In yet another case of sexual violation, a seven-year-old girl was repeatedly molested by her maternal uncle for over a month. Both the victim and the accused are residents of the Ramgarh slums located in the Fishermen’s Colony in Mahim. The victim’s mother, who filed the complaint, approached the Mahim police on Thursday.

The incident came to light after the victim, who initially thought what the 17-year-old accused was doing to her was a game, told her mother what he had done.

According to the police, the accused started molesting the victim since the second week of January. Since he was related to the victim’s mother and had free access to the house, he would take the victim out under various pretexts.

However, on Thursday when the victim’s mother asked her whether she enjoyed going out with her uncle, the truth came to light.

The victim told her mother that the accused would take her to a secluded spot near Mahim pipeline, where he would undress her and touch her inappropriately. She also stated that she had been molested at least five times in a month. According to the victim’s narration of events, it appears that the accused had even tried to rape her but could not succeed.

Acting on the complaint registered by the victim’s mother, the police immediately arrested the accused. However, since he is a minor, he was sent to Dongri Children’s Home.

The accused has been booked under sections 375 B (attempt of commission of rape), 354 (outraging the modesty of a woman), 363 (kidnapping) and 364 (kidnapping with the intention of murder). He has also been booked under The Protection of Children from Sexual Offences Act 2012 and will be tried be in juvenile court.

They had gone missing from the village on February 14. The NHRC, on its website, stated that the commission has taken suo motu cognizance of media reports about the three minors being raped and killed. Maharshtra Govt threatens to invoke Mesma on chemists #healthcare

HC Asks State To Take Chemists’ Problems Into Account

Rosy Sequeira TNN

The state government on Thursday told the Bombay HighCourtthatitis exploring the possibility of applying the Maharashtra Essential Services Maintenance Act against chemists who are on strike. However, chemists claimed they were merely closing their shops early and were not on strike.
A division bench of Chief JusticeMohit Shah andJustice Anoop Mohta was hearing an application by advocate Datta Mane to revive his earlier PIL seeking prosecution of members of the Maharashtra State Chemists & Druggists Association, to restrain them from going on strike and find a permanent solution to the issue. Advocate SnehalRatnakar submitted on Mane’s behalf that greathardship willbecausedto peopleduetothestrike.
However, the association’s advocate told the bench it was not a strike but an individual decision taken by some chemists to keep their shops open from 10am to 6pm. He said it was prompted by visits at odd hours, like 3am, by Food and Drugs Administration officials asking about the presence of pharmacists. “If a pharmacist is not presentor hassteppedout
to answer nature’s call, they serve a stop-sell notice,’’ hesaid, adding there was a shortage of pharmacists in the state. He said there were about 70,000 chemist shops in the state but only 55,000 pharmacists, adding many pharmacists take up other jobs. He said while chemists are ready to keep their shops open beyond 6pm, the government must not insist on the presenceof pharmacists.
However, government pleader S S Shinde said the action being taken was statutory and chemists were acting contrary to the undertaking given when applying for licences, which stated they will keep their shops open for at least 12 hours. “It is not a flimsy
ground, we have consistently found that qualified pharmacists are not available,’’ he added. The association’s advocate saidsincetheHC’sOctober 2012 order, the governmentdid nothing and not a single meeting washeldon theissue.
Shinde argued chemists have gone on strike in retaliation againstthe action initiated by the FDA. “We are exploring the possibility of taking action under the Essential Services Act. The commissioner has power to prohibit a strike,’’ said Shinde.
The judges asked the government to show the provision in lawunder which it can insist chemists keep their shops open. The judges also observed that the government must understand the difficultiesof chemists. “Try to understand their difficulty also. Have at least one meeting with them,” said Justice Shah.Thejudgesdirected the government to file a reply and produce a copy of the chemists’ undertaking atthehearing on March 8.
What is Mesma

An offence under the Act is cognisable and punishable with imprisonment up to 1 year. The Act empowers police to arrest offenders without a warrant

A senior police official who has been investigating such cases told TOI about some general provocationsthat may trigger suchcriminal behaviours. “It could be just out of curiosity or peer pressure, in some caseswefoundthatchildsex offenders commit crime because they feel that children are going to judge them like adultsdo. Someoffenders will have sex with anything and children are just one of them.”
The official said that another category of offenders find themselves in a revenge-type situation, where he is in a relationship with somebody but feels that he doesn’t have any power or control over his mate.In thiscasetoo, thecriminal may indulge in such heinous act
and turn violent
with the victim.
Founder

Action Group
(AWAG) Ila Pathak had requested the state government to initiate a programme among rural women to make them awareof thedifferenttypesof child sexual abuses. “TheNCRBdata has shown that in 80 per cent of cases, the child sex offenders are close relatives and neighbours. In rural areas, we have found that there is belief thathaving sex withchildren would give sexual prowess to individuals. In such a situation, it is important that there is awareness in families and also that mothers shouldtalkwiththeir daughterson these issues.”

#Chhattisgarh BJP MP Ramesh Bais justifies rape of women #WTFnews #Vaw

DC Online |

Raipur: A BJP MP on Thursday said the rape of grown-up girls and women might be understandable but if someone does this to an infant, he should be hanged.

He said rape of minor is a heinous crime and those who commits such crime should be hanged.

“The rape of grown-up girls and women might be understandable but if someone does this to an infant, it is a heinous crime and the offenders should be hanged (barabari ya bade logo ke sath balatkar samajh me ata hai, lekin nabalig bachhiyo ke sath is tarah ka jaghanya apradh karma. Inko to fasi par latka dena chahiye)”, MP Ramesh Bais told reporters referring to the rape case involving minor inmates of a government-run residential school in Kanker district of Chhattisgarh.

Asked about the MP’s remarks, the state’s main opposition Congress said assault on women, whether she is a child or a grown-up, is a heinous crime.

Congress spokesman Shailesh Nitin Trivedi said “assault on anyone is a heinous crime. The statement (of Bais) is objectionable and we condemn this”.

Bais said the incident like the one in Kanker happened in several places but they were not reported.

“Just terminating the employees will not bring back the honour of the victims. The accused in the case should be given stringent punishment”, Bais said.

“The incident of Delhi gang rape has rocked everyone to think over such crimes. The incident of Chhattisgarh is a matter of shame,” the MP said.

The MP also suspected the involvement of senior officials and claimed that for the past several months the girls were being sexually assaulted and the concerned officials were unaware of it.

The incident of sexual assault on minor inmates of the government-run residential school for tribal girls in Jhaliyamari village of Kanker district came to light last
Sunday.

So far six people, including two teachers, have been arrested in connection with the crime.

According to police, the medical examination has confirmed rape on nine inmates out of 40 who are living in a hostel.
