AURANGABAD: The state home department has suspended Sandeep Bhajibhakare, one of three senior police officials accused of sexual harassing a woman police constable from the Aurangabad police commissionerate. Bhajibhakare, who was assistant commissioner of police (ACP) (Aurangabad cantonment) when the woman constable levelled charges against him, was recently transferred to Chiplun in Ratnagiri district as deputy superintendent of police (Dy SP).Confirming the suspension, Aurangabad police commissioner Sanjay Kumar said, “The state government suspendedBhajibhakare more than two weeks ago. He has approached the Maharashtra Administrative Tribunal against his supension.”

In August 2012, the woman constable had complained to the Maharashtra State Women’s Commission (MSWC) that she had been sexually assaulted by Bhajibhakare and two other ACPs, K S Bahure and Naresh Meghrajani.

Highly-placed police officials said the suspension was based on the findings of the high-level committee that investigated the woman constable’s complaints. The committee was formed after the MSWC directed the Aurangabad police commissionerate to conduct a high-level probe into the matter and submit the findings within a stipulated time. After the inquiry, the findings along with the statements of the complainant and the three accused, and the alleged evidence submitted by the complainant, were sent to the MSWC and the director general of police’s (DGP) office in November.

The woman constable had also approached senior Shiv Sena leader Neelam Gorhe, who took a delegation to the city police commissionerate and demanded immediate action against the three ACPs.

Bhajibhakare was transferred to Chiplun in December last year. Around the same time, on orders issued by the DGP office, Bhajibhakare was also booked under section 509 of the IPC at the Satara police station.

In a reprieve to Bhajibhakare in mid-February this year, the Aurangabad bench of the Bombay high court quashed a judicial magistrate order to issue process against him under section 376(B) (rape by a public servant with woman in his custody).

Tarn Taran, March 4: Policemen in Punjab were seen clearly on camera hitting a young woman who allegedly tried to complain about harassment by a truck driver. The shocking footage was shot on a cellphone by a witness.

Four policemen have been suspended for the brutal assault. The 23-year-old woman says she was harassed by the truck driver while returning from a wedding party.

Her family then decided to approach constables who they spotted on the road at Tarn Taran near Amritsar.

But, the woman says, instead of helping her, the policemen took a bribe from the driver and started beating her.

Despite the footage, a senior police officer tried to defend the cops involved. “I don’t think our cops did anything (wrong)… they were actually trying to intervene and stop the fight between two sides,” said Sukhbir Singh, who heads the local police station.

Some policemen said that the altercation began when constables tried to arrest the victim’s father, who was allegedly drunk and was misbehaving. They say the woman tried to stop her father from being taken away by the policemen. However, they agreed that even if that were the case, there was no justification for the police hitting her in retaliation.

A policeman was arrested for allegedly molesting a woman on the pretext of conducting an investigation at her residence in Mapusa town near Panaji, police said on Tuesday. Constable Prashant Dawaskar, 30, was arrested on Monday after a woman lodged a complaint with Mapusa police that he, along with four other civilians, ransacked her flat and molested her, while trying to conduct a probe on a complaint against her husband, police said.
The woman and her six-year-old daughter were at home when the alleged offence took place, while her husband was out on his duty. The woman mentioned in her complaint that Dawaskar entered her house on Sunday at around midnight without a woman police constable and body searched her, amounting to molestation.
Superintendent of Police (North) Vishram Borkar said the constable had been arrested and placed under suspension. There was no formal complaint against the woman and the constable acted on his own, Borkar said. The woman alleged that all the persons entered the house forcibly claiming that her husband owed them money.

NHRC directs U.P. govt. to give Rs. 5 lakh to kin of Dalit girl killed by constable; The constable had murdered and hanged a Dalit girl after a failed rape attempt

The National Human Rights Commission (NHRC) has directed the Uttar Pradesh government to provide a compensation of Rs. 5 lakh to the family of a 14-year-old Dalit girl, who was murdered by a police constable after a failed rape attempt in 2011.

The incident happened in the Nighasan police station in Lakhimpur-Kheri district of the State.

Atiq Ahmed, who lived on the police station premises, used to lure the girl often with money or gifts. On June 10, 2011, he tried to drag the girl into his room. When she resisted and screamed in protest, he first tried to gag her with his hand and then strangulated her with her dupatta.

The constable then hanged the body from the branch of a fallen tree in the vicinity to paint his crime as suicide.

The first post-mortem had dismissed the case as suicide. It was only after the intervention of the government that a second post-mortem was carried out by a special team of Lucknow doctors, who confirmed the death as on account of “strangulation.”

The NHRC, which took up the case suo motu following media reports, took serious exception to the attitude of the law keeper.

The Station House Officer, who was supposed to uphold law in his jurisdiction, joined hands with the accused, who was his personal security officer-cum-gunner, and helped him, along with other cops, by destroying evidence and cut the tree itself on which the girl was hanged. A team of three government doctors too helped the accused police personnel by creating records that stated the cause of death as “ante-mortem hanging.”

After considering the material on record, the Commission observed that “in view of the report of the investigation team of this Commission and the investigation carried out by the CB-CID, it is established, prima facie, that a police constable attempted to rape the 14-year-old victim, daughter of a watchman, strangulated her to death and then hanged her from a tree on the premises of police station Nighasan.

“Two constables attempted to destroy evidence. The team of three doctors who conducted the post-mortem examination colluded with the police and gave a false report on the cause of death as ante-mortem hanging. The senior police officers committed dereliction of duty by not taking timely appropriate action.”

In response to NHRC notices, the U.P. government informed that in addition to initiating department proceedings against the delinquent policemen, a charge sheet under Sections 302 (murder), 376 (rape), 511 (punishment for attempting to commit offence punishable with imprisonment for life or other imprisonment) and 201 (disappearance of evidence) of the Indian Penal Code (IPC) was filed in the court against them.

While the circle officer was transferred, five other policemen were suspended. Besides, all four doctors who carried out the first post-mortem on the girl were also suspended.

The Citizens for Justice and Peace, Mumbai has made a contribution of Rs 51,000 to the Commissioner of Police Welfare Fund towards the injury suffered by police women and men on duty during last Saturday’s (August 11, 2012) demonstration. The CJP while commending the restraint and maturity shown by top echelons of the Mumbai police and the repeated assurances that no innocents from any community would be booked, also appeals to other organisations in the city to come forward with gestures of solidarity and good faith (we are enclosing a list of names of police officials injured). As citizens who criticise the police when things go wrong, it is our duty to also express vocal appreciation when a situation is controlled effectively.

 

 

 

 CJP along with other women’s activists and organisations have also in a written complaint to the National Commission for Women urged that an investigation into allegations of mishandling and molestation of women police officers be undertaken. Attached is a copy of the complaint sent to the National Commission for Women today. Signatories to the complaint include Citizens for Justice and Peace, Forum Against Oppression of Women, Awaaz-e-Niswaan, Bharatiya Muslim Mahila Andolan, Sabrang, IIWA (Iqra International Women’s Alliance), WRAG (Women’s Research and Action Group).
