An organised, disciplined protest against the Mandal-Bechraji SIR

 

More than 10,000 men and women in 500 tractors, 50-60 motor cycles, 10 mini-trucks and 50 four-wheeled vehicles descend into Gandhinagar to express their anger

 

Government efforts to break the movement fail

 

The government projects on the one hand that the people are happy with the Mandal-Bechraji SIR announcement. On the other hand, the government and its representatives Ms. Anandiben Patel, Mr. Nitin Patel and Mr. Saurabh Patel, Mr. Bhupendrasinh Chudasma and the Secretary to the CM Mr. A.K. Sharma were compelled to invite representatives of the anti-SIR movement to the Circuit House in Gandhinagar on the morning of 17th June 2013. The government’s enthusiasm to meet with the representatives of the people shows that the movement is succeeding. However, the pronouncements of the government representatives signifying nothing have left the people disappointed.

 

The government also tried unsuccessfully to stall the people’s plan for a peaceful Tractor Rally to Gandhinagar on the 18th of June. Unprecedented police arrangements were made, since the night of 17th, on the entire rally route. The people were made to go from one office to another, one block to another to secure permission for the rally route. Despite all of this, the people assembled by 8 a.m. on 18th and the rally commenced from village Vithlapur at 8.30 a.m. There were 500 tractors, 50-60 motorcycles, 10 mini-trucks and 50 4-wheelers in the entire rally. On the entire rally route one could hear slogans like “Tell SIR, no Sir”, “Remove SIR, save agriculture”, “The village land belongs to the village, not to the government” and “We will give up our lives, not our land”. The government also tried to enforce a change in the rally route but seeing the turnout of the people and their anger, they let the rally pass on the pre-determined route.

 

Several state and national-level movements and organisations have lent their support and solidarity to this movement. Those in support include Gujarat Lok Samiti, Gujarat Sarvodaya Mandal, PUCL, Bhavnagar District Gram Bachao Samiti, National Alliance of People’s Movement (NAPM), Paryavaran Suraksha Samiti, AWAG, Gujarat Khet Vikas Parishad, Paryavaran Mitra, Paryavaran Santri, Bandhara Bachao Andolan – Mahuva, Kinara Bachao Andolan – Umargaon, Lok Andolan Gujarat, Jyoti Karmachari Mandal, Vadodara Kamdar Union, Documentation and Study Centre for Action, SUCI, Radical Socialist – Gujarat, Gram Vikas Trust – Dwarka, New Trade Union Initiative (NTUI), Lok Sangharsh Samiti, Gujarat Anumukti Andolan, apart from many individuals.

 

The Revenue Minister Ms. Anandiben Patel invited the representatives of 44 villages in the agitation to meet her this evening. At the time of writing this, the representatives were in talks with the Minister.

 

This project, being anti-farmers and unconstitutional, it poses an intellectual, organisational, legal and constitutional challenge to the GoG. The organisational strength has forced the government to concede, rather unwillingly, that this is an organisation and not a mob.

 

The rally finally converged in the Andolan Chhavni in Gandhinagar. The meeting was being managed by a well-known activist of Gujarat Mr. Raju Purohit, and was addressed by, among others, Dr. Kanubhai Kalsariya, former Finance Minister of Gujarat Mr. Sanat Mehta, Mr. Y. K. Alagh, Jayesh Patel of Olpad anti-SIR movement, Lalji Desai, Mr. Rajni Dave of Bhumiputra, and the letters of support and solidarity from noted Gandhians Shri Narayan Desai and Shri Chunibhai Vaidya were also read out.

 

This meeting has demonstrated its resolution and firmness to oppose such anti-people projects of the government. This rally is the first public statement of the movement, where people, in one voice, made their anger and protest clear. The meeting ended with people taking a pledge to not part with even an inch of their land. It is hoped that the government heeds the warning of the people else this movement will gather strength and become more widespread.

  • આખા ગુજરાતને ઔધોગિક વસાહત  GIDC બનાવવા નીકળેલી સરકાર લોકોના આંદોલનને દબાવવાના તમામ નિષ્ફળ પ્રયાસો કરવા બે દિવસથી કામે લાગી છે.
  • માંડલ – બેચરાજી સર સામે લોકોનો વિરોધ નથી તેમ દર્શાવવા નિષ્ફળ પ્રયાસો ગુજરાત સરકાર કરી રહી છે.
  • સર નો વિરોધ કરતાં લોકો ટોળામાં નહીંપણ ૫૦૦ જેટલા ટ્રેક્ટરો, ૫૦-૬૦ મોટર સાઈકલો, ૧૦ મીનીટ્રક, અને આશરે ૫૦ ફોર વ્હીલ વાહનોમાં ૧૦૦૦૦ થી વધુ ખેડૂતો બહેનો-ભાઈઓ એક સંગઠન તરીકે ઉમટી પડ્યા હતા

 

 

એક તરફ લોકો માંડલ – બેચરાજીના ‘સર’થી ખુશ હોય અને તેમણે કોઈ વાંધો ના હોય તેવો ભ્રમ પેદા કરવાની કોશિશ અને બીજી તરફ લોકોના વાંધા અને આક્રોશને કારણે ગુજરાત સરકારના મુખ્યમંત્રી પછીની હરોળના મંત્રીઓ આનંદીબેન પટેલ, નિતિનભાઈ પટેલ, સૌરભભાઈ પટેલ, ભૂપેન્દ્રસિંહ ચુડાસમા અને મુખ્યમંત્રીના સચિવ એ.કે.શર્માએ ૪૪ ગામના કેટલાક વ્યક્તિઓ સાથે સામેથી ગામના લોકોને આમંત્રણ આપી ગાંધીનગર સર્કિટ હાઉસમાં મીટિંગ કરવાની તા. ૧૭/૮/૨૦૧૩ને સોમવારના રોજ ફરજ પડી હતી. લોકોને મળવાની સરકારમાં ઊભી થયેલી આ તાલાવેલી દર્શાવે છે કે લોકોનો વિરોધ, આક્રોશ અને જનઆંદોલન અસરકારક બની રહ્યા છે. ૨ કલાક ચાલેલી મિટિંગમાં ભાગ લીધેલ વ્યક્તિઓને સરકારની ગોળ-ગોળ વાતોથી નિરાશા થઈ હતી.

 

ગુજરાત સરકારે એક તરફ લોકો સાથે વાત કરવાનું નાટક અને બીજી તરફ લોકો દ્વારા લોકશાહી ઢબે પોતાનો વિરોધ દર્શાવવા તા. ૧૮/૬/૨૦૧૩ના રોજ આયોજીત ટ્રેક્ટર રેલી જે વિઠલાપુર, સચાણા, સાણંદ, થઈ સરખેજ, પ્રહલાદનગર, માણેકબગ, મીઠાખળી, આશ્રમ રોડ, ગાંધી આશ્રમ  થઈ  ગાંધીનગર ગઈ હતી તેને રોકવાના એનકેન પ્રકારે નિષ્ફળ પ્રયાસો કર્યા હતા.

 

ગુજરાતને ઔધ્યોગિક વસાહત GIDC બનાવવા નીકળેલી ગુજરાત સરકારે ૨૦૦૯માં ‘The Special Investment Region (SIR) Act, 2009’ કાયદો પસાર કર્યો છે. આ કાયદો ભારતના બંધારણની વિરુદ્ધનો અને ઉદ્યોગો માટે ખેતીની જમીનો કોઈ પણ રીતે સંપાદિત કરી શકાય તે માટેનો કાયદો છે. આ કાયદો પોતે એ વાતનો સ્વીકાર કરે છે કે, ખેતી લાયક, ગૌચર અને અન્ય જમીનો કોઈ પણ રીતે ઉદ્યોગો માટે, “વિકાસ”ના નામે સંપાદિત કરી શકાય તે માટેનો કાયદો છે.

 

ગુજરાતમાં અંજાર, સાંથલપુર, વિરમગામ, માંડલ-બેચરાજી, ઓખા, નવલખી, ચાંગોદર, સિમર, ધોલેરા, હાલોલ-સાવલી, પીપાવાવ, દહેજ અને આલિયાબેટમાં ‘સર’વિસ્તાર જાહેર કરેલ છે.

તા. ૧૭/૬/૨૦૧૩ સોમવાર રાતથી રેલીના આખા રૂટપર જાણે મુખ્યમંત્રી નીકળવાના હોય અને સુરક્ષાની વ્યવસ્થા ગોઠવવામાં આવી હોય તેમ પોલીસ ખડકી દેવામાં આવી છે. પોલીસ પરમીશન માટે પણ કાર્યકર્તાઓને એક પોલીસ સ્ટેશનમાંથી બીજા પોલીસ સ્ટેશનમાં અને એક જિલ્લામાંથી બીજા જીલ્લામાં ધક્કા ખવડાવવામાં આવ્યા હતા. આ તમામ પ્રયાસો છતાં ગામના લોકો મક્કમપણે સવારે ૬ વાગ્યાથી ૫૦૦ જેટલા ટ્રેક્ટરો, ૫૦-૬૦ મોટર સાઈકલો, ૧૦ મીનીટ્રક, અને આશરે ૫૦ ફોર વ્હીલ વાહનોમાં ૮૦૦૦ થી વધુ ખેડૂતો બહેનો-ભાઈઓ ઉમટી પડ્યા હતા. રેલી સવારે ૮-૩૦ ના વિઠલાપુરથી રવાના થઈ હતી. રેલી નો આખો રસ્તો  – ‘સર’ને કહો ‘નો સર’ , માંડલ – બેચરાજી સર હટાઓ ખેતી બચાવો, ગામની જમીન ગામની સરકારની નહીં, જાન દેગે, જમીન નહીં ના પોકારો સાથે ગુંજી ઉઠ્યો હતો.

 

જમીન અધિકાર આંદોલન ગુજરાતનાં ટેકામાં રાજ્ય અને દેશના જનસંગઠનો – ગુજરાત લોક સમિતિ, ગુજરાત સર્વોદય મંડળ, PUCL, ભાવનગર જિલ્લા ગ્રામ બચાવ સમિતિ, નેશનલ એલાયન્સ ઓફ પીપલ્સ મુવમેંટ (NAPM), પર્યાવરણ સુરક્ષા સમિતિ, અવાજ, ખેત વિકાસ પરિષદ, પર્યાવરણ મિત્ર, પર્યાવરણ સંત્રી, બંધારા બચાવ આંદોલન – મહુવા, કિનારા બચાવ આંદોલન – ઉમરગામ, લોક આંદોલન ગુજરાત, જ્યોતિ કર્મચારી મંડળ, વડોદરા કામદાર યુનિયન, ડોક્યુમેંટેશન એન્ડ સ્ટડિ સેંટર ફોર એક્શન, SUCI, રેડિકલ સોશિયાલિસ્ટ – ગુજરાત, ગ્રામ વિકાસ ટ્રસ્ટ – દ્વારકા, NTUI, લોક સંઘર્ષ સમિતિ, ગુજરાત અણુમુક્તિ આંદોલનના અને અન્ય અનેક કાર્યકરો પણ આંદોલનના ટેકામાં જોડાયા હતા.

 

તા. ૧૭/૬/૨૦૧૩ સોમવાર ના રોજ લોકોના પ્રશ્નો સાંભળવાનું નાટક કરનાર મંત્રીઓએ આજ રોજ રેલી સ્વરૂપે અગાઉથી જણાવીને માંડલ-બેચરાજી સર વિસ્તારના ૪૪ ગામના ૧૦,૦૦૦ લોકોના પ્રતિનિધિ મંડળને આનંદીબેને મળવા બોલાવ્યા હતા. આ પ્રેસ નોટ લખતા સમયે મંત્રીશ્રી પ્રતિનિધિ મંડળ સાથે વાટાઘાટો કરી રહ્યા છે.

 

આ આખો પ્રોજેકટ ખેતી વિરોધી, ભારતના બંધારણનો છેદ ઉડાડનારું હોવાથી તેની સામે વૈચારિક, સંગઠનાત્મક, કાયદાકીય, બંધારણીય સંઘર્ષનો સામનો કરવા ગુજરાત સરકારને પડકાર છે.

 

સરકારની ઈચ્છા અમદાવાદ ખાતેની સાણંદ ચોકડી થી ખેડૂત રેલી નો રૂટ બદલવાની હતી, પરંતુ સરકારને ખેડૂત સંગઠન અને તેની સંગઠન શક્તિનો ખ્યાલ આવતા રેલીનો રૂટ બદલવાનું માંડવાળ કરવું પડ્યું હતું.

 

 

 

રેલી તેના જાહેર કરેલ રૂટ પ્રમાણેજ શાંતિ અને શિસ્તપૂર્વક આગળ ધપી હતી.

 

આ રેલી તેના સૂત્રો અને સંગઠનાત્મક શક્તિનો પરચો બતાવતી હોવાથી, ગુજરાત સરકારે કમને એક વાતનો સ્વીકાર કરવો પડ્યો હતો કે, “ આ લોકોનું ટોળું નથી, પણ લોકોનું સંગઠન છે”.

 

રેલી અંતે ગાંધીનગર સેક્ટર ૬ ખાતે ઉપવાસી છાવણીના મેદાન માં સભામાં પરિવર્તિત થઈ હતી. લોકોએ આ સભાને, ‘જાન દેગે જમીન નહીં’, જેવા નારા થી ગાજવી મૂકી હતી. આ સભાનું સંચાલન ગુજરાતનાં જાણીતા કર્મશીલ, રાજુભાઈ પુરોહિતએ કર્યું હતું. આ સભાને માંડલ-બેચરાજી સર થી અસરગ્રસ્ત ૪૪ ગામના પ્રતિનિધિઓએ તથા નિરમા આંદોલનના ડો. કનુભાઈ કલસરિયા, ગુજરાતનાં માજી નાણાંમંત્રી સનતભાઈ મેહતા, વાય.કે. અલગ, ઓલપાડ સર સામેના આંદોલનના જયેશભાઈ પટેલ, લાલજીભાઈ દેસાઇ, ભૂમિપુત્રના સંપાદક રજનીભાઇ દવે, અને જાણીતા ગાંધીવાદી વિચારક નારાયણભાઈ દેસાઈ અને સર્વોદય અગ્રણી ચુનીભાઈ વૈદ્ય નો લેખિત શુભેચ્છા સંદેશ વાંચવામાં આવ્યો હતો.

 

આ સભાએ સરકારને પોતાનો સ્પષ્ટ, મક્કમ, વિગતો, મુદાઓ અને નીતિ વિષયક વાંધાઓ સાથેનો પોતાનો વિરોધ રજૂ કર્યો હતો. આ મુદ્દે જાહેરમાં તથ્યો અને વિગતો સાથે સમાજ અને પત્રકારોની હાજરીમાં ચર્ચા કરવા આવાહન આપેલ. આ રેલી અને દેખાવ આંદોલનની શરૂવાત નું પ્રથમ પગલું હતું. લોકોએ એકી અવાજે પોતાની એક ઇંચ પણ જમીન નહીં આપવાનો જાહેર સંકલ્પ કર્યો હતો.

 

છેલ્લે “અભિ તો યે અંગડાઇ હૈ આગે ઔર લડાઈ હૈ” ના મક્કમ નિર્ધાર સાથે સભા પૂરી થઈ હતી. સરકાર સાનમાં વિગતો સાથેની રાજુવત અને વિકાસની સાચી દિશા સમજે તો સારું, નહીં તો આ આંદોલન વધુ ઉગ્ર અને વ્યાપક બનશે.

Prevent and Respond to End Violence against Women and Girls

We, the undersigned women’s organizations and concerned citizens, express our strong condemnation of the rising incidence of heinous crimes against women and girls in Delhi. This continues in spite of an unrelenting campaign by women’s groups and civil society over the past many months. The recent rape and sexual torture of a 5-year old girl in Delhi once again highlights that the police and administration continue to respond to crimes against women casually, in gross violation of the law.

Delhi and the National Capital Region is not a safe place for women and girls, either inside the home, in workplaces or on the streets. This is evident from the ever-increasing incidents of rape and other sexual crimes against women and girls. This is a shameful indicator of the inadequate response and abject failure of State agencies to uphold the rights and safety of  women. It is time that the government and its entire machinery, including the police, institute mechanisms and practices that will end impunity for all forms of violence against women..

We call on the Delhi Police to carry out efficient and time-bound investigations and take measures to ensure a speedy trial leading to stringent punishment in all cases of sexual violence. The police must also ensure that they take urgent necessary steps to ensure a competent, legal and sensitive responses by its personnel at all levels. We can wait no longer.

We demand that the following measures be undertaken by the police authorities on an emergency basis:

1.     Registration of a case under Sec. 166A IPC against the Investigating Officer of P.S. Gandhinagar , for not investigating the case of sexual violence in accordance with law.

2.     Action against supervising Police Officers – SHO – for failure to discharge their responsibility in supervising the investigation.

3.     Action against all concerned police personnel of P.S. Gandhinagar, for failure to comply with the directive of the Supreme Court of India to immediately register a case of a ‘missing child’ and promptly investigate the same.

4.     Investigation into the allegation of bribe to the parents to hush up the case.

5.     Standardized investigation procedures to be circulated to all police stations, with action taken against police personnel who do not implement them properly;

6.     Increased sensitization, effective investigation and accountability of the police at all levels in dealing with all crimes against women and girls.

#India – Gujarat riots were not spontaneous and sudden Mr Narendra Modi

In the past 10 years, the Gujarat government and senior BJP leaders have often said that the riots that broke out in the state in February 2012 were an ‘instantaneous reaction’ to the carnage at Godhra. The chief minister himself in an interview on March 1, 2002 had said, “What we are witnessing in Gujarat at this time is a chain of action and reaction. We want that there neither be action nor reaction.”

But now Headlines Today has uncovered the police control room messages and the state intelligence bureau reports which show that the police had received a constant stream of inputs from its field officers about VHP leaders making provocative speeches, about crowds being mobilised and warnings about the possibility of major riots breaking out. Despite the flurry of ground reports and advance warnings, no curfew was imposed in Ahmedabad till noon the next day. The BJP government supported the VHP called bandhs that, as events turned out, proved to be the pretext under which violent mobs were mobilized. VHP leaders were not warned or put under preventive detention.

But the most intriguing aspect of these messages is that while they have been produced before the court as annexures, they don’t find any mention in the 541 page closure report filed by the SIT. No attempt has been made by the SIT to reconstruct the sequence of events as they unfolded immediately after the news of Sabarmati train incident broke. The SIT did not assess the adequacy or appropriateness of the state’s response in a chronological fashion as the law and order collapsed in large parts of the state.

 Perhaps, that’s the reason that the facts that emerge from these messages are hard to reconcile with the conclusions drawn by the SIT.

There were two centralised police control rooms in Ahmedabad in 2002 – Ahmedabad Police Control Room situated at Shahibaug in the heart of the city.  Naroda and Gulberg Society, where around 150 people were burnt to death on the 28th of February lay within a radius of 6 KMs from this Police Control Room 9Gulber was 2 to 3 kms from the control room while Naroda was roughly six kilometers).

The second one — the State Police Control Room — located at Police Bhawan in Gandhinagar.

The Ahmedabad Police Control Room received messages of the build up taking place in Ahmedabad City. The State Control Room got messages from different districts in the state.

In February 2012 the SIT submitted before an Ahmedabad court, in a sealed cover, only the Ahmedabad City PCR messages… a copy of these are now with Headlines Today. The State Control Room messages are still missing.

There was also a third control room…this was at the State Intelligence Bureau Headquarters situated inside Police Bhawan, Gandhinagar…the  same building where the State DGP’s office is located. The SIB Control Room was also flooded with field intelligence reports filed by its intelligence units located across the State including Ahmedabad and Gandhinagar. These SIB reports too have been submitted before the Court by the SIT. A copy of these too is now in the possession of Headlines Today.

By the afternoon of February 27, the Gujarat home department was being bombarded with messages from cops on the ground about mobilisation of VHP and Bajrang Dal cadre.

Rightwing activists across the state were holding public meetings, making provocative speeches and inciting mobs. All this is documented in hundreds of wireless messages sent by policemen to the state intelligence bureau. But the State failed to take any effective steps to prevent the imminent massacres. Within a few hours after the Godhra tragedy, the three senior-most office bearers of Gujarat’s VHP unit -Jaideep Patel, Dilep Trivedi and Kaushik Patel– issued a statement declaring a state wide bandh and containing remarks that were designed to incite the mobs.

A field level officer faxed this statement to SIB headquarters at 20:38 hours on the 27 Feb 2002.

Despite these warnings there was no clampdown by the Gujarat government on the mobilisation being carried out by the VHP leadership and neither were VHP and Bajrang Dal members taken under preventive detention.

The Speical Investigation Team in its report accepted that the Modi government supported the bandh called by the VHP.

Page 134 of SIT closure report: “Shri Vijay Badheka, Under Secretary to Home Department has stated before the SIT that both Gujarat bandh on 28.02.02 and Bharat bandh on 01.03.02 were supported by the BJP.”

The bandh allowed the VHP cadre a free run even as the SIB kept sending signals of impending riots and sought preventive action.

When the Ahmedabad police commissioner P.C. Pande and State DGP K. Chakravarty were questioned by the SIT, they were not confronted with these specific SIB reports. P.C. Pande was not asked why curfew was not imposed in Ahmedabad city on the 27th afternoon itself, particularly in the face of such specific intelligence inputs.

Pande told SIT on page 7 of his statement recorded on 24.03.2010: “The circumstances did not exist on the 27.02.02 or even on 28.02.02 to warrant the imposition of curfew and any hasty decision would have led to panic in the city. Even otherwise with limited forces available imposition of curfew becomes a serious problem and large scale breach becomes common.”

Pande and Chakravarty were also not asked why VHP and Bajrang Dal leaders were not put under preventive arrest even as they were threatening violence.

But the SIT has not explained what these specific measures were. General and vague claims made by Gujarat State Officials that all possible efforts were made to control the riots have been accepted by the SIT.

The State Intelligence Bureau repeatedly pressed the panic button, sending SOS’ to the home department about the possibility of riots. Bodies of kar sevaks in public display and funeral processions by mobs…proved to be the trigger. But records show the VHP and its cadres succeeded in stoking mass hysteria.

30 minutes past midnight on the 28th of February 2002, the state intelligence bureau received a fax giving a specific warning about possibility of riots with bodies being brought to Ahmedabad. Then VHP state unit president Jaideep Patel was already on his way escorting the 54 bodies from Godhra to Ahmedabad.

“I went to Sola Civil Hosptal around 10:00 and found that doctors were under pressure to complete the documentation wheras relatives were in a hurry to take the bodies. However, I didn’t find anything alarming and as such returned around 11:00 am.”

Pande also claimed there were no funeral processions, a claim accepted by the SIT. But the PCR messages show that there were not only processions but also riots at the hospital, nailing Pande’s lies.

Inspite of all of this, the then Ahmedabad Police Commissioner told the SIT that he didn’t find the “circumstances on the 27th and 28th fit for curfew.”

PCR and SIB reports show that there were regular inputs of VHP and Bajrang Dal led mobs swelling at Naroda and Gulberg Society.

Pande admitted before the SIT that at both these places curfew was declared only after 12:50 pm …by then the mob had already swelled to between 10 and 15 thousand people in number. It is no wonder that the curfew that was finally imposed remained only on paper – it had no effect on the ground.

Hundred and fifty men, women and children were burnt and hacked to death at Naroda and Gulberg society in the four hours between 2 and 6 PM on February 28.

Police Headquarters at Shahibaug was only 2 to 3 kilometers from Gulberg Society and around 6 kilometers from Naroda Patiya.

Pande admitted before the SIT that through out the day he didn’t move out of his office and visited Naroda Patiya and Gulberg only late in the evening…by that time the massacre was over and done with.

In his defence Pande said in his statement: “On 28.2.2002 requests were received from different police stations seeking additional force and SRP and whatever forces were available with me the same were dispatched. SIT accepted Pande’s defence and gave him and the Gujarat Administration a clean chit.

The state government told the SIT that the 2002 riots were a spontaneous reaction to the Godhra tragedy, but documentary evidence tells a different story.

Eleven years after the after the horrific incidents as Narendra Modi aspires for the prime minister’s chair, Headlines Today has tried to throw fresh light on why his ascension remains so contentious.

Univ of Colorado at Boulder scientist deported from Delhi airport ,labelled as ‘scaremonger’

New Delhi, Dec. 11: An American seismologist highly-rated in geological circles but labelled by some as a “scaremongerer” has said that the Indian government has, under the influence of a senior Indian scientist, banned his entry into India.

Roger Bilham, a University of Colorado geophysicist, who was sent back from New Delhi airport on May 19 this year while in transit to Bhutan, has said that he learnt again last week that he is still on a list of foreigners not permitted to enter India.

Sections of Indian scientists familiar with Bilham’s work say his research studies on earthquake hazards in the subcontinent have generated controversy in India, but said they are surprised at the government’s decision to keep him out of India.

Bilham and a collaborating Bangalore-based geophysicist Vinod Gaur had suggested that Indian authorities might have underestimated the seismic risk at the site of a proposed nuclear power station in Jaitapur, Maharashtra.

Over the past decade, Bilham has predicted that the Himalayan region is ripe for several giant earthquakes greater than magnitude 8, and cautioned that any one of these could kill more than a million people in the densely populated urbanised Gangetic plains.

“It’s unfortunate if Bilham has been barred entry because of his scientific views,” said Rangachar Narayana Iyengar, an earthquake engineering expert in Bangalore and the former director of the Central Building Research Institute in Roorkee.

“Differences of opinion in science must be allowed, indeed encouraged — that is the way science advances,” Iyengar told The Telegraph.

Bilham, who has visited India at least six times over the past decade, first learnt he was on a list of unwanted foreigners on the night of May 19 when he was sent back to the US from New Delhi airport while he was trying to fly to Bhutan for a field trip.

Bilham, who has a 10-year multiple-entry tourist visa from India, said he had written about his deportation to the US state department on May 21, which informed him on May 22 that it had learnt that he was on a list of individuals not permitted to visit India.

“They were not told why I was on the list. I enquired again last week because I was planning to visit Delhi to study historical archives,” Bilham told The Telegraph via email. “They confirmed that I was still on the prohibited list.”

Indian home ministry officials have not responded to email queries from The Telegraph, seeking information about the circumstances under which the government had decided to keep Bilham out of India.

But Indian scientists say they are intrigued by a claim made by Bilham in writing to the Indian Institute of Science (IISc) in Bangalore that the government appears to have been influenced by a senior Indian seismologist.

“The government decision was presumably based on recommendations made by one or more influential seismologists in India,” Bilham wrote to the IISc on October 17 this year, in a letter where he has declined to evaluate the PhD thesis of a young scholar.

The IISc had requested Bilham to assist in the evaluation of the thesis.

“It has been brought to my attention that some younger colleagues have been intimidated by a retired (Indian) seismologist who once held a position in Hyderabad, from working with me, or being associated with scientific studies, or discussions,” Bilham told the IISc.

“The intimidation takes the form of suggestions that future funding, or chances of promotion, or job security, may be placed in jeopardy if these young scientists are in any way associated with my name,” he wrote, adding that his presence on the panel of thesis examiners might turn detrimental to the future of the young scholar.

Shailesh Nayak, secretary in the Union earth sciences ministry said he had no direct information about the decision to keep Bilham out of the country. “My understanding is that it has something to do with his tourist visa,” Nayak said.

But Bilham said he has never had a problem with his visa.

In January this year, he was invited to an Indo-US bilateral workshop on intraplate seismicity at Gandhinagar, Gujarat, a meeting supported by the Indo-US Science and Technology Forum, an initiative funded by the Indian and US governments.

A senior Indian geophysicist who knows Bilham well said his research and style of making presentations in India may have irked sections of senior scientists. “I have had a good working relationship with him, but he’s regarded by some as a scaremongerer,” said Bal Krishna Rastogi, director of the Institute of Seismological Research in Gandhinagar, which hosted the workshop . “It’s not nice for scientists to come here and tell us that we’re not doing anything. Whatever might be lacking in our efforts here is because of (lack of) resources.”

Bilham’s deportation from India also featured at the American Geophysical Union meeting on December 6 where Max Wyss, a Switzerland-based seismologist, mentioned it as an example of scientists being punished for predictions.

Gaur said the decision to disallow Bilham from visiting India is “against the philosophy of science”, which, he said, demands honest, open debates. “When science gets closed to scrutiny, there is a danger that it might get done with less rigour.”

Iyengar said he’s also concerned about the impact to young scholars. “Seismic risk is a borderline area of human knowledge — disagreement about hazard risks are always present, but punishing someone who holds a contrary view might turn young people away from seismology.”

 

#India-Three Bangalore bar girls gang-raped #Vaw #Rape


Three bar girls were gang-raped by a group of eight-nine men, who broke into their house located on the outskirts of Bangalore late Thursday night.

The victims’ house is adjacent to Jnanabharathi campus, where a 21-year-old law student was gang-raped on October 6. Police said the three victims stay with five other bar girls. Most of them are from north India and work at Casino Royale bar and restaurant in Gandhinagar.

“The girls returned from work at 12.30am. While they were watching TV, someone knocked on the main door,” police said.

“The security guard opened it without checking who it was. An armed gang of eight-nine men barged inside and forced all three security guards into a room. They then took three girls inside a room and raped them. They also looted the house,” the police added.

The three victims were then taken to another house, where one of them was raped again.

One of the bar girls, on condition of anonymity, said the men forced all eight of them to strip and then made videos using their mobile phones, threatening to circulate the video clips if anyone informed the police.

Police suspect the miscreants had been following the girls for a few days.

Gujarat Riots peaked after Kodnani’s arrival: Court #Narendramodi


 

 

Special court said that Maya Kodnani had done nothing to restore peace in the riot-torn Naroda Patia

Special judge Dr Jyotsna Yagnik who conducted the trial in the Naroda Patia murder case, noted in her verdict that, according to eyewitnesses, the riots had intensified and peaked after the arrival of Naroda MLA Maya Kodnani. The court also set aside Kodnani’s defence that she was at the Gujarat assembly during the massacre and that she had become a victim of political conspiracy.

“As far as Kodnani and other leaders of the communal riot are concerned, and as far as other accused leaders who were admittedly members of the Peace Committee of the Sardarnagar police station and Naroda police station are concerned, they have not been found to have done any act of a peace agent or a pacifying agent,” said the court in its judgment. “The CD provided by the accused [Kodnani] shows that the accused was in the Legislative Assembly up to 8:40 a.m. of February 28, 2002. This court is of the opinion that Gandhinagar and Ahmedabad are twin cities and that it is hardly at a distance of 30 km from Ahmedabad,” the court said.

It further said that if Kodnani was relieved at 8:40 a.m. (as had been claimed by her), it could not have been difficult for her to reach Naroda Patia after 9 a.m. “In the records of this case, the witnesses have stated that all the disturbances were started and, in fact, reached a peak after the arrival of Kodnani,” the court said.

It further said that if Kodnani had not provoked Hindus (as had been argued by the defence), then there was nothing on record to show that she had played the role of a pacifying agent. “She had not done anything to stop the massacre; she had not instructed even the police officers to stop the lawlessness at the site,” the court observed.

Regarding the role of the state police in shielding Kodnani, the court said: “This court is not sitting in an ivory tower and is conscious of the hard realities of the system. In the system, normally if a police officer knows the desire of the political leader, the officer would not leave a single stone unturned to give all colours to such desire.” The court further said that to respect and to give ‘colours’ to the desire of Kodnani, the police had taken all care to ensure that the statements of all the eyewitnesses repeated the same thing.
