appointed in all primary and community health centres.

9. There should be a complete ban on tobacco and alcohol.

Apart from these, effective measures should be taken to curb and control inflation and corruption.
