Horrible week for Karnataka students: Girl made to beg by Father , two dead

Bangalore, Ndtv : A father forced his daughter to beg on streets for not studying well, another girl committed suicide as a question paper leak led to an exam being rescheduled and a school-going boy was brutally murdered -the week began on a horrible note for students in Karnataka.

The bizarre way of disciplining the 13-year-old class 7 student took place in Mysore, 130 km from Bangalore, while the body of a class 12 student was found hanging from a ceiling fan of her hostel room in Davangere, about 260 km from Bangalore.

The brutal murder of the boy, studying in class 8, happened in Bangalore. The naked body of the boy bore eight stab wounds.

In the Mysore incident that took place late on Monday a man identified by police as Prakash, working as a technician in a city hospital, sat in a car belonging to his friend opposite the temple where he watched his daughter beg.

The incident would have gone unnoticed if the girl was not in her school uniform, police said.

Visitors to the temple were surprised to see a girl in school uniform begging and some questioned her persuading her to tell her story, police said.

Prakash was arrested and later released by a Mysore court on bail. The girl was taken to a government shelter home.

On Tuesday an official of the shelter home accompanied her to the school to sit for exams.

Though the girl has expressed her desire to go back to her father, this will be done only after counselling both and once the authorities of the government home are satisfied, police said.

In Davangere, the body of Neetu Umapati, was found hanging from a ceiling fan of her hostel room on Tuesday.

Police said her classmates told them that apparently she took her life as she had become nervous after the rescheduling of the mathematics examination following a question paper leak.

The class 12 students in the state have been having a hard time this year as question papers of at least three subjects have been leaked forcing rescheduling of the exams.

The death of Neetu was raised in the assembly on Tuesday but Chief Minister D.V. Sadananda Gowda said police had informed him that the suicide had nothing to do with the postponement of the examination.

He, however, expressed anguish over the death and urged students and their parents not to get agitated over question paper leaks and rescheduling of examinations.

In Bangalore, the body of class eight student E. Abhishek was found on Tuesday with eight stab wounds, police said.

The murder was committed on Monday evening, they said adding that they are questioning four boys of his age-group as he was last found talking to them.

The Great Indian Nuclear Maya

By Saraswati Kavula

28 March, 2012

Like the philosophers say, we, the people of India, are surrounded by “Maya” – an illusion: and that illusion today is Democracy. Under this illusion we think, we the people are the ones who decide who “rules” us, we think innocently too that ‘we the people” are the decision makers, king makers. In our sad state of minds, we think that this great country has a democracy – that is “by the people, for the people, of the people’ – meaning the people are supreme. However, the Indian voter is supreme only till such time; he trudges to the electoral booth and makes his thumb print. In many a places, even that is a mere illusion, for the ones who have the ‘muscle power” will decide who wins – voting themselves to power. Then there is this greater illusion that is created – with money, liquor, sarees, kumkum boxes – that this entire exercise is a celebration of people’s power – no wonder then that our election jamborees are called, “election festivals” in some parts of the country.

Thence, the so called “elected representatives” of the people, thus “elected” to power, with promises like supplying of TV sets, surely keep their promises of “providing every house with a TV set”. So, that they may numb people’s minds with the constant bombarding of mind numbing, programs. Is it any wonder then that people, who think they have “elected” their leaders, finally have to “bite the bullet” literally, when it actually comes to asserting their democratic and human rights?

What has happened in Tamil Nadu, yesterday, is the greatest example of this illusion called “Indian democracy”. Purichchi Talaivi, Amma as she is fondly called, has finally decided that the Koodankulam Nuclear Plant is absolutely safe and has also stated that the local people’s fears have been allayed as far as the safety of the plant was concerned. Wonder, then why does she need a battalion of 3000 strong police force, to start the plant, or that the people who were peacefully protesting all these days have to be slapped with sedition cases? And then she adds that she is going to spend 500 crores for the development of Tirunelvelli district. Perhaps, that is the reserve fund for the treatment of the local people from cancers, failed organs, genetic mutations and other ailments which will surely follow in the near future once the plant starts operating. At least their situation is better than the people living near Kalpakkam, who are suffering silently – from cancers, genetic mutations and organ failures to name a few. No body made a promise of 500 crores to these people when Kalpakkam plant started. Like everywhere else, they were made a promise – of “progress, development and of course were told they were doing that in the interest of the nation”.

When I was discussing about the issue of Koodankulam with a friend, he said, that these plants were necessary for development of the economy. So, when I pointed out, about the impacts that the local people will have to face – his take was, “the local people must be told about the effects, and that their sacrifice is needed in the interest of the nation. And then with their consent, the plant should be started”. He too is under an illusion, that the powers that be will be “honest” with the public. The blatant lies that the Nuclear Industry across the world has been telling people, and the way our dear DAE has been convincing us about Atoms for Peace, is missed by the millions of “educated” Indians. Wonder how many of them will agree to “sacrifice” for the sake of the nation – “if they are told the truth about radiation effects” and if they come to know that their own children could be born with radiation impacted diseases?

But as I said, in this Great Indian Maya, we continue to allude ourselves that by saying, “all is well”, “all will be well”. Alas, radioactive elements and nature do not work according to the script unlike a bollywood movie. Therefore, while “we the people” used to happy endings, in our escapist movies, keep thinking, that “Indian Nuclear Industry” has had no accident till now, hence, the best in the world, there are ugly facts, that are hidden by the “make up” provided by the DAE and their likes. In case of Nuclear, there is no “happily ever after” situation – as till date not a single country has been able to figure out how to dispose off the tons of high level radioactive Nuclear waste, lying near the 435 nuclear power plants, and where low level radioactive poisons are routinely being released into the atmosphere and dumped into our oceans and seas. But, smug with our latest “illusion” about India becoming a “superpower”, our middle class thinks that there can be accidents in highly technologically advanced nations like Japan, USA, or Russia but it can Never happen in India!

Our Prime Minister thinks that making a loss of 1, 76, 000 crores to the national exchequer by his minister, is not a good enough case to prosecute him. Yet, he thinks that the people of the country, in whose interest he is supposed to work, for whose sake he should have taken a decision that would protect the current and future generations, feel the people of kudankulam are working against “national interest”. Hence, cases of sedition and conspiracy cases are being slapped. And his spin of “Maya” continues that the protesters have a vested interest, and have taken money from American NGOs! So, our dear Prime Minister, who incidentally never got “elected”, had been under the ‘illusion” that he was working in the “interest” of the nation, when he brushed aside the concerns of the Parliament and the entire country and signed the Indo-US nuclear deal. It’s another matter, that another deal helped him keep his “kursi” post the Indo-US nuclear deal. So, in this game of musical chairs and magic numbers, where anyone can come to power with the power of money, it is a wonder then that the “Indian people” who have been seeing this kind of tamasha for the last 6 decades, still believe in this great Indian Maya called, ‘Democracy”.

Accepting the Nuclear Liability Cap Bill according to the dictates of the Nuclear Powers and trying to pass it in the Parliament at any cost it self speaks of the “Sell out” to the Nuclear Lobby by the Prime Minister and his Government. However, today, he is trying to make us “believe” that all those who are standing up to save their lives, livelihoods and the lives of the future generations are doing anti-national activities. And ‘we, the thinking people’ believe him.

The claim that the “expert committee” has found the safety aspects absolutely up to the mark is another example of this “Maya”. The expert committee, is not an independent committee, and is headed by M.R. Srinivasan, a former chairperson of Atomic Energy Commission, and a very strong advocate of Nuclear Energy. So, is it any surprise that he would find the safety mechanisms of Koodankulam absolutely safe? That this is an absolutely new technology and not tested anywhere else in the world, and that this project got sanctioned, soon after and despite the accident of Chernobyl is another fact, that is not highlighted. The bigger question is who is telling us all these things: the state and the central governments and the ‘experts’ who work under the Department of Atomic Energy, which is directly controlled by the Prime Minister. So, how should we believe this Committee? But we must. Because this is the great Indian Maya!

So, our leaders, our bureaucrats, technocrats – all are trying to put us under this “maya’ or illusion, that come what may, Nuclear Industry in India is absolutely incident free and has a spotless record. While just in December 2009, 95 people have been affected by radiation impacts due to contamination of the drinking water with tritium at Kaigah NPP. The authorities dismissed that as “human mischief”. A flooding that occurred in 1994 in Kakrapar Nuclear Power Plant, contaminated the nearby lake with radioactive elements, as the dam of the pond where the spent fuel is cooled, was breached. When I was in Kakrapar in 2010, the local people told me, “don’t go in there, that water has radiation”. But there was no warning sign announcing of the danger. This water flows on under a bridge and joins a stream. And here people are fishing and even bathing in that water. When asked if they knew that it was dangerous, the villagers replied, “Well no one told us that we should not use this water. The NPCIL always comes and takes samples, but never tells us the results. But, we do see occurrence of strange diseases in our village. Just a few days ago, four people died”.

So, the easiest way to maintain that ‘all is well’ is to not divulge any information at all to the public. And then say, “Indian Nuclear Industry” has a spotless record. And later on say, “we have allayed the fears of the people’ and then use 3000 strong police and military force, to “convince” the protesters that “all is well”. Thus, today, the great Indian public – (not the people of Koodankulam), believe that Nuclear is absolutely safe. And we shall continue to live under this “illusion” or “Maya” until another Fukushima could happen. Even then, I am not sure, once the 24 hour “breaking news” time is up, whether ‘we will realize the real dangers” of Nuclear radiation – that no body dies – immediately that is – only the death shall be slow and drawn out and painful and no one knows who will be next and shall haunt not one but hundreds of generations – creating a country of diseased people!

Tibetan activists in ‘ Preventive Detention’ and ” House Arrest” in Delhi

New Delhi, March 27 –Tibetan activists are being randomly rounded up on “preventive measures” in the Indian Capital on the eve of Chinese President Hu Jintao’s visit.

Around 5.30pm, well-known Tibetan writer, poet and activist Tenzin Tsundue was arrested by policemen in plainclothes from India Habitat Centre, where he was in the middle of an academic discussion on Tibet and India. Seven other activists were also arrested under preventive sections in separate incidents in the New Delhi area. Delhi Police officials said Tsundue had been arrested under preventive sections for his “notorious activities in Bangalore” where he had staged a protest during the Chinese premier’s visit in 2005.

Dhardon Sharling, communications officer for the Tibetan Women’s Association who had organized the talk, said, “We had just taken a tea break when some men forcibly picked up Tenzin Tsundue from the lobby of the hall. We pleaded with the police officers to let him answer the questions posed to him during the talk, then take him away. However, they roughly pushed us away. The talk was planned three weeks ago and was in conformity with Indian laws.”

Tibetan MP Youdon Aukhatsang said, “As a preventive measure, police are arresting Tibetan activists. They have just arrested two Tibetans after they held a press conference at the Press Club to issue an appeal of religious leaders on the situation inside Tibet.”

Areas with large Tibetan settlements like Majnu ka Tila, Ambedkar Bhawan and Buddh Vihar Tibetan Market witnessed a clampdown with cops disallowing students, working professionals and tourists to move about freely in the city while citing “apprehension for violence”. Though the section 144 CrPC had been imposed only in certain parts of central Delhi, cops restricted the movements of Tibetans all over Delhi.

Special commissioner of police (law and order) Dharmendra Kumar said, “We had rejected the application of Tibetan activists to hold protests as there are international security concerns. However, when they continued to protest on Monday, we allowed them to sit at Jantar Mantar. But as they turned violent and tried to run towards Parliament, we had to deploy a massive force to contain them and finally arrest 153 of them under preventive sections. We have imposed the Foreigners Act in the city now to restrict the movement of those Tibetans who have come to the city to protest. If they fail to follow the directions, we will take further legal action.”

But residents of these areas complained that they were stopped from going to work, attending college and even going out for regular household activities like buying groceries. “No autos were allowed to carry us, police shooed them away. My friend works in Gurgaon but was not allowed to report to work. Her boss refused to believe her. Police should allow routine facilities like going to hospitals and colleges,” said Tenzin Yangki, a student living in Majnu ka Tila.

The situation was worse at the Tibetan SOS Youth Hostel in Rohini Sector 14 where around 240 Tibetan students are housed. “We have been locked up in the hostel since morning. Many of us have missed our exams and project submission deadlines. We pleaded with police that some of us have exams at 9am but they finally allowed some of us to go to college at 10am. By then, we had already missed the exam. The rest of us have remained confined to the hostel all day and have been told by police not to interact with media,” said Palden Sonam.

Early in the day, two Tibetan volunteers of the New Delhi based Indo-Tibet Co-ordination Office was detained from the Press Club. The two were helping organize a press conference for ITCO.

Core Group for Tibetan Cause, the coordinator umbrella organisation of Tibet support groups in India strongly condemned the random mass arrests calling it “undemocratic and illegal” on the part of the agencies of the Indian government.

“We call upon all democracy loving individuals and groups of India to advise the policy makers of the Government of India to permit the Tibetan refugee community to express their opinion in a democratic and peaceful manner,” the group said in a release today.

Outside Tibetan residential areas in New Delhi, Rapid Action Forces armed in full riot gear have been deployed in large numbers.

The gates to Majnu-ka-Tilla, a popular Tibetan residential area as well as the Tibetan Youth Hostel in Rohini, are closed while police are keeping a strict watch on every movement.

The heightened security measure comes a day after 27 year old Jamphel Yeshi set his body on fire in an apparent protest against China’s continued occupation of Tibet. Jamphel Yeshi continues to be in a serious condition and has been shifted to another ward in the Ram Manohar Lohia Hospital

Breaking News- Kobad Ghandy discharged of UAPA charges

Naxalite Kobad Ghandy freed for lack of evidence

New Delhi,:   Additional Sessions Judge Pawan Kumar Jain framed charges against 65-year-old Gandhy under various provisions of the IPC relating to cheating, forgery and impersonation in the case in which he is accused of trying to set up a base for banned outfit CPI (Maoist).

The court, however, discharged Ghandy of the charges under the Unlawful Activities (Prevention) Act due to improper sanction from the authorities.

“In my opinion, case is made out against Ghandy under the provisions of Unlawful Activities (Prevention) Act but I am discharging (of the charges under UAP Act) him for want of proper sanction,” the judge said.

Confirming the development, his lawyer Rebecca John told a TV news channel, “The sanction by the government to prosecute him was found to be defective by the court.”

“It is time the government realises that people with a particular view point cannot be put in jail,” she added.

Gandhy was facing trial for allegedly trying to set up a base of his banned outfit in the capital.

He was was also chargesheeted by the Delhi Police under various stringent charges of UAPA, besides those of cheating, forgery and impersonation under the Indian Penal Code. The 64-year-old Ghandy was arrested by Special Cell of Delhi Police in September 2009.

The investigators, who claimed to have recovered a fake voter identity and pan cards from Ghandy, also referred to a CD in which he was shown to be addressing armed cadres of the banned organisation.

They had pointed out that after his arrest, Jharkhand police inspector Francis Induwar was abducted and killed by Maoists on October 6, 2009 and leaflets were distributed in Maharashtra for bandh in protest against his detention. In the supplementary charge sheet, the police had put on record a fresh sanction to prosecute Gandhy under section 45 of the Unlawful Activities Prevention Act.

Gandhy’s counsel had opposed it on the ground that the sanction was improper.”At the time of institution of the first charge sheet, there was a sanction. That sanction was incorrectly obtained. Now, this supplementary charge sheet has been filed to cure a defect. It is not a charge sheet but a curative petition,” Gandhy’s counsel had said.

The prosecution had denied any illegality in the first sanction and maintained that a fresh sanction was obtained in the light of the amendment to the UAP Act.

Ghandy studied at the Doon School and St. Xavier College in Bombay. He later went to London to complete his Chartered Accountancy. From 1975-77, he started a Human Rights Group, Committee for Protection of Democratic Rights in Mumbai. The late seventies and early eighties showed Kobad’s inclination towards Communism.

This fight is between truth and falsehoods- Soni Sori from Raipur Jail ( Hindi and English)

Letter to the Supreme Court Judge (through  Advocate sir)
Honourable Judge Sahib, the Chhattisgarh government is committing many wrongs on me even today.  I tolerate everything, and I do not have any intention of troubling you repeatedly through my letters, or causing grief to you, or putting any undue pressure on the decision of any case. But what can I do – I am compelled to do this (write to you), since no one wants to understand my circumstances.  I try my utmost that whatever problem I encounter gets resolved through the jail authorities or in the (lower) courts. But it does not happen this way, and instead, the problems get compounded.  Due to this, I am left with no option but am compelled to give you the information/ complaint. I have full faith in you.  Whenever this court (Supreme Court) hears the case, it will seek the truth and decide only after hearing both sides.
This fight is between truth and falsehoods. Even knowing all the truth and falsehoods, the police and administration is heaping atrocities on me.  The Essar note incident has ruined my life.  Even now, my life is on the verge of death.  Now I have to see for myself—I have heard and I have read that Truth can be beleagured but it cannot be defeated.  Walking on this path of Truth, I am facing many difficulties, trials and tribulations.  While I have lost myself, my body has also borne so many atrocities that there is no saying when it may also stop supporting me.
At this time, I have to face many difficulties. Three months have passed and I am not being given any medicines.  My treatment was left incomplete.  The problem in my body has increased significantly.  I have problems walking.  Suddenly, my body swells up.  While walking, my feet suddenly go numb.  Even I am a human being, then why this injustice?  Why have I been condemned to this life of torment, agony and punishment?
Judge Sahib, I want to know from you, from the Court, what wrong have I committed? First, they tortured me mentally, committed unbearable atrocities on me, and put me behind these prison bars. If I had to be sent to prison in any case, then why send me after subjecting me to such injuries, wounds and atrocities? And even if they have put me in prison, why are they unable to give me treatment for the wounds inflicted by the police and administration, to get me back into a healthy condition?
It was upon the order of the Supreme Court that I was taken to Kolkata for treatment.  During the treatment, the doctor advised me to be regular in taking my medicines till the internal pains do not get better. But I am not being given these medicines.  I have complained about this in the Jagdalpur jail.  After coming to the Raipur jail, I have told the Jailor Madam many times about this.  Even in the lower court in Dantewada, I said that my internal problems are increasing.  My medicines should be made available to me.  In spite of all this, I have not been given medicines till today.  Troubled by such circumstances, I even asked the Doctor Madam of the Jail that I need to be treated.  The Doctor Madam began to  say, “You have come here through the Administration” and put in writing that I am a Naxalite woman and thus I was put through mental harassment.  Then, I kept quiet for a few days.  My pains go on increasing.
Under such circumstances, on 27-02-2012, when I went for the court hearing and saw my lawyer, I told him that in this condition, it will be difficult for me to stay alive.  Then the lawyers presented an application in the court for my treatment.  The application was approved and the jail received an order for my treatment.
On 1-2-2012, Jailor madam sent me to the hospital.  But my treatmentcould not be completed that day.  Since the time (for seeing patients) was up, the doctor called us back on 6-3-2012 so that sonography could be conducted that day.  But I was not taken to the hospital on 5-3-2012. Then I told the Jailor Madam and the Jail Superintendent that, “Sir, my internal pains and problems are increasing.  Why are you not sending me to for treatment?  The Doctor has recommended sonography.  It is important to get it done.  Please, do not be so negligent in this matter. I have a lot of weakness. At this time, I am unable to do anything.  I have to face a lot of difficulties.  Please send me to the hospital and get my sonography done, so that I can get the right medicines which will provide me relief from my pains.”
Even on explaining all this to him, the Jail Superintendent said, “I cannot do anything.  Nothing is in my hands.”
I asked him then, “If all this is not in your hands, in your control, then what should I do? Please tell me. “
He said, “I don’t know. Understand?”
Then I said, “First, you did not even take me for the hearing on 6-3-2012 and produce me in the court there.  Had I gone for the hearing, I could have informed the court about my condition.  You have deprived me of this opportunity.  It was necessary for me to be present in this hearing.  Now, who is responsible for this?”
The same reply, “I have nothing to do with all this.  Nor is this my responsibility.  Understand?”
Then I said, “Alright, sir.  I will write a letter to the government.”
Honourable Judge sir, please give some thought to what I have written.  What should I do under these circumstances?  I leave all this to you.  I am weary of the rules, regulations and injustices of the Chhattisgarh government.
Judge sahib, it is necessary for me to be present for my hearings because my family cannot make it to each hearing due to their circumstances, and I need to know about the charges against me and the truth and falsehoods of the cases against me.
(2) My internal problems have worsened because of non-availability of medicines and treatment.
(3) My father is now disabled because the Naxalites shot him in the leg.  When he comes to meet me in the court, he is made to feel helpless.
My children are being mentally harassed.  My children do not know anything.  Why are my children interrogated?  My little girl is now mentally traumatized and fearful due to this behavior of the police.  This fear is not good for my girl’s life.  Should something happen to me in the near future, please ensure that my children are taken care of.  These children have no one besides me – even the father of my children is in jail.   My father’s property has been completely destroyed by the Naxalites.  This is why even this family is living a life of destitution.
Whether it is the Raipur Jail or some other jail in Chhattisgarh, I will not be allowed to live in a good condition, nor will they keep me in a good condition.  Neither can I feel protected, nor am I safe.  Still, I should be sent back from the Raipur jail to the Jagdalpur jail so that I can meet my children from time to time, till I am alive.  One of these days, the Chhattisgarh government will surely kill me. Because subjecting adivasis like me to atrocities, cruelties and torture, and then awarding us with death is the biggest victory and success of this government.
Judge sahib, I am facing a lot of difficulties in the Raipur Jail.  I pray to you to be taken back.  Please forgive me for my mistakes.
