Ghaziabad: An ex-student raped his tutor in Kavi Nagar area of Ghaziabad on Monday morning. Police said the incident took place at the victim’s residence when she was alone.
The accused entered the victim’s house and increased the volume of the television to suppress her calls for help. An FIR has been lodged and the accused has been arrested.
Cops said the accused has been identified as Amit (18). He studies in a private school. Two months ago he had sought tuition in accounts from the victim. The victim, who is pursuing B.Com, had agreed to teach the 18-year-old as he was known to her family. The student had failed in his Class XII exams twice. However, but the victim stopped giving him tuitions due to his bad habits.
On Monday, the accused went to the victim’s house at 10.30am and raped her. Later, when the victim’s cousin reached the house, he found the girl injured and bleeding. “She was unconscious so we took her to a nearby hospital. Medical examination has confirmed that she was raped,” said a family member.
When cops were informed, a police team reached the scene and the accused was detained. He was arrested after rape was confirmed.
The family and supporters of the accused allegedly manhandled the victim’s family at the hospital and pressured them to withdraw the case.
Ghaziabad superintendent of police SS Yadav said an FIR under appropriate sections of Indian Penal Code, including 376, has been lodged with Kavi Nagar police station.

Postmen fail to find beneficiaries at the given addresses in slums and colonies; residents cry foul

Thousands of Aadhaar cards of residents living in colonies and slums are gathering dust at post offices or with roadside vendors in these areas as the Department of Posts has not been able to locate recipients at the addresses mentioned on the cards.
For the past few months, postmen deputed in slums and colonies are at their wits’ end as they have failed to locate a large number of recipients at the given addresses. As a result, the undistributed cards are being dumped with area leaders or roadside vendors. In most cases, the cards are finding their way back to the post offices.
At Kajheri village alone, 56 Aadhaar cards were found lying with the area barber while the beneficiaries were running from pillar to post to get duplicate copies of the cards to avail of the services which are now available only after producing these cards. A few days ago, 200 Aadhaar cards were found lying in a garbage bin at Kajheri village.
Sham Singh of Colony No. 5 said two days ago, his area cobbler called him to deliver his Aadhaar card, which the area postman had dropped at his shop with the excuse that he had failed to locate his house. He said these days local confectionery shops and tea vendors were doing public service by delivering Aadhaar cards to residents as postmen often failed to locate them.
A representative of the Aam Aadmi Party, Kamal Kishore Sharma, who visited the colony two days ago, said residents of Kajheri had complained that around 200 Aadhaar cards were lying dumped in a garbage bin in the area. Residents then picked these up and informed the beneficiaries. Thousands of residents in 25 other colonies in the city are facing a similar problem.
A senior official of the Department of Posts said postmen had complained that they often found it difficult to deliver Aadhaar cards at the postal addresses in slums and colonies as a majority of the slum dwellers were not residing at the given addresses.
The official said the situation was even worse in rehabilitation colonies where residents had removed common walls due to which their addresses had changed.
Assistant Director General, Unique Identification Authority of India, Charu Bali admitted that they had received complaints from Kajheri and the department would communicate with the Department of Posts to resolve the issue. She said the UT Administration would also be informed about it so that the issue of delivering Aadhaar cards at the actual addresses could be resolved.
Residents of Mauli Jagran said a local leader had distributed Aadhaar cards to them instead of the postman concerned who was supposed to do so. They alleged that a number of residents had to apply for a duplicate copy of the Aadhaar card as they had not received the original one.
 
AAP delegation meets DC
A delegation of the Aam Aadmi Party (AAP) on Monday met the UT Deputy Commissioner and complained that in Kajheri village, residents had complained that they were being charged Rs 10 for the delivery of an Aadhaar card at their address. Nitika Sharma, a representative of the party, said they had deposited 56 Aadhaar cards, which they had found lying at a barber’s shop in the area, with the Deputy Commissioner’s office. The party has demanded action against those responsible for the lapse.

#Bangalore -DRDO sacks youth who got bail in terror module case

BANGALORE: Ejaz Ahmed Mirza, 25, who has been granted bail in the Bangalore terror module case, has been terminated from the Defence Research Development Organization where he worked as a junior research fellow.

Ejaz, who is likely to walk out of the Parappana Agrahara Central Jail on Monday morning, was among the 15 youths held by the Bangalore police in August-November 2012 for suspected terror activities. However, the National Investigation Agency (NIA) took over the probe and charged only 11 of the 15 arrested. While two of the arrested youths were discharged, Ejaz was granted bail on Thursday.

Ejaz’s father, Rauf Abdul Mirza, confirmed the DRDO order and said he will be reaching Bangalore on Monday morning. “Yes, we received a termination letter from the DRDO dated February 12. However, my current priority is to get my son out on bail and further action will be decided once he is back. We have been told that he will be able to get back to DRDO and we hope it will be possible,” he said.

A DRDO spokesperson said: “He was not a DRDO employee, but was just a junior research fellow with one of the labs, and was taken in early 2012. It is a fellowship programme, and fellows are normally taken for a particular study, which is ongoing and they are encouraged to enroll for PhD etc, while they gain research experience with our labs. This is purely a temporary assignment.

“Based on the performance of a fellow, or when a particular study is completed, his fellowship can be terminated at any point of time by the local lab director. Or, he could get upgraded to a senior research fellow, but even that is not permanent employment with DRDO. The decision on a fellow is left purely to the lab director, and the ministry of defence and DRDO headquarters have no role at all,” the spokesperson added.

Columbia halts mining multinationals in indigenous territory #goodnews

A judge suspended Monday all activities by mining companies in nearly 50,000 hectares of indigenous lands in northwest Colombia, reported local media.

In an “unprecedented” ruling, all mining and exploration activities in 49,421 acres of territories belonging to indigenous Embera Katio communities have been halted for up to six months due to a failure to consult and protect the communities, according to El Tiempo.

“[This decision] only seeks to prevent the continued violation of the rights of indigenous peoples on their territory [arising from] disproportionate use by people outside the community, and the violence that has been occurring in the area, of which there is much evidence, ” said the judge.

The injunction covers an area known as the Alta Andagueda in Choco and Antioquia departments. The companies affected include multinational gold miner AngloGold Ashanti, working in the area with Continental Gold, and Colombian company Exploraciones Choco Colombia.

The judge ordered a halt to activities in 80 percent of the collective territory of the Embera Katio in order to protect the communities, noting that an increase in mining concessions in the area since 2006 has been mirrored by an increase in violence. The area has already seen several indigenous communities displaced to nearby cities due to violence.

While indigenous communities have a constitutional right to be consulted on the use of their land, the judge did not declare the mining concessions illegal but ordered the suspension to protect indigenous communities while the legality of the titles is determined. Some of the licenses held by the mining companies for the area reportedly do not expire until 2038 and 2041.

The decision to suspend mining for the sake of indigenous communities comes in the same week as a decision to suspend an eco-tourism project in Tayrona National Park for the same reason

Gonda, Uttar PradeshA judge in Uttar Pradesh has been accused of molesting two girls in his chambers at a court in  Gonda district, a two-hour drive from the capital of  Lucknow.

The two separate incidents allegedly took place on Monday.

The girls filed independent police complaints in which they allege that the judge made them undress and touched them inappropriately, claiming that he was trying to determine whether they are minors or younger than 18.

The girls were deposing before the judge in two separate cases of kidnapping that were lodged by their families after they had allegedly eloped. They had been summoned before the court to give their statements, which would have been used as evidence.

The police says that to register a case against the judge, it needs permission from the Allahabad High Court, which is awaited.

Lawyers boycotted the court in Gonda and vandalised the judge’s chambers, demanding his arrest.

Police said that they had still not been able to nab the accused.

A seven-year-old girl wasraped at her school in the port town of Vasco, resulting in huge protests here on Monday night.

Police have detained the headmistress of the school on charges of negligence.

The second grade student was sexually abused in the school toilet next to the office of the headmistress during recess on Monday, by an unidentified person, police saidon Tuesday.

The incident came to light after the minor complained of pain and was referred for medical examination.

Several parents and locals protested outside the school on Monday night questioning the negligence on the part of the school management. As the situation turned tense, Chief Minister Manohar Parrikar visited the spot late last night assuring stern action against the accused.

“We will not spare the accused and anyone involved in this crime,” Parrikar said, following which police detained the headmistress.

Police said the culprit is yet to be arrested. A sketch has been prepared based on the description provided by the victim, they said.

Incidentally, the school has been one of the well guarded institute with Central Industrial Security Force (CISF) personnel posted at the gate.

Goa Crime Branch to probe seven-year-old’s rape

The Crime Branch has been directed to probe the rape of a seven-year-old girl in the school premises in Vasco, Goa Chief Minister Manohar Parrikar said Tuesday.

While the rapist is still at large, Crime Branch officials have arrested the headmistress of the school for inordinately delaying the registration of a first information report (FIR).

“The Crime Branch will probe the complaint of rape and negligence by the headmistress separately,” the chief minister said.

The chief minister, along with top administration and police officials, had to rush to the school Monday night after irate residents and friends of the victim’s parents laid siege and did not allow the staff to step out.

According to the police, the girl was found Monday in a state of shock in the school toilet, after being raped by an unknown person who had slipped into the school premises in Vasco, 40 km from here.

The education ministry, which is headed by Parrikar, has ordered the school shut for two days in view of public ire.

The father of Indian woman who died after being gang raped and tortured has said he had not allowed his daughter to be identified after the British Daily Mirror Sunday paper edition revealed her name, Indian newspaper the Hindustan Times reported on Monday.

“I have only said we won’t have any objection if the government uses my daughter’s name for a new law for crime against women that is more stringent and better framed that the existing one,” the paper quoted him saying.

“I want my daughter to be known as the one who could bring a change in the society and laws, and not as a victim of a barbaric crime,” he told the daily-based newspaper.

India has seen widespread protests in the wake of sexual assault on a bus in New Delhi on December 16, when the 23-year-old woman was gang-raped and tortured with iron rod by six men, including a juvenile.

Five men charged with the brutal gang-rape and murder of the paramedic student will appear in court for the first time after police said they had forensic evidence to link them to the killing.

Legal experts say the court in the Saket district of the capital would likely transfer the case to a more senior court during Monday’s hearing.

“The court will ask them if they have lawyers and then it will appoint an Amicus Curiae (lawyer) to represent them and supply copies of the chargesheet to the accused,” said Vishwender Verma, a senior advocate at Delhi High Court.

“The case will then be committed to a sessions court as a magistrates’ court cannot try rape and murder cases.”

The student, who cannot be named for legal reasons, had spent the evening at a cinema with her boyfriend on the night of the attack.

Face death penalty

The five suspects, who could face the death penalty if convicted, are also charged with kidnap, robbery and conspiracy over the attack that sparked protests in India and soul-searching about the levels of violence against women.

The defendants have been named as Ram Singh, Mukesh Singh, Vijay Sharma, Akshay Thakur and Pawan Gupta.

A sixth accused, who is 17, is to be tried in a separate court for juveniles.

It normally takes months for the prosecution to assemble such a case, but the legal proceedings are getting under way barely a week after the 23-year-old medical student died of her injuries in a Singapore hospital.

The government, sensitive to criticism that a sluggish justice system often compounds the agony of victims, has pledged to fast-track the case against the defendants who are aged between 17 and 35. They all live in Delhi.

Police have pledged “maximum security” during the hearing at the magistrates’ court amid fears for the defendants’ safety.

A man was arrested last week as he allegedly tried to plant a crude bomb near the home of one of the men.

Rape cases are usually held behind closed doors in India and it will be up to the court to decide whether the media will be allowed to report.

The police have issued an advisory saying “it shall not be lawful for any person to print or publish any matter in relation to such proceedings” unless they receive permission from the court.

Hate speech: Owaisi seeks 4 more days to surrender before police

Hyderabad: Majlis-e-Ittehadul Muslimeen MLA Akbaruddin Owaisi, in a row over a hate speech, returned early on Monday morning from London to a rousing reception by his supporters at the airport. A hospital ambulance was at his residence for a reported check up on Monday morning.

He was likely to surrender to the police on Monday after being booked for delivering a hate speech, but Owaisi has approached the investigating officer in Adilabad seeking four days extension for appearance. Prohibitory orders, however, remain in force in Nirmal town of the district till 6 pm on Monday in anticipation of his meeting with police.

He was directed by the court to appear before the police in Adilabad district on Monday and in Nizamabad town on January 8. When asked if the police anticipated any trouble due to his appearance, the police officer said, “Everything will be taken care of”. On Saturday, Andhra Pradesh DGP V Dinesh Reddy said Owaisi informed police that he was undergoing treatment in London and would appear before it shortly.

Another notice was served to the MIM legislator by Osmania police asking him to appear before it on January 10. While two FIRs were registered suo motu at Adilabad and Nizamabad districts, a third case was registered by Osmania University police, following a court directive after Owaisi allegedly used inflammatory language against a particular community last month.

Fresh complaints continued to pour in against Owaisi from Malkangiri and Vanasthalipuram, though no cases have been registered, police said.

Owaisi, who represents Chandrayangutta Assembly constituency, has been booked under Sec 153A (promoting enmity between different groups on grounds of religion) and Sec 295A (deliberate and malicious acts intended to outrage religious feelings) of IPC.

The MIM legislator has also been booked under Sec 121 (waging or attempting to wage war, or abetting waging of war, against the Government of India) of IPC.

Meanwhile, TDP and BJP leaders held protests at various places in the state, demanding action against Owaisi. TDP MLA Revant Reddy demanded that Owaisi be disqualified for his comments.

Speaking at a protest, state BJP president G Kishan Reddy said that steps should be taken to ensure that Owaisi returns to India to face the law.

Government issues gag order to TV news channels #Censorship

Stung by the massive anti-government protests triggered by the gruesome Delhi gang-rape, the Information and Broadcasting Ministry has issued a gag order to TV channels.

The ministry’s advisory released late Sunday evening said “inappropriate” media reportage was likely to “vitiate the law and order situation”.

The strongly-worded advisory, which reads much like the media gag orders of the Emergency days, is aimed at forcing TV channels to tone down their coverage.

Terming the coverage by some channels as lacking in maturity, the ministry advised them to report the protests in a “responsible manner”.

This comes at a time when the government only shut down nine Metro stations and blocked access to India Gate to prevent people from gathering there to protest. While Sunday’s protests turned violent, policemen lathicharged even mediapersons covering the protests. Most of the roads leading to high-powered addresses in the capital have been blocked to traffic for an indefinite period.

“It has been observed that some private satellite news TV channels have not been showing due responsibility and maturity in telecasting the events relating to the said demonstration and such a telecast is likely to cause deterioration in the law and order, hindering the efforts of the law enforcing authorities,” the advisory said.

It advised all channels that they should scrupulously following the programme code to telecast the matter “in a responsible manner with due care, maturity and restraint.”

The order pointed out that the programme code stands against any “programme which is likely to encourage or incite violence or contains anything against maintenance of law and order or which promotes anti-national attitude. Signed by joint secretary of the I&B Ministry Supriya Sahu, it ends with a warning that “any violation would invite action under the cable rules.”

Sources said Information and Broadcasting Ministry officials also called up TV news channels asking them against using inflammatory headlines.

The News Broadcasters Association also issued a statement Monday after the attack on mediapersons by the police. It said that all member channels had reported the protests over the last few days with great maturity, sensitivity and restraint. “It would be a sad day for the country, and democracy if any attempt is made to muzzle the media.”

In another development, the Broadcast Complaints Council (BCC) of India, the body covering all entertainment channels, has asked its member channels to refrain from showing any vulgar content. In its advisory, in the wake of the gang-rape in Delhi, BCC told channels to refrain from featuring children below the age of 12 years in any situation that has sexual or adult overtones.

A minor’s rapist and murderer was Monday sentenced to death by a Bareilly court in Uttar Pradesh even as the state government issued orders to slap charges under the stringent National Security Act (NSA) on all rape accused.

Accused Ashok had raped a 10-year-old girl in Vidhauli village in Bhuta area May 27, 2009. After the sexual assault, he strangled the girl.

Special Judge U.C. Pandey held the accused guilty of murder and rape and sentenced him to death. A fine of Rs.1 lakh was also imposed.

In another case, Sessions Judge of Balrampur J.R. Pandey gave a rapist 10 years’ rigorous imprisonment and imposed a fine of Rs.5,000.

The case pertained to Parsia village where a minor girl was raped Feb 10, 2011.

The government Monday issued orders to slap charges under the NSA on all the rape accused. The harsh provisions allow police to keep an accused under preventive detention for up to 12 months
