Fourth Arvind Memorial Seminar has started in Chandigarh

Emancipation of Indian Society is impossible without finding a solution to the Caste question

Chandigarh, 12 March. The dicussion involving the various intellectuals and social activists arrived here from different corners of the country on the subject ‘Caste question amd Marxism‘ has started in the Fourth Arvind Memorial Seminar that has commenced in Bhakna Bhavan today.

At the very beginning of the seminar, it was clearly stated that no project of eliminating exploitation in Indian Society can be put forward without giving due consideration to the caste question. In this five-day seminar, various historians, social scientists, writers, social activities from states like Punjab, UP, Delhi, Haryana, Maharashtra, Bihar etc. are participating. In addition, senior leaders from both the main political parties of Nepal are also participating along with the intellectuals from the Britain and Germany.

In the commencing session of the seminar, Satyam from Arvind Institute of Marxist Studies said that in the seminar, issues like relation between Marxism and Ambedkarism, political ideas of Dr. Ambedkar, Marxist Understanding of the caste qusetion, historiographic writing of the caste question, caste question and dalit literature & aesthetics etc. will be thoroughly debated so that the obtacles to the social change can be removed. He said that in last few years the mechanical thinking prevalent in Marxist circles has undergone a change and in Dalitists also, questions are being raised regarding the ideas of Dr. Ambedkar.

Satyam also said that there has been a trend to bring a compromise between the Marxism & Ambedkarism, and a trend of subaltern & identity politics. Analysis of these trends from Marxist perspective is also the need of the hour.

Managing trustee of Arvind Memorial Trust, Meenakashi said that a national level seminar on the important issues concerning the communist movement of India is organized every year in the memory of Com. Arvind. Arvind Institute of Marxist Studies has been founded to carry out the research and study on the theoretical and practical issues faced by the communist movement of India.

While welcoming the various guests reached for the seminar, Sukhwinder, editor of Punjabi magazine Pratibadh said that left movement in Punjab has a distinct history and the caste question has also always remained here in its peculiar form. It has been a big thing for us that such a seminar is being organized here in Chandigarh.

The commencing session was presided over by the politburo member of Unified Communist Party of Nepal (Maoist) and famous literary critic Ninu Chapagai, senior trade-unionist from Mumbai Deepati, Trustee of Arvind Memorial Trust Meenakshi, and editor of Magazine ‘Ahwan’ Abhinav. The stage was conducted by poetess Katyayani.

The program started after paying homage to Comrade Arvind. Then the team from ‘Vihaan’ cultural group presented revolutionary songs.

Overall, 14 papers and write-ups will be presented in the seminar on different aspects of the subject. The base paper of the seminar ‘Caste Question and its solution: A Marxist Viewpoint’ is prepared by the research team of Arvind Institute of Marxist Studies. Other papers include ‘Ambedkarism and Dalit Liberation’ by Sukhwinder, editor of Punjabi journal Pratibaddh; ‘Historiography of Caste’ by Abhinav, editor, Aahwan; ‘Class, Caste and Identity Politics‘ by Shivani, Delhi University; ‘Caste and Politics in West Bengal‘ by Praskanva Sinharay, CSSS, Kolkata; ‘Caste and Sex in Marxist Traditions’ by Dr. Rajarshi Dasgupta, JNU; Marxism and the caste question’ by Asit Das, Researcher and Activist, New Delhi; ‘On Identity Politics’ by Prashant Gupta, B.R. Ambedkar College, Delhi University; On Conjoint Relevance of Marxism and Ambedkarism by Sukhdev Singh Janagal, Punjab and on the limitations of caste and identity politics by Jai Prakash of the ‘Jati Virodhi Andolan’.

Eminent historian Prof. Irfan Habib will send a background note on caste in India, Ninu Chapagain, Politburo Member and in charge of the Cultural Division of UCPN (M) will present a write-up on ‘The Dalit Question and Aesthetics’ and a paper ‘Towards A Programme for Abolition of Material Basis of Casteist Hierarchy’ by Dr. Anant Phadke, Shramik Mukti Dal (Democratic), Pune will be presented. Prof. William Paul Cockshott, University of Glasgow will make a presentation through internet linkup and his paper ‘Dr. Ambedkar or Dr. Marx’ will be circulated as a background note.

Punjab- Aspiring model alleges sexual exploitation by singer Nachattar Gill #Vaw

LUDHIANA: Noted Punjabi singer Nachattar Gill and three others have landed in a trouble after an aspiring model alleged sexual exploitation by them. She alleged that they had established physical relations with her on the pretext of sending her abroad and making her a top model.

The girl, a resident of Haibowal appeared before Police Commissioner Ishwar Singh and alleged that he gave her a cold drink laced with sedative at a Chandigarh hotel where they took objectionable pictures of her.She said she was raped by three others also when they visited Singapore.

The victim disclosed that she came in contact with Gill when she was adjudged first runners-up at a beauty pageant at Jalandhar in 2006 where the singer was one of the judges.The duo soon became intimate after they started talking to each other frequently.

The girl used to meet the singer in Ludhiana and Phillaur hotels.She also claimed that the singer had assured to make her a top model in the industry and established physical relations with her on several occasions. She also disclosed that their relation turned sour when she questioned the singer why she was not featured in music albums.

Later, the singer started blackmailing the girl on pretext that he would make the video footage public.Apart from Gill, three city residents also took advantage of her condition. The trio took Rs 20 lakh from her parents so that she could settle abroad.The two city residents also made her MMS when they were in Singapore and established physical relations with her.

She alleged that the third person established physical relations with her on pretext of helping her seek legal action against those who had sexually exploited her.

Meanwhile, Nachattar Gill termed her allegations baseless and a conspiracy against him, adding that he was ready to join investigation on March 5.

High Court finds application of UID/Aadhaar illegal like the Parliamentary Committee on Finance

 

Responding to the direction issued to the Union of India and Union Territory of Chandigarh by Punjab and Haryana High Court in the matter of Civil Writ Petition 569 of 2013 filed in the High Court against Union of India and others, the Executive Order for making Unique Identification (UID)/Aadhaar has been withdrawn.

 

In its order the bench of Justice A K Sikri, Chief Justice and Justice Rakesh Kumar Jain dated February 19, 2013 had not noted that the petition “raises a pure question of law.” Since the Executive Order was withdrawn, the case too was disposed of March 2, 2013 with a two page order. 

 

The Order observes, “In this writ petition filed as PIL, the petitioner has challenged the vires of notification issued by Union of India for making it compulsory to have UID Cards. Admittedly, this issue is pending before the Supreme Court and therefore, on

 

the last date of hearing i.e. on 19.2.2013, we did not observe anything on this issue.”

 

It is further observed that “Second issue raised in this petition is that vide order dated 5.12.2012, respondent No.3 i.e. Deputy Commissioner, U.T., Chandigarh has given directions to the Branch In charge Registration-cum-Accountant, office of Registering & Licensing Authority, Chandigarh not to accept any application for registration of vehicle and grant of learner/regular driving licence without UID card.”

 

It is quite bizarre that Union Territory of Chandigarh remains ignorant of the fact that UID is not a card, it is a 12 digit number. The entire government machinery is hiding the fact that fundamentally UID is not a proof of identity, it is an identifier contained in the Central Identities Data Repository (CIDR)of (UID)/Aadhaar Numbers. Union Territory of Chandigarh failed to inform the Court the UID is not a card but an identification number based on biometric data without any legal mandate.

 

The petition had made the following prayers:   i) Issue a writ in the nature of certiorari to quash Executive order dated 5.12.2012 passed by respondent no.3  passed in violation of Motor Vehicles Act, 1988 and Central Motor Vehicle Rules, 1989 vide which  UID has been mandatory for the registration of vehicles  and grant of learner/ regular driving licence.

 

ii) a writ in the nature of mandamus directing Union of India to accept other proofs of Identity and address i.e. Voter I-Card issued by Election Commission of India, the Constitutional body and Passport issued by Ministry of Foreign Affairs, Govt. of India and other proofs of address, age prescribed under Rule 4 of Central Motor Vehicles Rules, 1989 for issuance of learning/ regular driving licence and for registration of vehicle;

 

iii) Further it sought direction for Union Territory of Chandigarh and Union of India not to make mandatory UID for essential public Utility Services and accept other documents as proof of Identity and address as per the Rules;

 

iv) a writ in the nature of certiorari quashing notification dated 28.1.2009 being illegal and further issuance of a appropriate writ declaring the Unique Identification Authority of India constituted vide Notification dated 28.1.2009 unconstitutional as the same has no legal sanctity as the UIDAI been constituted and functioning illegally as the National Identification Authority of India Bill-2010 is pending in the Parliament of India.

 

The writ petition had emphasized that during the pendency of the petition Executive order dated December 5, 2012 and other similar executive orders vide which Adhaar have been made compulsory for essential public utility services may kindly be stayed.

 

In its concluding paragraph the March 2, 2013 order of the High Court reads, “Today, short affidavit of Mr.M.Shayin, IAS, Deputy Commissioner, UT, Chandigarh is filed stating that the aforesaid instructions have been reviewed and now the insistence of UID card is no longer treated as mandatory. No further orders are required to be passed in this petition, which is accordingly disposed of.”

 

It is noteworthy that UPA’s Budget Speech of 2013 announced that “We are redoubling our efforts to ensure that the digitized beneficiary lists are available; that a bank account is opened for each beneficiary; and that the bank account is seeded with Aadhaar in due course.” In the light of the High Court’s order, the implementation of opening of bank accounts seeded with UID/Aadhaar is legally and constitutionally questionable.  Earlier, Parliamentary Standing Committee, Finance rejected the UID/Aadhaar project and the related UID Bill in its report to the Parliament dated December 13, 2011.

 

Citizens Forum for Civil Liberties (CFCL) has been campaigning against unregulated biometric, surveillance and identification technology companies since 2010 and had appeared before the Parliamentary Standing Committee, Finance in this regard. CFCL has consistently underlined that the silence of the States which are quite vocal about threats to federal structure from Union Home Ministry‘s National Counter Terrorism Centre (NCTC) and National Intelligence Grid (NATGRID) that integrates 21 sets of databases in the matter of the creation of UID’s Centralized Identities Data Register (CIDR) disregarding the fact that Planning Commission’s CIDR and Home Ministry’s National Population Register (NPR) is inexplicable.

Punjab: Man sets pregnant wife ablaze, arrested #Vaw #Justice

Chandigarh: A man was arrested for allegedly setting his wife on fire in Punjab‘s Jakopur village over a petty matter, leading to her death, police said on Sunday.
Gurmej Singh alias Laddi Palwinder Kaur was arrested yesterday for setting Palwinder Kaur ablaze on Monday after she clipped his nails too deep cutting into the skin, Deputy Superintendent of Police (Shahkot) in Jalandhar district, Harpreet Singh said.
She was rushed to hospital where she succumbed on Thursday, the DSP said.
The victim’s kin told police she was persistenly harrased for dowry, the DSP said.
In her statement given to the Magistrate before her death, the victim told the police that her husband had set her on fire after thrashing her.
The DSP said Kaur had called up her brothers in Amritsar and expressed her fear that her husband may harm her.
“She told them that her husband was enraged as she had clipped his nails too deep cutting into the finger’s skin. After she made the phone call, Gurmej abused and thrashed Kaur and later sprinkled kerosene on her and set her on fire,” he said.
Two brothers of the victim rushed to Lohian, but found their sister in a semi-burnt condition and rushed her to civil hospital at Lohian, from where she was referred to a Jalandhar hospital, where she succumbed to her burn injuries, he said.
The brothers of the victim claimed she was pregnant, but the DSP said they were waiting for the postmortem report.

Four months ago, she was brutally raped by seven men who made a video-film on her and chopped off her hair.The 14-year-old, a class VIII student, has not had the courage to return to school since then. Her two younger siblings did not go to school for a month after the sordid incident. The victim’s family has decided to sell their small piece of land and migrate.

Across the village fields is the house of Manpreet Singh,22, the key accused. His father Gurjeet Singh, 54, and his elder brother Charanjeet Singh, 56, are co-accused in the case along with four others. Shinder Singh, 50, Gurjeet Singh’s brother, is the only one left at home to tend to the fields and the cattle. “Shoot us but don’t call my brothers and nephew rapists,” he says. Showing documents pertaining to a civil suit, Shinder Singh claimed: “We have been framed. The girl’s father had sold us a piece of land some years ago. When the price of the plot went up, he sought more money but we refused.”

An FIR was filed on October 20, 2012, alleging that Manpreet Singh and his friend Raju had forcibly taken the girl to a room 150 metres from her house and raped her . The victim’s further alleged that on October 14, the two called her up, asking her to meet them outside her house. They promised to delete the video-clip on her.

However, the two, who were accompanied by five others, took her away and raped her again. They cut off her hair and dumped her outside her house.

The Deputy Commmissioner said there was no scheme under which the victim could be rehabilitated. The Senior Superintendent of Police said the police had acted immediately on receiving the complaint and booked the accused.

BATHINDA: Even before the memories of Patiala gang rape and suicide case fade, another abduction and gang rape of a 26-year-old nurse, who was in Chandigarh to attend a job interview, shocked Punjab on Sunday.In an observation in the Patiala gang rape and suicide case, the Punjab and Haryana high court last month had made scathing criticism of the state of affairs in Punjab, saying there is need to combat the ‘rape culture’ in the state. However, the ‘rape culture’ seems to be continuing in the state without any shame.In the latest case, the nurse from Landeke village in Moga district was thrown out by the rapists from a car on Bathinda-Dabawali road on Sunday evening, two days after her abduction. The girl, who had completed her nursing course from Mata Sahib Kaur College in Gidderbaha in 2007, is battling for life at Bathinda civil hospital now.

According to a statement given to Bathinda’s Rama Mandi police station SHO Paramjeet Singh, the girl, who had been looking for a job, was informed by one of her friends that there was a vacancy at a Sector 34 hospital in Chandigarh.

She took a bus to Chandigarh on Friday morning and got down at Sector 43 bus terminal when an unknown person came to her asking for an address. Before she could utter a word, the girl was dragged into a car in which another woman and a man were seated. They gagged her and the trio injected her with some drug after which she fell unconscious.

When she woke up, she saw four men in a room and one of them was filming her in the nude. When she screamed, he injected her with another dose of some drug. The girl alleged that she was gang-raped by the men. On Sunday morning, she was dragged into a car in a semi-conscious condition by the gang. Later, the girl was thrown out of the vehicle around 5.30pm on Sunday near Rama Mandi area on Bathinda-Dabawali road.

A car driver, Rohitas Kumar of Kular village in Abohar district, spotted the girl in a serious condition and admitted her to the civil hospital in Bathinda.

The police have registered a case and a hunt is on for the culprits, said Gurmeet Singh Kingra, DSP, Bathinda.

Doctor Poonam Dhillon of the civil hospital has conducted a medical examination of the girl and confirmed that the girl was gangraped.

On December 26, a minor girl had ended her life in Patiala after the cops failed to take action against those who violated her. A 26-year-old woman was thrown out of a moving car on Sunday after being abducted and gang-raped in Punjab’s Moga district.

The woman was thrown out by the rapists on the Bathinda-Dabawali road. The victim is battling for life at a hospital.

According to the woman’s statement to the police, she took a bus to Chandigarh on Friday morning. After she got down at Sector 43 bus terminal an unknown person came to her asking for an address. Before she could say anything, she was dragged into a car where there was another woman and a man. They gagged her and injected her with some drug after which she fell unconscious.

A five-year-old student at a private school in Sector 22 was sexually assaulted, slapped and threatened by the driver of the private cab who was dropping her home from school at around 12pm on Saturday.

The accused, Pawan Kumar, 26, of Nayagaon village near Chandigarh has been arrested. A family member of the victim told TOI, “At around noon, my niece came home crying loudly. When I asked what happened, she told me about her horrific experience.”

According to the relative, the regular cab driver Sharwan Singh, had gone to Ludhiana to attend a family function and he had given the charge of ferrying children to and from school to Pawan. A medical examination of the victim, who fell sick and is traumatized, was conducted at GMH-16.

The victim and five other children used to go to school in Sector 22 together. The turn of the victim came in the end. In her statement to the police and family members, the child said that the driver committed the crime, after which he slapped and threatened her. The statement of the child was recorded in the presence of her family members and women cops.

Punjab Police drew criticism from all quarters, including the victim’s kin, after it revealed the name of the 30-year old woman who was abducted and gang raped on Friday night.

The police released the victim’s name in a press note on Sunday. According to reports, the press note was issued after the First Information Report (FIR) was lodged by police on the basis of complaints.
According to lawyer Rahul Verma, naming a rape victim is a punishable offence under Section 228 (a) of the Indian Penal Code.
“The provision is clear; it says nobody can publish the victim’s name in such cases.
Recently, the Supreme Court, in connection with the Delhi gangrape, said no name has to be disclosed, because there is a social stigma that exists in our society,“ he said.
Meanwhile, the incident has spurred an outpouring of anger from women in the state.
“There is a sense of insecurity all the time, we feel threatened. There has been outrage over the Delhi gang rape and another similar incident has occurred here. It shows that women are not safe anywhere,” said Daljeet Kaur, a resident of Pathankot.
Police have arrested six people so far, including the bus driver and conductor.
The woman was travelling by bus to her village when the driver and his assistant drove her to a deserted location and raped her.
Five more people reportedly joined them later and assaulted the woman in a house. They then dropped her off near her village the next morning. The victim went home before going to a police station to file a complaint.

 

#Patialagangrape : Punjab and Haryana High Court says enough is enough

“Enough is enough”, the Chief Justice of the Punjab and Haryana High Court today asserted, while taking suo-motu cognizance of news reports on suicide by a minor over alleged harassment by the police after rape.

Chief Justice Arjan Kumar Sikri also drew a parallel between the law and order situation prevailing in Delhi and Punjab, and minced no words to say crime against women was on the rise in the state.

In a scathing indictment of the Punjab Police, the Chief Justice went on say: “The manner in which incidents have happened over the past few days is an eye-opener. Enough is enough…. The primary function, nay, the solemn duty of the police is to protect the citizens and track down crimes. However, when the police starts shielding and protecting the culprits and starts treating the victims of crime as accused persons, it is a sad day for the democracy of a country governed by the rules of law.”

Chief Justice Sikri issued notice to Punjab and Haryana along with Chandigarh, directing the authorities concerned to fix responsibility on erring officers before coming out with a detailed report on the incident and circumstances leading to the suicide.

The Chief Justice said the incident depicted a “very sordid sate of affairs”. The victim of rape was not only “harassed by policemen”, but also continuously threatened by the alleged rapists, he observed.

Compelled by “these adverse circumstances and filled with indignation, the minor girl thought the only course of action left was to end her life”.

The Chief Justice added: “Woman rights are human rights”, but in the present case the alleged rapists were “only not arrested, but were allowed to reportedly threaten the victim, as well as her family members. They were allowed to roam freely, and the repeated requests of the victim and her mother had no effect on policemen who remained deaf. On the contrary, they kept harassing the victim and her family by asking awkward questions and passing vulgar remarks, whenever the victim visited the police station”.

In his two-page order, the Chief Justice asserted: “Delhi has already acquired the dubious distinction of being labelled the ‘rape capital’ of the country. Irony is that the state of affairs is not confined to Delhi alone and the situation in Punjab is also far from satisfactory. There is not only an upsurge in general crimes against women, but also heinous and ghastly crimes like rape in the state.

“There is also a need for combating this rape culture by reforming various other institutions. Law for punishing such crimes appears on the statute book. It is the lack of adequate and enforcement system that also contributes to repeated commission of such offences. There is a need for proper law and order machinery in preventing such occurrences. In order to curb such criminality, criminal justice system also required to be revamped and strengthened.”
